the craziest part about the whole thing isn't even about the main guy, you can see it at 52:09 and there were complete different news story covering it, cops were so flustered with what was happening they thought the guy in the white car that jumped out after he got hit was the guy they were chasing the entire time so they tackled and beat the fuck out of him in front of his wife and kid... he was literally just sitting at the light and got hit head on by another car so his first instinct was to get out and check on his kid and the cops started jumping him and they're claiming "he refused to leave the scene" like man his car was fucked and his family was still in it

@officialdrowsy
@officialdrowsy Жыл бұрын
Pop it with what? A screwdriver? There are only two units on scene, and not only do spike strips take a while to set up, I don’t think all units carry them. Before you say they could’ve shot, they couldn’t and absolutely shouldn’t. Their backdrop is a literal apartment complex and it’s usually unauthorized use of force unless he poses a direct threat to them or others.
@mystic95
@mystic95 Жыл бұрын
@@officialdrowsy The direct threat is there. A possible stray bullet is not as dangerous as him getting back on the road. Once he started backing up/ramming the cop car, they could have used max force to stop him and/or immobilize the van. And stray bullets hitting a random civilian are ridiculously rare. People just think it's a serious deal due to the handful of cases getting major coverage (like shark attacks).
@officialdrowsy
@officialdrowsy Жыл бұрын
@@mystic95 “not as dangerous” so you admit that strays are dangerous? Exactly. People and even little children inside houses die of stray bullets all the time. Back to my point, out of all the moments that it was, it was unauthorized use of force at the time.
@mystic95
@mystic95 Жыл бұрын
@@officialdrowsy Getting back on the road doing nearly 100mph in traffic > stray bullet from shooting downward at a tire. The objective is to minimize overall danger. Can't let people/risks like that escape when you have the ability to keep them contained. The most I'll give you is that the cops legally/professionally had either option, so they technically did nothing wrong. They just chose the easy/safe (for them) option which resulted in significantly additional damage and injury.
@officialdrowsy
@officialdrowsy Жыл бұрын
@@mystic95 No. they “legally/professionally” did not have the choice of shooting the tire. It literally is not within protocol, same as shooting someone in the leg to subdue them. They can face extreme repercussions, both in the department and legally if they point and shoot at anything but the suspect, with intent to kill. Every bullet they fire is accounted for. In the cases that cops shoot from their car while chasing someone, they’re usually aiming at the driver. I don’t know you but Im not sure you are able to grasp the dangers and how easily a bullet can ricochet, especially at an angle.

So yeah I'd agree they attacked him in this context.
@Barb4sale
@Barb4sale Жыл бұрын
@@Movs. Your context is just ignorant context. Here are all your flaws simply laid out. "If some random person" - It isn't a random person, it's a police unit marked and identified while YOU are operating a motor vehicle. (look up the state statute that compels you to comply. They don't need a reason to pull you out of the car and detain you, they have lawful power to do so even when they are wrong - you only have power to be right over him in court, after the fact.) "hit you and put you in handcuffs" - subjective hitting verb usage and yes they can put you in handcuffs to detain you, legally in literally every state and if you refuse they can use force. "There wasn't any good reason" - Again subjective as to what you THINK a GOOD reason is.. it isn't about what people feelings are.. its just facts. They have a guy with what will arguably will be aggravated assault with a motor vehicle randomly ramming people and police officers on the street and he is in the way of crossfire, next to the whole scene. This is literally borderline standard procedure. "They weren't protecting anyone" - That's literally what they were doing, protecting him from getting shot from police fire and themselves from an unknown variable. "he wasn't doing anything in that moment except being a victim of a car accident." - This wasn't a car accident, this was a criminal scene involving 100 police force personnel, helicopter and an active crime scene. Gotta remember, it doesn't matter if he refused to comply, or if he did comply and got put down after, or if he wasn't asked a single thing. Police will always have the right to detain you because of statutes imposed on you, and then they can be wrong in court. Irrelevant here considering they have all the reasons they need whilst you are in the way of whats about to be an active shooting.

A stand-your-ground law (sometimes called "line in the sand" or "no duty to retreat" law) provides that people may use deadly force when they reasonably believe it to be necessary to defend against certain violent crimes (right of self-defense). Under such a law, people have no duty to retreat before using deadly force in self-defense, so long as they are in a place where they are lawfully present. Someone breaking into your house you have a right to shoot in these states. Him also taking the car he can be shot. XQC your wrong !! The alternative to stand your ground is "duty to retreat". In jurisdictions that implement a duty to retreat, even a person who is unlawfully attacked (or who is defending someone who is unlawfully attacked) may not use deadly force if it is possible to instead avoid the danger with complete safety by retreating. These stats your FUCKED!!!

In california, "you have the right to stand your ground and defend yourself using force IF REASONABLY NECESSARY to pursue an assailant UNTIL the danger of bodily injury or death has passed". Key words capitalized there. Standing your ground does not apply to someone who fully has the option to close the door to their house and not pursue someone who never actually hurt them and is actively trying to put distance between them. There is even less reason for him to be giving chase when he can see/hear that the entire PD is already by his house and there is a literal chopper spotlight above. Pretty sure they know what's happening, so just go inside... Despite their faults, I still think they're a little more equipped to handle things than a guy running out with a bread knife. "If reasonably necessary" - It was not reasonable or necessary to leave the safety of his house, especially in an attempt to stab a man the police are clearly already in pursuit of. "until the danger of bodily injury has passed" - the man never hurt anyone, was out of the house in 20 seconds and was running away from the homeowners the whole time. The danger of bodily injury has passed, he's not in the house, all you need to do is close the door and let the police do their jobs. The homeowner himself put his family and dogs at risk of bodily injury by NOT doing this. And as a result, the dogs excitedly ran out and started going under/around the truck that the guy was about to getaway in, and almost got run over in the process. As well as his mother breaking her hand trying to stop her son from doing something unnecessary. If he stabbed him inside the home it would be different, but that's not what was going to happen here. It was clear he was already aware the man was no longer a threat to him. You generally don't leave a safe place and opt to pursue someone who you legitimately think is going to hurt you. That's completely counter-intuitive and anyone would be foolish to think the prosecution wouldn't bring this up. Kyle Ritenhouse had to fight for years over shooting people who were very clearly attacking him, while he was actively retreating the entire time, in a generally gun friendly state. Despite the entire thing being on video and there being zero room for any sane person to dispute it was self defense.. he was still dragged through court for years and was detained for months behind bars. So do you really think this would have gone over well if the mother hadn't stopped him? In cali of all places? Because I sure don't. Unlike Kyle, there is more than enough argument here to not classify what the homeowner was going to do as self defense. His actions by definition do not fall under stand your ground in Cali, and they certainly don't fall under castle doctrine as many children in the chat were saying. In my opinion this would not have gone over well with a Cali jury. Chasing the guy down and stabbing him wasn't a necessary action. And that was further demonstrated by the fact that him not being able to stab the guy.. didn't save any of his family from being hurt by the man. Which no surprise because the guy was clearly not interested in hurting them in the first place since he was always trying to put distance between himself and the homeowners and making no attempt to hurt them. So just go inside and let the vehicle go, you don't even need to call the police because they can see it. The time to be a hero is not when the whole PD is already dealing with the person, you really aren't needed if you're able to just get out of the way. The chance of someone already on mass amounts of adrenaline taking the knife from you is not impossible by any means. And judging how nutty is was of the cops to just grab that random guy who was hit and arrest him...do you really think it's impossible that those same officers could have shot the homeowner when they see him leaving the safety of his home while brandishing a knife, chasing a guy and then violently stabbing him in the driveway? I don't think it's impossible the police could have shot him. They literally arrested a guy who was doing nothing other than being in a car that was hit by the suspect, so I don't put anything past them lol. The suspect is nuts, and so are the cops. All the more reason to just stay inside and not get involved when you don't have to. The mother saved her son from potential legal issues, potential injury, potentially being run over, and potentially being shot by police. In other words, she's basically the only person who did anything intelligent in the whole video.
@Movs.
@Movs. Жыл бұрын
@@treyskyy2645 He actually doesn't know what he's talking about at all, you should have figured that out by the fact that he doesn't know the difference between "you're" and "your". But if that wasn't enough of a clue you could have looked it up yourself instead of relying on someone who likely hasn't even graduated middle school yet judging by the grammar. California has no such law where you are permitted to kill someone just because they are stealing your vehicle without you inside it. Their defense laws very much revolve around you being in immediate danger. Hurting people for any other reason is almost always not going to go in your favor. Quote from Rodriguez Law Group on shooting someone who's trying to steal your vehicle in California, last updated April 22 2022: "Typically, the answer is no. While there are a few exceptions, most states, including California, do not allow the use of deadly force simply because someone is trying to steal your car. However, if someone is stealing the car by means of armed robbery, for example, that is a completely different matter - that situation could trigger the law of self-defense." So there you go, MOST STATES would not allow this according to a literal lawyer. The homeowner was not being carjacked from inside the vehicle. So you don't get to leave the safety of your house to chase them down with a knife and start stabbing them just because you're mad they want your car, and thereby risking your own safety and your family/dog's safety in the process. You let the vehicle go. The entire PD is outside with a spotlight on the whole thing. I think they're aware of what's going on. They don't need him to do anything except get out of the way. I'll never understand people who live in a country where they have to pay for every little medical expense being so gung-ho over a replaceable material possession ...that they literally pay monthly payments on so they DON'T have to worry about things like this. And for extra assurance, here is yet another lawyer stating the exact same thing. From Simmran Law Group: "In California, you have the right to protect your property from harm. However, there are limits to that right. You may only use the amount of force deemed reasonably necessary when protecting your property. In most cases, shooting someone attempting to break into your vehicle would extend beyond the reasonable force requirement." The only time when shooting someone who is breaking into your car is likely to prove a solid defense of your actions is when the vehicle is occupied. If you are in the automobile at the time of the attempted break-in, you could feel that your life is in danger. In this case, the use of deadly force, including shooting the potential carjacker, will likely be viewed as reasonable self-defense." So there you go kids. It's funny to see Americans once again knowing less about their own country than Canadians do. But that's how it's been for quite a long time, US public schools are terrible. It's manifested into people who can't spell grade 2 words correctly, yet wielding enough confidence from cultural US bravado that they've fooled themselves into thinking they're armchair lawyers. Nor was it a typo, because he wrote "your" instead of "you're" more than once. And you took his word on legal matters why...? Oh right, because American schools are no longer interested in teaching critical thinking so the thought of doing otherwise never occurred. Someone said something you liked that sounded believable enough so you went with it. Be aware, the cycle of ignorance breeds ill-thought out compliance. I make this point not to be insulting, but to hopefully get you to research things before just believing them.

X, my guy, if someone enters your home without your consent and, in this case, with a weapon (scissors), most states have the stand your ground law which basically means you are entitled to defending yourself within a dwelling you own. The point you're arguing makes sense in a courtroom but doesn't in the heat of the moment. If someone breaks into your house with a weapon you're not going to stop and wonder why hes there which is what your explanation entails. Your whole argument banks on the fact that the victim is aware the person who broke in is trying to escape but 9.9/10 times someone who breaks into a house is not immediately trying to leave. 99% of society is not going to stop and PID a person and determine that he is using your house as a shortcut lol your legal reaction is to defend yourself with the possibility that an intruder means you harm. That's not even mentioning that fact that the dude explicitly stated he had been hearing helicopters for quite a while which could also indicate that he was scared out of his gourd when a man broke into his house while there is a police manhunt going on outside your front door lmao
