My daughter's I 140 (EB1) was approved in Dec2022. Her H1B is upto Dec 2023 ( I 797) and subsequently renewed upto Dec 2026. She also has valid AP. In case she visits India in Jan 2024, and uses AP to enter again without stamping in the passport....can she still claim H1B status?

If she has H-1B then I will always advice to use it to work and travel until she receives her GC.

Hello, my L1A visa stamping is set to expire in March 2024 and planning to travel to india in Nov/Dec of this year. I already have i140, EAD and AP approved, should I still get the stamping renewed when I am in india. My immigration lawyer advising me to renew. I am confused as I will be going only for 2 weeks to india.

I also would suggest renewing as it is easier and advisable to travel on L-1 than AP until you receive your GC.

Hi, thanks for the content you are creating. I am based in France and I just accepted to be a co-founder for a startup already based in the US. I have a PhD in artificial intelligence, 90 citations, 10 papers, and have been working as machine learning engineer for 4 years after my phd graduation at the same big company in France. From my understanding that I am eligible for O1 visa and also found that I am eligible for EB1 green card too. Is it right? Can I apply for green card from France as a co-founder?
