@@lang1031 Actually no it does not mean that. I’m a criminal law student and started in the medical field. What I realized is MOST people don’t fully understand terms like this. I mean let’s look at how cops who are 20 years in don’t understand basic laws and policies. Secondly what it shows is that her lawyer is cutting corners and not fully explaining to his client the full repercussions of this plea. This happens a lot.

I’m only about 6 minutes in, just before she tells the defendant to go talk with her attorney for the 2nd time, so I’m not sure how much worse it gets. But I agree that her attorney seems to have dropped the ball in regard to making sure his client was fully informed of what taking the plea truly entails. ETA: Yeah, ok yikes. I just heard the lawyer (try to) address the judge/court and wow. Didn’t look at the judge, was nearly impossible to undo due to his mumbling etc.

I'm not so sure it's the attorney's inability to represent her. I think she is not wanting to hear what is being said, that she has A, B and C in her head and suddenly she's being told something totally different. Also Judge Boyd doesn't dumb down her language and I suspect many words with many syllables went over her head. ETA: it's not always possible in a legal setting to say something differently or replace terms with simple ones because it might change the meaning enough to where it would be inaccurate.

Absolutely agree. It is sometimes very difficult for someone who is educated and intelligent to be able to articulate information to someone who is ignorant and unintelligent. When the stupid person is also entitled and has a piss poor attitude, that bridge is really difficult to gap. It comes across as trying to explain calculus to a kindergartner. This seems like a case where a very intelligent and experienced attorney simply was unable to make an entitled and stupid person understand concepts that she did not want to address. She’s gotten away with acting like a turd her entire life, and anything she doesn’t want to hear, she ignores.

Don't blame it on the attorney. Defendants are usually in denial and can be told over and over what the law is - they refuse to acknowledge the consequences of their own actions. They say "I don't understand" when what they really mean is "I don't like this." Why do people think old attorneys are incompetent? Often they are the most experienced. Imagine how she would act if she was facing really hard time - 25 years.

I know people sometimes dont hear what you tell them in terms of consequences, but when someone is shocked and confused over standard restrictions like this it appears to be a communication issue. Two separate conversations with counsel in the middle of standard questions is concerning, especially when counsel seems confused and shocked himself about state's recommendation.

Some people tend to hear what they want to hear in conversations. I have a relative who does this regularly, and when they injured their ankle I heard the ER room staff tell them “you need to stay off your foot for the crack to heal…it will re-open if you walk on it. Use the soft cast, don’t put any weight on that ankle and we will check it on 6 weeks to see if it has fully healed.” She heard “it will be healed in 6 weeks no matter what I do,” proceeded to walk on it repeatedly for dumb stuff (like we didn’t bring the right sauce quickly enough for her lunch) then was shocked and felt misled when it hadn’t healed at the 6 week follow-up.

Perhaps he was trying to get her to take the plea so she could get deferred (which ISN'T a bad thing)BUT... he should have taken more time with her & she SHOULD have asked questions BEFORE being in front of the Judge. You get what you pay for. What do you expect for free? Court appointed lawyers (Public Defenders) are rarely there to help the defendant. They are better than nothing but they are usually buddy buddy with the prosecutors, they are paid low (from the taxpayer) for every case they help with and they are usually just there to help move things along. It's better to retain your own attorney. My sister is still living with the consequences of a "Plea" that her public defender didn't explain to her properly 2 decades later. If you don't have any money they are better than nothing but they are loyal to who pays them which is the court.

@@jefflitchford1422 Jail and prison are useless expenses. Which is why I think probation and all of this "leniency" is the practical solution most of the time. Being on probation is enough for most people at first. When it comes to habitual offenders then clearly it is a mental health issue and our money should go there. Before all of this though we need education for our kids. We need licensing for parenthood. Some people should not be parents. EVER. We all have to deal with the results of screwed up parenting or a lack of it altogether. Populations are high enough. Just throwing these people on the street or in prison doesn't help or change anything. It scares people but they need to grow a pair and realize that having kids is not for everyone. Sex may be but child rearing is not. If people disagree then they need to stop complaining about crime or government social programs. Because those are the alternative.

I think the judge was actually going to probate it. She just didn't get the chance to get the words out. That's why she gave her the choice: A conviction for less time on probation or a longer time under supervision for deferred.

to some it might sound odd, but women like her......make money by purchasing firearms legally, and selling them to their boyfriends, and others. this is why she is SO concerned about the firearm thing. The child thing is also how she makes money, as a woman the state awards fatherless children, and its a way to make money if you dont care about kids welfare, which sadly many women like her dont. this finding will put those revenue streams at risk.

@@barbarayoung7077I was going to say the same thing. I have a feeling she won’t do well on probation, especially given her attitude towards the restrictions placed on her due to her sentence. She’ll get caught with a gun and then end up back in front of Judge Boyd justifying the violation by claiming it’s unfair she can’t have a weapon because she needed it for self defense. That the restriction against weapons violates her 2 amendment.
