1. Before appear, verify going to right place, how long will take 2. Contact and verify prior going 3. Leave enough time to park, get there early. 4. Dress appropriately, like going to church (no jeans, no t-shirts, no flashy jewelry, cover up tattoos, neutral, not too sexy, etc), don’t give people reason to not like you based on appearance. 5. Always tell truth 6. Think before speak, take 1-2 counts, take a breath.. 7. 1/2 truths come back to bite you 8. Listen well to questions being asked 9. Only answer what is being asked and no more (don't volunteer information or give extra information, give only that specific answer to that specific question) 10. Don’t assume what person asking 11. Everything you say is important 12. It’s ok to say I don’t recall, I don’t remember, but it has to be honest 13. Those that come with you also need to dress appropriately 14. It’s ok to be nervous, take a deep breath. 15. Remove anything in pockets so no coins, keys that can rattle/make noises. 16. When you answer than speak loudly, and clearly 17. Address the person that you are speaking to 18. Never answered, and you do not understand 19. If they ask you a general question like tell me what happened when you went into the bar you can respond by saying can you clarify your question so that they can ask you a specific question 20. Give a simple yes, or no if the question asks for a simple yes or no 21. If you can't give a simple yes or no, you can say I can't give a yes or no because there's more to it, would you like to hear 22. They ask your cousin question you can say I don't understand, you asked me, I love different things, what would you like to address? 23. Avoid drawing conclusions from a set of facts 24. You don't have to do opinion you don't have to conclude facts 25. Witnesses who heard, or saw some thing or smelled something, you're there to do state what you heard saw or smelled you're not there to; you're not piece to Guess about anything 26. I if a lawyer judge calls for an objection it's nothing that you did. It's ja legal question. 27. If you hear an objection stop 28. Be confident, be attentive, answer simple and directly 29. Avoid though I think or I believe, or I never would have something like that 30. Avoid always or never 31. Don’t say I don’t remember, rather say I don’t recall. Later you can say, now I recall. 32. Ask every question to best of your ability 33. Lawyer may say have you talked about this case to anybody- truthful answer should be “yes” (police or lawyer.. If you say yes I spoke to lawyer, “what did you say to your lawyer”…say “I was told to answer every question truthfully and that will put them in their place”. 34. Normal to be nervous, tAkes a lot of practice and preparation.

Thanks for sharing and keeping it simple. I think the problem for witnesses is nerves. When you are nervous (feeling the adrenaline in your bloodstream) your fight or flight kicks in which can cause a reduction in ability to answer in the best way possible ;)

Never take a plea!!!!! The court and the lawyers have made it legal to use a lie to instruct juries in the US since 1895. Plenty of things in our country now that are not right, just, moral or ethical, but they are LEGAL. However, making a lie legal to speak doesn't change the lie to truth. The Truth, the whole Truth and nothing the truth, is the standard for citizens, not the court, in a jury room the citizens get to say NO to the behavior of their government. In the USA we get to say YES at the voting booth, and we get to say NO in a jury room. Jury nullification is the law and every citizen has a right to say NO to power. This guy simply feeds off the suffering and misery of his fellow man, he is a vulture.

Question I got my conviction dismissed in furtherance of justice and vacated after a conviction and that still did not satisfy the dept of justice for my gun rights crazy..went to court this January 2024 and the judge granted factual innocence 851.86 after 27 year old case I never stopped fighting. So should I have any problem buying a firearm once my records have updated.

What if you really are innocent? You are now on the spot. Saying nothing makes you look like a selfish asshole. Saying something is an admission of guilt. The big problem these days is most people on the jury overlook reasonable doubt. That is a fact. Almost every case that I've looked into with somebody released from prison is the police report was bullshit, The state not turning over exonerating evidence, Poor witnesses and so on. More and more innocent people are going away and very little is being done about it. It is your job as an attorney to do your best to stop it. The first part is not giving a shit about public opinion.. Your job is to defend your client with everything you have.

Never give a witness statement. My sister gave one, due was told by the police that she wouldn't have to go to court. However, she was forced to go, even though she has bipolar. She had a mental health crisis as a result of the cross examination and the whole experience.

Gun rights restored. In your state only. You may have gotten your criminal records expunged that only means that they are not visible to the general public. Even when you records are expunged they are still visible to law enforcement and can still be used against you forever. If you have had your criminal record expunged and go to buy a gun you will have the federal government come down on you for lying on a federal government form.

As a former probation officer, I despised Alford pleas. Made the probationers totally arrogant. They would come in and say that they never admitted to anything. How can someone tell a sex offender he must go to therapy where the PRIME requirement is to admit what you've done, if someone refuses to admit to anything, and the Court has somehow accepted this?

I totally get what you are saying on this. It doesn't feel right or make sense. It also doesn't feel right that someone can accuse someone of sexual abuse without any evidence whatsoever. No texts, no kits done, no DNA evidence, no witnesses, and no surveillance. Literally just the victims word. I think that's why the Alford plea is a thing.
