Update: First, thank you! Without your comments and help with sharing this video, I am sure Xilinx would not react. Xilinx will not publicly comment on what exactly happened. This is the official Xilinx response: Dear Mr. Feranec: We greatly value the developer and engineering communities who use Xilinx tools to enable the technology of today and tomorrow - and those who educate them. We would like to apologize for the manner in which your situation was handled. It has brought to light several gaps in our content and internal processes, including a lack of guidance concerning the use of Xilinx’s intellectual property and the difficulty in receiving a response from Xilinx for clarity. Please be assured that we are actively reviewing and updating our processes to avoid this from happening again. That said, we are responding by working on a set of guidelines that will address the use of Xilinx’s intellectual property while at the same time, provide clarity to content creators on acceptable usage; once finalized, we will provide written guidance at www.xilinx.com/about/legal.html. Second, we will ensure that situations such as this are addressed with a friendly email from a Xilinx employee instead of a letter from a law firm. In the meantime, please know that we are supportive of the spirit of educators, and would not want to do anything that would stand in the way of learning about our technology. Again, we are very sorry that this unfolded in this way and are committed to doing better.

@@RobertFeranec I just never expected this situation to occur in the first place given all support they provide for hobbyists. I like how Dave explained it on his forum: "It is clear they are not protecting their actual trademark here, the official intent is to ensure that people don't think that any unathorised online courses are confused with official Xilinx approved courses. The real reason is undoubtedly that they don't like the unofficial courses, and the logo trademark is an easy way to screw with the little providers. .... I'd bet that Xilinx hope the small "unofficial" providers get in a huff and simply remove all their material and never do it again. @@RobertFeranec Robert, I disagree. Xilinx did not send you C&D, it did come from lawyers directly (there was no intent from Xilinx) and there is no real reason behind it. They have tried, and they are ready to try again. But they do not know how. If you want to talk to someone at Xilinx, try get meeting with their CTO. I'm playing with Altera/Intel, and I have been looking into Lattice and Xilinx. Thanks for helping me make an easy decision. @theminertom115516 жыл бұрын
Robert, thank you for providing this video. I have great respect for your work. A little history about Xilinx: Xilinx's own attitude towards its customers was the reason why Altera could start up. Back in the late 80's and early 90's, Xilinx management had the attitude "we are a chip company not a software company". I believe that was an exact quote from the then ceo (it was a long time ago). It became incredibly hard to program Xilinx FPGAs and one had to purchase third party software in order to use their devices. I remember having to purchase not one but two software packages to program Xilinx devices. When Altera came along, their attitude was to provide good software for programming and do it basically free (only some advanced devices required some kind of license). So you see, Xilinx was not usually a company that thought strategically about providing service to customers. Now, it has a few uppity lawyers trying to make a name for themselves and move up the management chain. They are probably getting "taken out to the woodshed" as I write this.

@PrimeToolbox2 жыл бұрын
Well said. They take the status quo bias, if they know how to use, they automatically think on implement it. But if they don't, they don't even think about it. This means expending not just money, but many hours on learning how to use it. Many products became popular solutions not because they are the best, but because they have plenty of leaning resources, rich documentation and community support. Two great exemples are the Arduino and Raspberry Pi boards. But I understand that most of the clients of Xilinx solutions are big industries, that can pay training for their engineers.

This is ridiculous, especially since I often do comparisons between implementations in Xilinx and Altera devices (for performance reasons), although I never use their logos. Now the next question is if they will start to sue universities that teach FPGA programming, especially if they teach both Quartus and Vivado. As far as switching to Altera, they (especially Intel) are not so virtuous either. I have had a lot of problems with Intel and Altera regarding support for bugs in their software, and obtaining basic documentation (a bunch of it is under an NDA which university faculty, students, and freelancers are not eligible for). Also, I think that currently, Xilinx has a better performance per cost than Altera does with their 7-series (though I have only tried the Max 10 on Altera in their 10 series). And Xilinx has better optimization tools. Though all of those points for Xilinx are for performance intensive implementations (in HPC where a 2 MHz faster clock at the same price means a lot), which if you are working on a project without that requirement then those points are moot. Lattice and Actel might be better choices for CPLD applications though, mostly because they aren't big enough to flex their legal muscles like Xilinx and Intel.

Realmente preocupante la situación, soy entusiasta en el tema de FPGA y me asusta el hecho de que la compañía XILINX porque simplemente "no le gusta" el contenido, envíen abogados, es preferible usar mejor ALTERA y no correr riesgos.

maybe I missed something in the video, but if Xilinx is bothered with logo only, what's the problem? Just don't use the logo, it is not necessary in a documentation, or is it?
@Swanicorn5 жыл бұрын
I pledge to boycott Xilinx. No matter what their "friendly" response was, the fact that such an incident happened in the first place is disgusting enough. The lawyers should have first contacted Xilinx and taken permission from them before initiating legal notice. Such incidents are happening a lot and I think the parent companies should take responsibility and not let the lawyers run free will. It's like buying a new car and clicking a photo with it and posting it on instagram only to find that lawyers are after me cuz the car manufacturer's logo was visible in the photo. That's bullshit Xilinx. This can further discourage honest reviews and comparisons from knowledgeable people. I feel disgusted that I used to teach on Xilinx chips. Oh god so many students supporting the wrong company. I will make sure to include this incident in alumni meetups. I won't support or teach or use anything that hinders with sharing knowledge and education.

In China, I got such mail from time to time. You don't need to answer that email. It is probably just a blackmail or threat mail to somebody who are just use the product, and want to ask some money from it. Just ignore it.
@RobertFeranec6 жыл бұрын
Hmm, it is not so simple in US and EU. Let's see what Xilinx will answer - if they answer.
@geekchenxiang6 жыл бұрын
BTW, the xilinx company maybe know nothing about the mail. Here in China, we have some intelligence property lawyers who has nothing to do but to send lawyer mail to every company which maybe use some CAD software and threat the users with some kind of "proof". For me, just ignore these kind of mail. These mail are blackmail. You did nothing wrong.

Did Xillinx resolved this? I know it is 4 years now and I am sure lots of customers have left Xillinx to somewhere else, but just curious they proceeded and acted on thier legal action?

If your products are significantly worse than the competition. It does not help to fight comparison. Make your products better for god's sake

This kind of thing is rather counterproductive, as free courses encourage people to buy more FPGAs and tooling, IP, etc. That two logos are shown together is bunk: The logos are useful to identify vendors under fair use rules, ie what a logo is for. It doesn't imply association, nor indeed third party cross-association. The note in the small print saying the info is only intended for the recipient, ie that it is private to them - *not* that it is secret in any way. This whole affair sounds very silly.

well, let say, sometimes an employee or one of the stupid staffs makes simple mistakes just for showing off. Otherwise, why such a huge company with millions of production per year should make silly mistakes and spend their resources to pursue legal users!!!! Something is wrong here, maybe they send you email or letter just for appeasement.

$2400 dollars. WOW... Even FPGA Engineers would not support that kind of price.

Robert thank you very much for this video. I never liked Xilinx to be honest. Today after watching you, I have forwarded your video to my university and we decided to use anything else except Xilinix (how is this bullshit name spelled anyway?) for our projects. Law is the citizens... Xilinx and it's old school lawyers, don't have any idea in what kind of war they are getting into...

I've worked at one of these giant tech companies and am well aware how employess at these companies are protective of their IPs. While this approach help maintain "value" of those employees, I find it incredibly counterproductive for the company as they are always struggling to find the righ. If i create a product, I'd had it out for free to students and hobbyists for "free marketing" and if it ends up helping the opensource community then that's just cherry on top.

Apparently they only want to work with corporations who can afford their training.

Whaaaat ?!?! this is inacceptable on so many levels ... sending lawyers on someone who teaching this heavy material , even xilinx don't make such effort to teach FPGAs and make FPGA mainstream in market . Robert I will not touch any xilinx part/tool till I will hear that xilinx have made an official apologize !

When bureaucrats take control of a tech company, that's what happens - first they draw all weapons and go for the kill and only after they see it seriously backfired, they stop to think (FTDI is a good example of bureaucrat hubris).

I'd ask at industrial property office (urad priemyselneho vlastnictva) and/or ombudsman. The protection of registered trademark is quite limited and can be different per country. Also you can have same trademark registered by different companies in different countries (like Tesla). The only problem I see is that you're selling the videos. Some legal.html bullshit on their website is irelevant, important is what the law says.

The fundamental issue is copyright reform: the current copyright system is corrupt and skewed toward large companies that use it to their advantage to keep the status quo. The European Article 11 and Article 13 would only make it worse if they pass. Someone needs to stand up for the smaller creators/developers who do the actual innovating.

I have studied electronics my entire life. Oddly, the difference between a $2 course and a $2000 course is the same as the difference between using Xilinx and not using Xilinx... in ALL future products I will ever produce.... That could be boards numbering into the millions.. The same thing goes for Chip scalpers.. If scalpers drive up chip prices. I will just find a chip that sells at less than MSRP... and redesign the entire board around the lower price chip.
@stevenx3m2 жыл бұрын
It's very simple. Such companies are only interested in their profit and they will do anything to stop anyone who shares knowledge. The worst part is those expensive trainings are jsut too short and limited and you don't really learn enough for the money you pay. The best you can do is avoid such companies in your projects.
@prussian76 жыл бұрын
Did they send the lawyers, or did the lawyers send themselves? I worked at a company where that happened. Just the same I will not be planning on using them for development now.

I have some answer, but I will ask Xilinx for explanation what can be shared publicly. Many people would like to know what happen.

Absolutely terrible, but this looks like a good oportunity for Altera to counter this behaviour by embracing the people out there educating other about their products.
