Thank you for this quick video. Most of the Indians are stuck to unprecedented wait time on normal EB2 but is there going to be any benefits if an H4-EAD apply for the EB2-NIW per his/her past expertise in a niche area, specially if they have to wait for prolonged time for GC normal EB2-India, can they work independently without being dependent on H1b primary applicant etc?

They can't work independently but it still serves as a great strategic tool if they plan to go on H-1B at any time as both spouses can then serve as a backup for each other.

Well, there were no changes in dates in October and November bulletins. Im suspecting its beyond matter of high demand and low of supply. They must be putting everything on hold for some reason. Maybe a big change in policies or something i cannot fgure out.

No, there is actually no movement because demand is high. This is not usually influenced by policy. We expect more movement on a quarterly basis than a monthly basis, and much more on an annual basis than a quarterly basis.

Do you expect cases filed in November/December to be adjudicated under current guidelines? No need for a guarantee, just a “more/less likely than not” guess is fine. I assume it might be a while before policies change drastically?

I do expect them to be adjudicated under current guidelines, but there seems to have been a shift in the last six months so who knows if those guidelines are any good.

These are not common and I don't think they have huge impact but I have seen one or two that have been impactful for cases.

@@WaypointImmigrationUSA I would think that someone that works for the government, specially ambassadors areresponsible for sourcing and identifying valuable individuals from other countries based of they national importance. Having a letter from such individuals will kinda emphasise how the applicants work has national importance? Agree?

A wiered question, We cannot fill out i765 and i131 before priority date is current, correct? So what happens if i140 is approved (regular or premium process) and priority date is not current AND student visa expires? That complicates things even more. I485 would shift from status adjustment to consular process, correct?

Given the EB-2 backlog, most people are in this situation. Having an approved I-140 does not grant you status or work authorization. It is a classification only so if you want to stay in the U.S., you need a separate status. If your F-1 expires, you need a different status. I-140s don't automatically shift to consular processing. You may have to take action to get consular processing but it is possible to get consular processing.

If a local tv but cover 75% audience of that country (very small country) kept live interviewing me like 5 times over 3 years for updates on company projects (I leaded) and even after I left that country, I still be mentioned when they interview other relevant person. Does this similar situation to your second example?

There aren't major changes. It just removes a line of questioning that USCIS can use to challenge a certain kind of evidence.
