I have a quick question If I had someone executive produce one of my songs, and he provided his input on adding harmonies, etc., and coached me on how to lay out the harmonies, and he also included a few harmonies himself with his voice. If I were to remove the harmonies, he did with his voice and release the song without his voice on it is he still entitled to songwriting royalties? We do not have any document or contract in place.
@theartistguides12 күн бұрын
Difficult for me to provide an exact answer, but generally if the other person is just singing harmonies then they wouldn't be given a songwriting (publishing income) share, unless maybe they fundamentally changed the song melody. Therefore, it makes no difference if you release the recording with or without their vocal. However, if you do release their recorded vocal then it is usual that they would be entitled to register as a performer on the recording with a Collection Society in your country that collects copyright income relating to recordings only (not song income). For example they could register with PPL in th UK, or in the US it would be with SoundExchange. This is how session musicians get royalties for recordings they have performed on if the recording is played publicly. How would the contract look with a producer and what would they be entitled to if I am the one that writes, compose and sings; also helps arrange song and always pay a one time fee for their work ? Learned a lot with this video thanks so much.
@theartistguides12 күн бұрын
Thanks for your kind comments about the video. In the scenario you have outlined, the contract would be quite straight-forward. The producer would not have any share of the songwriting (sometimes called the publishing income), but usually you would give the producer a share/percentage of the master recording income (i.e. the money that comes from distribution) in addition to the fee.

If I paid to an audio engineer to record my song. I own the recording.
@theartistguides23 күн бұрын
Yes that is usually what happens. However, you should always clarify this before beginning recording because there are occassions when artists, engineers and producers all have different expectations and ideas of what they believe is being agreed. A simple conversation at the start is much easier than a complicated disagreement later on.

I also feel artists hate the idea of being a business person. But you need to be good at doing business. Because it is a business after all.
@nomad151728 күн бұрын
I also feel people limit themselves with the rockstar thing. There are so many avenues in the industry. Not saying quiting a solo career. But to pay the bills, I'm sure there are better ways to make a living in the industry.
@nomad151728 күн бұрын
I feel people want to be remembered as somebody who made a difference. Or had major influence on others. Not so much the wealth. I'm sure wealth is a big part. But more of creating an experience that will be remembered and studied by others. I guess greatness has a lot of facets. So it's hard to quantify it.

Thanks for your thoughful comments. We have helped thousands of artists and you are right, most are not trying to chase wealth. With our teaching and coaching we encourage focusing on making great music and being a great artist. We want artists to give us their truth and their sound. How good can an artist become and how far can they take it? It's an adventure and a personal journey. Building an audience, marketing, promotion and all the business side is vitally important if you want to make any money, but everything starts with the artistry.

i think a word that would appeal more to artists would be a “concept” rather than brand.
@theartistguidesАй бұрын
Thanks for your comment. I appreciate your thoughts on this. We've tried various ways to describe "branding" when teaching or coaching artists over the years, and you are right that "concept" is a good word as well. I often use it when teaching, although it usually requires further context and explanation. For most people "branding" is more generally recognised as the topic we are trying to explore. I agree, it is imperfect though and is off-putting for music creatives. With our strategy and methodology of artist develpoment we also have other topics such as artistic voice and sonic identity which we treat as separate ideas, so the word "concept" for us would be more of an overall description that can be used to help describe all of these things. We are very grateful for your thoughtful comment on this. We wish you all the best.

This is so informative. Thank you! When the producer agrees to sign over all ownership of the masters upon payment, does that come with any hardcopy deliverables?
@theartistguidesАй бұрын
Glad the video was useful for you. I'm not totally sure what you are asking when you say "hard copy deliverables". If you are asking how exactly the producer gives the artist the recordings, then it is usual that the artist is provided with all the stems of a recording so that it could be mixed by somebody else if needed. Most recordings are sent digitally these days, and often Producer Agreements will say something similar to this: ""Producer will deliver such formats as Artist may reasonably require - including stems"". Hope that helps. If it isn't the answer you needed please clarify your question. All the best

Thank you very much for this information. Please, if you would, help me decipher my endeavour. I am a novice, free-lance Producer who is currently working with an un-signed artist. My background in music goes back to the 1970s - as a musician, composer, arranger, singer, songwriter, orchestrator, recording engineer - et al. This is my first time working with an artist - outside of my own projects. The artist and I have a verbal agreement as to the fee for me to turn over the Master recordings. I have spoken with other more-experienced Producers who have told me I should contract the artist to a percentage of "the publishing". Can you expound on this? This said artist will take the Master recordings and upload them on streaming platforms (Spotify, etc) I'm assuming he might use DistroKid (?). Should I monitor the streams and contract for a percentage? I've heard it takes 1 million streams to earn $1,000. I guess what I'm really in need of is information on how a Producer collects Pay and/or royalties in this modern age of streaming - especially with an un-signed artist, and what a contract for these conditions might look like. Also - should I join BM!? Any help would be considered priceless - and I thank you in advance. I'm SURE there are many novice Producers out there who are asking themselves the same question as I am. Cheers!
@theartistguidesАй бұрын
Hey, thanks for your comment. That's a lot of questions, but I'll try and answer them briefly. Firstly, if you haven't watched our video about Producer Agreements, you should: kzbin.info/www/bejne/kH2pgouardStnsU. In terms of you having a percentage of an artist's publishing, this means you are taking a share of the songwriting royalties. So you should only receive this if you have contributed to the songwriting. Just producing an artist's recordings doesn't automatically entitle you to their song royalties. Yes, as a producer you would usually received a share of the master royalties (the money from distribution). Some distributors will split the income and pay you directly if the artist sets it up that way. Otherwise, you are depending on the artist paying you themselves. Regarding BMI, this is a PRO that collects royalties for songwriters. So you only need to join them if you have songwriting shares in songs that have been released or performed. If you are interested in finding out more, we provide coaching and can properly help you with everything you need/want to know. theartistguides.net/coaching. All the best
