Great Video Man! I'm a 7 years veteran of MetalDays and also worked there as a volunteer for a while, so I really knew the drama surrounding Boban and the Refunds and also his very ridicolous behaviors both in the private and public FB Groups, but thanx to this video I found out how low he can go. I will share this vid around, hope it helps make some noise and help the people who still didn't get the refund. My experience: I bought 4 tickets for MetalDays 2020 edition. 3 years went by and still haven't received a refund. I understand that it takes time to refund but the unbelievable part is that in 2 months there is a new edition of the festival and somehow they are still holding my 800€+. One festival edition was also last year (2022). Last time I received email notification about refunds was probably more than 1 year ago. If their interest would be in refunding then they would keep us informed. So it looks like they just stole the money and created new festival (probably even opened new company to hide debt). They clearly don't give a shit about fans. Wrote many mails but they just don't give a damn. They offered me a promotion code instead but I do not want to be a part of this festival and most importantly I do not want to support greedy and scamming organisators. 800€ is not a small amount otherwise it wouldn't be such a big problem for me. And after all of this I see them (MetalDays) arguing with people in comments here and on Facebook. You can't be more low than that. They (Boban) should be ashamed of themselves. Taking fans money and spitting in their face when it's time to refund. Can't even believe that this is possible but I believe in karma and I believe one day they will taste it - universe always makes things right at the end. Peace.

Tolminator will be a completely different story. Organizers are Dirty Skunks team (20+ years of organizing metal/punk/rock concerts in Slovenia and great people), tickets and prices are as normal as it can be in current environment, it will look a lot like Punk Rock Holidays which, from an organization stand point, is A LOT better and people friendly than MetalDays ever was. In 2020 i bought 5 tickets to Brutal Assault for me, my wife, my father and mother and someone who has a drivings license and doesnt drink (smart right) :D For my family that would be their first metal festival EVER! And i was proud to show them why i love BA and went there for 6 years. Then Pandemic hit. Ok i still got money, thought not 2020 but we will go to 2021. Then my wife lost here job because of that pandemic and i had no choice to ask for refunds as much as i didnt wanted to. And you know what? In 2 weeks, when i was ir grocery store to see if i can afford toilet paper of potatos, i got a message that i got my refund. And THATS why in 2024 (not this year because we still have to get back on our feets) i will take my family to BA! They deserve all my money and love!

We have been going to Metaldays for years and it was always clear that Boban is sort off a dweeb. After complains about beer prices and overall prices going up each year he changed the name off the fbook forum into "Snowflakes Paradise", a few people laughed about it but after a few days most where wondering if the joke wasn't past it's prime... it's still called that way! The next year T-shirt where being sold with the print "Boban Milunović melting Snowflakes since 1971", I don't believe many where sold... But, we also loved the fest. Nice location, the village is relaxed and supermarkets are really near, the way they treated the area was really inspirational and it's good to have a few non-meat options. So, we're going to Tolminator, hopefully it will be the best of both worlds!

The concept of fair use is thrown out the windows and anyone can wrongly strike and/or take down anything on just accusations and nothing based on actual law or precident. But they know KZbinrs don't have legal teams on their payroll and it would not be financially viable to lawyer up for every false claim.

@@preuner19 well they did it, people on the facebook page snowflakes paradise said you were not allowed to bring your own drink on near the lake, have to buy 5€ union and some people were even charged 4€ for water supposed to be free . And a lot of other shit x) now it's cancelled because all the camp ground is flooded and all road closed.

I did buy a ticket for the 2021 edition that got cancelled, and then asked to book my ticket to the 2022 version, no issue whatsoever. I haven't checked with other visitors, but last year's edition was far from ideal, especially with the roadworks that basically cut the valley in half. From what I have seen from the organisation of Tolminator however, it seems that they are really pushing to work with the local municipality, they get things done and I know some of the guys from Dirty Skunks, the organisers personally from when I played at Metaldays 2018 with my band. I look forward to see some of the magic back, since that was what I liked about Metaldays in the beginning, the intimate setting. This year I'm playing at Tolminator with my current band, so I'm looking forward to go back to Tolmin 🤘

Played at MetalCamp (2009 2nd stage, 2011 2nd stage and 2012 Main Stage) and worked all the years after that as press and I can say; yes, the dude that owns this is a G.S. (go figure it out) Calls the attendees "snowflakes", got more stringent on what you can and cannot bring onto the campsite (normally you could bring your own food and drinks onto it - CAMPSITE ONLY!), made everything triple as expensive as it was, he did not go into any criticism at all, but mostly just ridiculed the person making the valid critique. Also Velenje is total bullshit for the festival; people will 100% get robbed there and it will smell like sulphur. Tolminator is organized by DirtySkunks and the guys from PunkRock Holidays; Dirty Skuns were responsible for the 2nd stage bands for some years and since then this stage was mostly filled for every band. Now to the scammy part: Covid hit, tickets were already sold and the festival was then cancelled - people did not get their refunds or anything an mostly got ridiculed. He whined how he doesn't have money but meanwhile building a "holistic health center" in Zanzibar. The festival in Velenje will be smaller btw. Also; he wanted to make the festival fully vegan (no meat allowed anywhere on the festival grounds including campsite etc..) The tickets went from 120€ to 290€(!!!) and they say:"oh it includes warm showers etc.." only thing is they did not change the infrastructure and the warm water ran out around 8-9 AM and after that only cold showers were available. He is probably the most hated guy in Slovenija and no one has the balls to say something since they want to play on MetalDays, but since this festival is going to crash and burn in Velenje, more people come out of the woodwork. Fuck this guy and this festival. I will never support it again. Please just go to Tolminator or some other festival.

To be fair, the “smoke” from a nuclear power plant is just steam, and does not include any chemicals. I get that it doesnt have the same “green” appearance, but hosting the festival there is the same as hosting it next to a windmill or solar cell farm, at least in terms of climate impact. I understand the beef you guys have with Metal days, I get it and condone it, but it really busts my balls when someone talks shit about my city, especially not ever being here. Yes, I'm from Velenje (you didn't pronounce it that bad at all, cheers!) ... and for you to compare it to Isengard, just to suit your agenda, is dead wrong, childish at least. Let me draw a better picture for all metal heads that were possibly reppeled by the presentation. Velenje is simply beautiful. One of the greenest cities in Slovenia and voted the most beautiful city in Slovenia back-to-back for a few years a row now. It goes hand in hand with modern and green, and we're kinda very proud of it. Yes, if you look to the west (which you probably won't much, as all the fun is east oriented) there is a power plant in the neighboring town of Šoštanj. Your pictures are very outdated, due to extensive efforts to minimize pollution, high tech air cleaning devices were installed, so what you see is mostly just steam being released from heating turbines, and only one of those chimneys is still operational. Trust me, it's not that bad. On the other hand ... it seems a bit funny to me that metal heads are that much bothered with some industrial scenery. So really, don't worry about that, you have plenty of parks, lake, castles, bars, good music and fun stuff to keep you busy. Welcome to Velenje.

@wyattsmetal There are occasions with certain wind direction and air pressure, when you can smell something, but it's not the smoke, it's fresh coal stored outside, for the plant ... locals kinda got used to it, but it could be interesting experience for a newcomer. Nothing too awful tho. I'm sure there will always be armpit nearby that smells much worse 😆

It will be intetesting to see how Metaldays goes. I went to Metaldays 2022 and I had fun but it wasnt the same as previous years. Guards going around the campsite asking people to basically shut up as we werent allowed to make noise after midnight etc. The pricing at the festival was ridicolous, they charged drinks depending on what bouse was used and didnt tell beforehand so you could get charged a normal amount or like 56€ for a drink. I bought my ticket for Metaldays 2023 in hope that it would be the same feeling as before the pandemic again, but I doubt due to missing the river and that the festival is tehing to expand and I'm tired of big festivals. Will be interesting to see how Tolminator works if they will be restricted by all the restrictions that was announced placed by the muncipality.

Tolminator is like Punk Rock Holidays at the same place - the only use the Second Stage in the Forest, so the big Stage is missing because of the new Road. So there is truth at both sides - if you want to continue with acts played the last Years at Metaldays it is not possible because you need more Visitors to pay them.

theres also the thing that the ticket is way more expensive, the bands are smaller IMHO (like having In Flames as the main headliner for a 300€ event, also there was supposed to be a main headliner announced later, but that just never happened and In Flames just stayed the biggest band), giant bands being replaced with smaller bands (Anthrax being replaced with Carcass, love them but I think Anthrax has a more legendary status), and its dates are clashing with Wacken

A few comments on the new venue - I was checking the place available for camping in Velenje and compared it to Tolmin and there's no way, there's more place at the new venue and next to 0 of shade. The water in the lake simply stinks. While it is true, that it is better than it was, the fact remains that the lakes were used for dumping off the coal ash from the thermal power plant for several decades, so there really is no comparison. And to use all the views in the promo, not to show that said plant and offering extra activities that spread in the area of around 50km or more, as they are on site (like Tolmin had), is lame at best.

Good video and you're 95% correct in all of your legal analysis. Fuck that guy and fuck spurious copyright strikes in general. However, since you did such a good job of these things, as someone who is educated and has taught music copyright laws, I do want to take the time to explain why the Gojira cover claim is actually valid. You're right in that since it is an original recording by you and your friends, no copyright in relation to the original recording of the piece applies. However, both the composition and publishing rights to the intellectual property are in effect. So you're not claimed because of the recording, but because of a recreation of a piece of music that is still under copyright. That's the same reason why a lot of movies and TV shows wouldn't sing the 'Happy Birthday' song. I don't agree that they should claim covers since I'd say it's very flattering and creates fan engagement and enthusiasm about the music itself. If any of my musical works were to be covered, I most certainly wouldn't claim them because those fractions of a penny aren't worth the lost respect. But legally speaking, they are in the right so you probably don't want to waste effort in trying to counterclaim.

@@SymbolicSplenetic Not anymore. Warner Music claimed the copyright for a number of decades because of very long shenanigans involving the rights. Ironically enough, it was the lyrics that they claimed, the melody was already out of copyright. Eventually it got challenged in court and the copyright was revoked. Warned even had to pay back some royalties that they collected. It's one of those hilariously stupid tales of copyright being dumb.

@@ChunkSchuldinga He fleeced a bunch of bands on the MMF bill. He was also a contributing promoter for other metal festivals and screwed over bands for those as well. Either bouncing checks or canceling their contracts without standing. All of this happened in 2004 during the summer tours. I don't remember any resolution ever happening. It killed MMF and I don't believe Koshick has been actively involved with metal promotion since that summer... it was band after band coming out of the woodworks saying they got screwed by him that summer.

The reason it moved from Tolmin is because the government is constructing a road straight thru the former festival location in Tolmin. Besides that, I did visit the Velenje location, which is a pretty beach on a lake. But it does not have the same allure as the Soca for sure.

They are looking for volunteers to do jobs like stage setup that should be paid crew, a festival local to me that has also ripped people off and owes money is also doing the same thing. Using volunteers for events jobs that should be paid is a massive red flag the promoter is dodgy.

Frankly I'd petition any band booked by MetalDays to pull out. After 3 years of having no money for refunds yet all the money to up(down)grade, I'd argue that any band still willing to bring people to the scam, are complicit in the scam themselves.

We did a ticket exchange from 2020 to 2022, but honestly I don't remember it being a straight forward thing to do, we'd done the block booking of 4 tickets and the guy who booked them had no idea he was supposed to submit an official request, if it wasnt for my ex bf being so on the ball i think the tickets would have ended up invalid and no refund would have come to us either. I remember at the time thinking "Oh this feels a bit sneaky" which was a shame as I've had so many brilliant metaldays. I got covid the day before I was due to travel and missed MD22 anyway, but never mind...

Sounds like he was rolling money instead of having actual funds to pay for things up front, hence not actually having the available capital go refund. Borrowed from A to pay B, so when A wanted the money back, he didn't have it anymore. Bad business.

Sounds almost like the Hove festival in Arendal, Norway. It wasn't a metal only festival, but it's had some big metal names playing. Usually one or two days on a stage dedicated to it. Anyway, they cancelled the entire festival - not even because of covid, just because they couldn't handle their economy at all. It's a very funny story for people who didn't buy a ticket, but for those who did, I imagine it makes their blood boil.

The entire way the West does copyright laws should be overthrown. For starters, just introduce severe financial penalties for attorneys and plaintiffs whenever they try to take something down that obviously falls under fair use. There should be consequences for scummy behavior like that.

You should make another video how they sold tickets for 2024 and then canceled and again no refunds.. Or how noone got back their leftover "casless system" money from 2023, or how smaller bands didnt get paid last year, or how the workers didnt get payed last year..Boban owes me 500eu now.

Way back when Boban floated the idea of cutting off the festival from outside food. You can imagine how that when down. When an alternative site was first announced, he was looking at a small river in Croatia...15km from any shops. Presumably realising this wouldn't work logistically, they chose Velenje. But not before gaslighting the hell out of the community, implying over months that the festival was moving to the Adriatic coast. Until Velenje municipal government announced it by accident. Now, I don't think having it on the coast in summer would be great (too hot no shade) and I don't think Velenje is a terrible spot. But he's been a massive cretin. So all hail Tolminator!

Not even surprised. This is why I'm cautious to ever go to another festival. Remember how I said I bled a ton of money and wasted time twice because of a no re entry rule in one of my other comments? Festivals are usually staffed by nice people, and the bands are awesome, but the assholes who run them always ruin them one way or another. Anytime I see a article exposing festival runners as scamming people or being a right wing prop up group who are donating the funds to hate groups I'm not surprised, I just go "Yup. There it is." and continue on my day. I was considering going to a war metal/industrial/post punk festival next year and shilling out a cold $1,500 usd to fly to where it's taking place in Japan, but after everything I'm so demotivated that I don't think I will because I'm sure I'll end up getting stranded and have to hitch a ride illegally on a fishing cargo ship back to the US with my luck and the management probably leading to a repeat of the same old story, then when I come back I find out I accidentally helped fund the Imperialist Revival Party of Japan. The absolute state. I wish there were some way to unionize a festival directly between fans and bands to not have to deal with stuff like this. That's the wrong term but you know what I mean, cut out the middle man who's just there to profit with the most anti consumer policies he can stuff it with.
