Steve Leidner is the only person living at the Hamilton on the Bay, a 28-story residential building in Miami’s Edgewater bayside neighborhood. He said he was outraged when he received a letter saying he had 60 days to leave and he has refused to do so.

Protip: If you ever come across any legal document that contains a clause giving the other a party the right to do something, in this case the owner to evict, and the party claims they aren't going to do that, take out a pen and draw a line through that clause, and have the other party initial it. If they refuse to do so, then clearly they intend to make use of that clause.

AND always remember that the party that draws up the legal doc has the advantage. Do not sign anything in haste and have a lawyer review before signing. The new owner clearly intended from Day One to evict the current tenants.

Yep. A landlord gave me a renter’s agreement to sign that was different than what I was originally shown. I mentioned I had waterbed at first meeting and it wasn’t a problem. When I returned to sign, there was a new clause banning waterbeds. But I was told it was never enforced. So I crossed it out and initialized then ask them to do the same. They refused and I walked. Got a call back that water damage insurance would be required. I agreed, the agreement was changed and had good business relationship for 5 years.

@@wiseGUY1288 when the new company buys the place, they buy the leases too. They don't get to just evict people the day they buy the place. What this company did was offer all the tenants new leases with cheaper rents, but in the fine print gave the owners the right to terminate their leases prematurely and kick them out. If he didn't sign the new lease, the owners are still on the lease for the old one.

Watch the whole video before opening your mouth. The lease specifically allowed for early termination. He signed it, they're terminating early, he's a squatter. Plain and simple.

@@chrisw9122 He's not a squatter. He has an active court case challenging the eviction. Until the court rules, he is still a legally a tenant. If he were to leave, the court case would become moot.

This is an injustice. When ordinary people break leases, these large companies go after them with no mercy. When these companies break their own leases, they just shut down your electric and water and making living unbearable to get you out. They deserve to be sued for breach of contract.

@@bizzzzzzle People that you think are rich are normally struggling with very similar problems as poor people. Credit cards, loans, vehicle payments, actually pay in taxes each year with no returns. They just buy higher end and pay more. Doesn't matter how much some one makes, the companies need to be held accountable.

Read. Your. Lease. The landlord/owners wrote that contract, so it will favor them. Every lease I've ever seen has a clause giving the owner the right to terminate a lease with 30/60/90 day notice. The tenant usually has no such option. (if they do, it'll be something stupid like 50% of the remainder or some fixed number of months - which ever is less.) His utilities most likely were cut off when they started work on his floor. (It's actually a standard part of any realtor bag-o-tricks.)

Calling him a squatter is completely false, his lease is still good and he's standing his ground because he's smarter than the other tenants and read the fine print n didn't fall for the new owners' sneaky antics. Im proud of this man's stubbornness and persistence / perseverance, it must be very annoying living in a construction site. Realestate Development Corporations are given too much power to screw over their tenants far too often and always seem to get away with it. Im glad this man is standing up to them and their slimey tricks.

He's smart and playing hardball until he moves out. The owner attempted constructive eviction and was court ordered to restore his utilities. He has a strong case to counter sue for harrassment and breach of contract. He may even get a better settlement offer from the owner than the previous tenants had been offered.

As for the utilities being turned off, not good. But in Florida the owner can shut off utilities to complete repairs, and with notice to the tenant. If the tenant refuses, but was given notice, he can't interrupt the repairs already scheduled and utilities can be shut off. So, he may not have enough to sue for breach of contract if the new owner can prove he had a legitimate reason to turn off the utilities and did so with notice. When notice is given, the tenant is given an alternative to stay in a hotel if he chooses while utilities are shut off. But I'm noticing he's saying NO to everything. I don't believe this news caster wouldn't know to what lead to the utilities being shut off, because she's only being given the tenant's side here.

Its stupid how in order to maintain your rights, you need to spend thousands on a lawyer. They literally tried to force him out by shutting off his water and power. That wouldnt have come back on without a very threatening legal letter or court.

NOPE, the remodeling and compliance with the codes is the new excuse for property owners to evict lower rent paying local and long term residents, refurnish and repair the building, and jack up the prices for new higher income new costumers.

Incorrect. The new owners have the right to evict him whenever they wish within the legal limits of the municipality. It's just not that quick to force people out if they fight, which is what he's doing. He will lose, probably before his old lease is up, he will have just delayed it a few months.

The owner had the option of not renewing peoples lease to begin with. Thus people would have had to move. However they signed new leases to collect rent until they were ready to start Renovations. This shows that the owners were not bargaining in good faith to begin with.

@@wendyannh It's a border case. Contractual obligations must be made in good faith. You can't say "oops that was a mistake" but you _can_ say the verbal contract differs from the written contract and hence the written contract was not made in good faith. Technically not fraud but the court may still throw it out and award damages.

@@Mavendow Exactly, while it's pretty silly to sign a document because of a verbal assurance that a clause will not be acted on, it is a requirement that the contract be in good faith. If it can be shown the owners knew or should have known that they were going to have to kick people out prior to the leases expiration, then a court may find them acting in bad faith and responsible for damages.

I had a similar experience where I was the last man standing in a Tempe apartment building. All my neighbors were on a month to month lease and hit with an increase from $750 a month to $1200 by the new owner who wanted to remodel the place and market it as “luxury.” I had insisted on signing a one year lease with the old owner, and refused to move until I found the perfect place to move to. Props for a this guy for not allowing himself to be bullied by the greedy property investors.

I lived in a very large apartment complex in San Diego that got bought out by a large investment firm and wanted to vacate the complex to do renovations on every apartment. They set up meetings with each tenant and basically negotiated lease buyouts with each tenant based on how much time you had left on the lease. I only had 3 months left on my lease at the time and I got my last month free + full deposit back without inspection + $2000 for moving cost + $1000 lease buyout (total of $7200 value). I took it no problem. Funniest part is the very next apartment I moved in to the exact same thing happened a month after I moved in and I got another lease buyout. That was a good couple months lol.

The company is already playing dirty by purposely turning off his water and electricity trying to force him out but had to turn it back on only by Court Order. Next they will turn off the elevators etc.

Well they are renovating. It's necessary to turn off electrical and water so you don't get electrocuted when working on wiring and don't want to cause a flood when working on the pipes. *Edit. That's what they were doing. And they were court ordered to supply his apartment with the utilities but by the time the order was put in place he already had his utilities turned back on as they no longer needed them off to get the work they needed done in adjacent apartments. The main problem was they gave him no warning the utilities would be out and wasn't told for how long.

@@Mavendow the scaffolding is for the outside renovation. Have you ever seen a construction site without scaffolding. They do multiple projects at once to get the job done quicker. Just cause they have scaffolding up doesn't mean they aren't working on other parts of the building. Come on man. It's common sense.

Everyone has the right to exercise their rights, and protest. But when or if that building fell for negligence, then it’s a whole other story. There’s more to this then his rights to continue living there. The engineers saw serious work needed to be done ASAP. But everyone is only focusing with a one track mind, on this one mans stubbornness.

@@MegaMech There was nothing mentioned about safety issues. This is a basically purely cosmetic overhaul, although of course it will also have to be brought fully up to code in the process. But that’s the law everywhere when major renovations are undertaken, not an inherent indication that anything is actually unsafe.

Much as I sympathize with this tenant,he signed a Lease(which is a written contract)that allows for termination of the lease. A written contract cannot be altered verbally,only on paper.Of course,he did not understand that when he signed but since he is not of diminished capacity,it is binding.

A new owner of a rental building decides to give all of its tenants an option for better leases, but that includes an early termination clause in fine print. And they promise not to evict-huge red flag. Everyone signs except for 1 person. Then the owner (Aimco) decides they need to replace the sewer system, and that everyone needs to get out-nice coincidence. They offer help to move the residents that signed into smaller places with 3 months rent paid. Then the company decides to turn off the electricity and water of the 1 person that didn't sign. Post a sign that says it's a felony to go outside onto the balcony that he is renting, and take him to court for his eviction. GTFO out of here, Aimco, with your %$#% contract! I hope you get sued, never have another tenant again, lose millions, and go under.

Squatters by definition don't have a LEASE. His lease hasn't expired so HE'S NOT A SQUATTER. This is a scam we've seen all over the country for a long time. They're not trying to give residents better leases, they're trying to illegally push them out so they can rent to yuppies who are willing to pay extravagant, unnecessary prices. Absolutely sickening. All those residents need to file a CLASA ACTION against the new owner, the developers, construction company, EVERYONE.

This reminds me of a story I heard about a long time ago. If I remember right some guy bought his apartment in NYC when his building went condo then some years later the building went back to rentals ( I think the property owner made more money that way. The building's new owner told him he was past due on his rent and wanted him gone, from what I remember or heard ( not sure which ) he said he owned the unit when he bought it years before. The owner try to force him out but after going to court and suing the new owner he ended up getting the apartment next door to his and made both units into one.

Reminds me of an old apartment that accidentally lowered my rent instead of raising it one year. I immediately signed and ratified the new lease, and made 100% sure I had a signed copy on hand. Sure enough, they tried to force me to sign a higher rent lease a few days later, threatened to sue me, threatened to evict me, etc... I told them where to stick their new lease, and lived there un-sued and un-evicted until I bought a house a year later. I called their bluff and won.

Never believe what they tell you *unless* it’s in writing in the lease, exactly the way they are saying. And if you don’t understand the lease terms - which most people don’t (if they even try to read the lease to start with) - then take the thing to a lawyer to decipher it for you *before* you sign it.

It depends on the contract and state laws. In California people are expected to vacate on a 30 days notice, unless the contract says otherwise, but the contract cannot say any less than that.

Contract said the owners could end the lease before the term. IMO that's a conflicting term making it a month to month lease while at the same time stating a longer term. A judge would have to decide which term is valid. I suspect this is why the owners aren't evicting him because they'd probable lose in court. He should have read the lease before signing it but many judges don't like lawyers drafting these types of contracts that are clearly misleading at best.

People don't seem to realize this is related to the collapsed building in Miami that killed a bunch of people. This building was made by the same people and literally looks identical. It's right down the street from the collapsed one too. When that other building fell, they evacuated all the people in this identical building. That's WHY the construction is going on, they're making upgrades to it to avoid another tragedy. A lot of people are saying this guy is some sort of hero, but I personally wouldn't want to stay in that building until the upgrades were done considering all the facts. And even after, I wouldn't move back in.

😂😂😂 I worked for AIMCO for a few years… during the recession of 2008. I tell you from experience that they DO NOT care! They do whatever they want and use their arsenal of attorney to “deal” with difficult residents. They are the worst company to their employees too as they fired the manager, assistant manager, bookkeeper and the one other leasing agent I worked with on a 400+ unit property and gave me inconsistent “helpers” through a temp agency, of which I needed to give the run down to each of because they were new to property management and not versed in landlord-tenant law and what was allowed and not. I begged for experienced help! The residents were amazing though and patient with me but some ripped into higher management on their visit days about the lack of quality office staff to help me. I loved those residents but I had to leave when they decided they were no longer going to pay commissions fairly and instead distribute them amongst all office staff. Has anyone been in sales before? That’s not how that works unless everyone collaborated in landing the sale. 😕 Anyway, I hope this guys wins! I hope he wins big!

Stubborn what ? he signed a contract and agreement when he's first pay the rent and moved in.. his not breaking any law, his contract isn't expirated yet, the owner that breaching the contract..
