For someone who is a true independent contractor there is no limit. But if they are found to be an employee later there could be big issues with pay, specifically overtime if they were working a lot of hours.

I am being discriminated againt by police and fire trucks workers they are driving by my company with their sirens on for the last year They cost me all my clients I asked them to turn their sirens off and they refused And no lawyers said they'd defend me I need my case to go to court to stop them and give me compensation for the clients I lost

What about employees who have not passed a 90 day probationary period?

It really depends on what the contract says. Many employees think they are under a 90 day probationary period but generally it only exists in law if it is in writing.

@@monkhouselaw5441 I'm unfortunately in this situation again, and have to terminate another employee early next week. The contract does state a 90 day probationary period, however maybe i'm being a bit too personal on this, but the reason this person is going to be terminated is due to budget cuts. Do I disclose this information to the employee at the time of the termination meeting, or simply advise they are terminated and try to keep it short and sweet?

If its averaged out, would the worker still be able to claim their overtime if they're still going over? ("Booking" the hours for later)

Unless it's agreed in writing the employer can't 'average' overtime. Time can be 'booked' for later but should be at time and a half and not at 'straight time'. I was laid off the day of my surgery , first said I was liability, then lack of work , then said I quit is what the Eeoc was told , I was refused lay off papers that my union contract stated I was to recieve stating reason for dismissal , filed suit in federal court ,what the employer denied what I told the Eeoc , admitted to a federal judge that in fact my claim was true my case was dismissed for failure to state a claim regardless that that he not only discriminated against me and wrongfully terminated me and breached our contract he admitted wrong doing and my case was dismissed with predjudice by a magistrate judge , I appealed and was threatened to let it go or else by a federal judge, now I’m in need of on going herniated lower back disc treatment, still need the second of two surgeries for nerve damage in both wrist and have gout in both feet I’ve been out of work with no income at all for a year and a half disability said no treatment no disability, I have no insurance and no income the union has broke one off in me all I’m told is sorry it sucks to be you don’t it ,

Great information! I am not a lawyer, but my feeling is the decision in Hill v. Peter Gorman on what a terminated employee's rights are upon imposition of unilateral changes to terms of employment is still greatly misunderstood by many. Chief Justice Ontario Winkler got it 100% correct- "Wronko v. Western Inventory". My humble opinion only.

Yes. Any employee could have ltd depending on their benefits package.

I’m sorry I meant can you continue your LTD benefit and work for a non profit only an hour and a half daily, No income from the nonprofit during summer or days when there is no class

@@carlasirmans9744 It could well affect your LTD benefits so you would want to be careful with that. I would advise hiring a lawyer to help you through it is the volunteering (or paid work) at a non profit is very important to you.

I got a settlement wasn't great Wasn't bad,but the covid had the courts in gridlock.Dude did the best he could & worked hard given the fact courts are closed. Somewhat happy I guess

Why does the person being bullied / harassed need to leave vs the wrong-doer? The person leaving loses out on their pension - in the long term I.e. severance doesn’t cover what you could collect via pension- especially if you only have a few more years before you want to begin collecting it

I have a couple of quick questions. When SSD transfers to SSI at age 65, will I still be required to see my licensed physicians? And will I still receive disability updated reports from SSA to fill out? Thanx for your response in advance…

Your SSD changes to SS retirement at around 66-67, FRA. No doctors are needed.

Wow, I have came forward and speaking up about workplace harassments, and other misconducts. I live and work in Canada. I went through 1 year of Sexual harassments, bullying, harassments, retaliation and discrimination with my previous employer. I file complains with HR and they said they would investigate it, but nothing became of it. This was my full-time job and my only means of income, and I was injured on the job, so I was on W.S.I.B (workplace safety and insurance board) who was taking care of my Physio Therapy sessions....etc and on top of that I was dismiss from my job, because I couldn't work the way I use to anymore, so I was useless. Some may say, why didn't you get a Lawyer and fight your employer, it's easier said than done. Lawyers are hours in Canada, so I would have to pay $300+ for consultation + $300+ hours. In USA Lawyers are flexible and they work on contingencies, hours.....etc It's tough being a victim and it's tough going up against cooperations.
