Birthday cake flavored ice cream has been out for at least 10 years, basically every major store and brand has it. The trademark Cold Stone would own would be for the specific marketing name, not the general flavor or theme, and changing the recipe by even 1g of sugar would be sufficient to defeat any claims on the recipe.

I remember the first time I had the cake batter shake from Cold Stone it was like either '06 maybe '07 but I got a large, I drank it down so quick I ended up getting sick from it but I still love it even to this day even tho I haven't had 1 from Cold Stone in like 10 years. I think it's about time for another one lol
