EB-3 ROW unavailability is likely so until we see constant movement in EB-3 it is difficult to say. I think October visa bulletin will be important to see if we have VISA numbers than normal

Hi… my i 485 form says that i need to submit a sealed copy of marriage certificate which the immigration has to open. But i am unable to get that copy from the court or state capitol. They said that they don’t provide the sealed marriage certificate. I need it to prove that i got married within 90 days of coming to US. What should i do? From where i will get the sealed copy? Someone please help me

Does 485 processing time differ for different categories? Like eb1 takes shorter time than eb2 based i485? If so , what is the hierarchy?

I sent my paperwork to Nebraska service center via USPS priority mail. They received it couple days later on June 17 2024 and I kid you not they printed out the reciept notices the very next day on the 18th and just 3days later the notices were in my mailbox. I guess now, as of July 2, am waiting for my biometrics appointment for my I-765.

In no way is the striking down of Chevron a good thing for EB-1 applicants. It doesn’t help those waiting for I-485. More people challenging UCIS decision means more backlog in courts. Striking down of Chevron can be catastrophic for the climate, human rights, etc. Please don’t spread false information.

I travelled on H4 and got lottery based H1BI worked in different field (IT) which is different from my proposed endeavor (electrical engineering) for EB1 A I140. Will it be any problem for my I 140 approval or I485??

It depends on what niche you are filing in EB-1. If you have evidence and show that your actively contributing to niche and are an expert then it should be fine. Trying work in different fields is no problem as long as continue to work in the niche that you field EB-1 in.

Can i travel if my 130 approved but passport with 10 years valid visa got lost . I have to get into USA for filling 485. Can i apply new visa on new passport and travel ? I am mother of US citizen.

Passport is needed to travel along with valid Visa. I130 petition approval is not enough to travel.

We received Receipt of our application and also letter for biometrics appointment. Do you know after Biometrics appointment how much time it takes for getting green card?

You should continue in the same niche in which you receive your EB-1 otherwise at the time of naturalization USCIS might ask why change fields. If you PD is not current then filing for PP is not helpful. Please confirm with your attorney.

Difficult to say as USCIS points to further retrogression in EB-3 category! You can try porting to EB-2 if you qualify!

The total inventory for Eb1s this year is around 56K. as per the inventory, 36K available + 8 K awaited this year... which makes it 44K. Despite giving 44K, there will be a remaining of 12K.. DOS numbers not included, Eb2 porting in Feb. Mar, Apr, May, June not included, Also, visas already awarded from Oct to Feb not included.. There should be progression for EB1 to Aug-Sep 2022.. in July bulletin, possibility of Jan 23 is also there. I dont know what data I am missing apart from this.

What’s your basis for EB-2/EB-3 India retrogression ? Based on inventory data , I don’t think it’s going to retrogress beyond 2012

Great point! It is based on the further retrogression that USCIS pointing at in ROW. ROW spill helps India and as EB-1 India is already retrogressed then EB-2 and EB-3 India will likely have less or no or some backward movement.
