Basically, it EXPLICITLY says that police cannot be sued for failing to inform people of their Miranda rights... which isn't really a change because under the doctrine of qualified immunity police can't be sued for ANYTHING they do as part of their duties unless the courts have specifically said that they CAN be sued for that specific thing previously. So until now they couldn't be sued for failing to mirandize because the courts hadn't said that they could, and now they can't be sued because the courts have said that they can't. No real change. It also doesn't change the fact that if they DON'T inform you of your Miranda rights then any testimony / evidence they gather as a result cannot be used in court. So yeah, they still "need to read your Miranda rights" just as much as they did before.

In this case both the reading of Miranda warnings and whether she was in custody or not is irrelevant. Miranda Warnings have nothing to do with a civil rights violation. You can't sue based on Miranda warnings. Being in custody or not only dictates if Miranda is required for statements to be used against them. These are evidence suppression questions not rights violation questions. For a rights violation the only question is: Did the person affirmly evoke their rights and did the questioning continue.

And what would a guilty person say, would they admit they took the card? She was the last person seen with the card, there was no video that showed who she gave the card to. The person that left the card was the one that went to the police (most likely) and she would have told the police that she wasn’t the one Wilson gave the card to in the van. So it goes back to why did Wilson give the card to someone else? Was she in on it, or was she just careless and gave the card to the wrong person. She was the only lead to the crime and when she “lied” about who she gave the card to, it was enough evidence to charge her with the crime or being involved in it. The person that really messed up was her attorney. He should have gotten the video and had her go through what she did, like she told the reporter. Then he should have brought that information to the DA and demanded that the charges should be dropped. Or file a motion with the court to have it dropped. The whole thing could have been settled in a couple days. Now her lawyer is trying to cover his ass by suing the city. And I am sure he will get paid whether she wins the case or not.

I had a case against me that was not just dropped but discharged and all records were destroyed, fingerprints, etc. I am in Canada, if they wouldn't have properly removed it from my record I wouldn't even be able to cross the border into the US and I am so I know they did do that properly. Most employers would just rather not deal with it. It is much easier to hire someone that doesn't have the baggage. Mine happened in the late 90s. I watched my prospects dry up pretty quick. I can't even tell you the number of times I've found something and immediately returned it to a customer service desk. Someone once left their purse in a cart outside of a grocery store. I pushed the entire cart into the store, up to the customer service counter, never touching the purse, a bit nervous the whole time. When I made it there, I immediately let them know and walked away. Most recently at the same grocery store-- years apart-- as I was walking up to a self-service register, the man ahead of me requested cashback but forgot to grab it. As soon as I saw it, I started yelling, "Sir, sir!" He didn't hear me but I told the attendant and asked him to stop him. He did and also came over to grab the money. The guy whose money it was looked at me crazy, as if I had done something wrong and thanked the attendant. The attendant came over and thanked me while acknowledging that most probably would have taken it. Well, I'm not "most people"-- I have morals, a conscience, and am blessed. I don't know what was going through that guy's head but it definitely wasn't gratitude. Glad my hands were too full to touch that money. After watching this video, even for something as cut and dry, I won't be touching anybody anything. Justice for Ms. Wilson! 🙏🏾

She only asked if they left a card inside, she never asked for the name on the card or ask for additional ID. The irony here is that Miranda Warnings probably didn't need to be given in the first place. If she went to the police station on her own and was never told she couldn't leave, was locked, or blocked in, she wouldn't be considered to be in custody and any statements made would be admissible. The reading of the Miranda is likely what prompted her to request a lawyer. Bottom line once that request is made, the questions have to stop. Even if she changed her mind 5 min later and said she wanted to answer questions, the cop still couldn't question her until the woman spoke with an attorney and they Oked it. Failing to read Miranda is not a rights violation but can lead to the suppression of evidence. Continuing to question after 5th rights were evoked, whether issued Miranda or not, becomes compelling and likely coercive. That is a clear rights violation.

Returning property to the wrong person is not a smart thing. it is a simple mistake. Unfortunately for her, a mistake that became costly. The police royally screwed up the investigation by lazily assuming that she had nefarious intent. Only the absolute worst of detectives would watch that video and infer that she had criminal intent. i had someting similar happen to me twice😔 this is whyyy i feel we must separate bc they cant be fair to us.... Most of them. Thank God the judge was a fair judge. In my case the judge tried to arrest me when i pled my case in court instead of righting the wrong. 2nd case they hid the video that would prove my case. They didnt care that i had been wrongly attacked, all they wanted was to ruin my life. This is not justice for black ppl in this system, not when racist are in position. They need polygraph test to work in these positions, they cant be trusted. This has happend thousands, millions of time. God will judge them all and need to pay for their deeds.

This is insane and is scary, I'd end up in the same ship as her if this happend to me?!? It's insane how fast your life falls apart after an arrest and how long it takes to get it back together, now she has an eviction, good luck finding a rental, no job, so no congruent job history, also makes it hard to find a rental, but all this happend so fast within 4 days her whole life fell apart it will take years for the courts to fix it. It took 4 months just to get the arrest vacated, ridiculous, and the police, no apology instead they try to defend what they did to her. Just awful!

I think she just panicked in reaction to an aggressive interrogation! She walked in to the police station knowing she was an innocent person, trying to find out why she had been shamed on social media and lost her job. Her few seconds of kindness in returning the card to the woman she thought was the rightful owner had been such an inconsequential everyday occurence that she'd had no reason to memorise exactly what happened. The aggressive questioning by incompetent cops obviously would have made her extremely anxious and, unable to remember the exact details, she said the first thing that came into her head. It's unfortunate that she said that, but I'm pretty sure I might have done the same thing in her position.

"I gave the card to the man behind the counter." Just wanted to defend her somewhere on this. Our days get muddled as we do the same stuff constantly. In the video we have evidence of her at least trying to find someone who owned the card and return it honestly. The idea that she and an accomplice worked together to steal a credit card at such an opportune moment (as most of us don't forget that sort of thing too often) is absurd. What could have occured would have been a crime of opportunity, which does not permit the idea of conspiracy that was used against this woman. In her own head, she went to the gas station for some smokes or a snack like any other day, found a card that wasn't hers, and took it to someone in an attempt to honestly return it. Guy behind the counter would have been a better option, but the intent is clear and it pisses me off that it took months to get to a reasonable judge to help her. I hope she gets absolved in social media and the workplace.
