This week, we examined a case when a permanent resident received a removal order to leave Canada because she did not fulfill her residential obligations. She had to return to China to take care of her father who had a stroke. She appealed the removal order decision in the Immigration Appeal Division and failed. She applied for judicial review.
The judge from the Federal Court of Canada concluded that the Immigration Appeal Division gave proper consideration to all relevant facts and factors. Its removal order decision is reasonable. Judiciary review is not granted.
*Humanitarian and Compassionate consideration is an immigration policy, designed to offer a pathway to permanent residency for foreign nationals who do not fulfill the criteria of other immigration categories.
