It takes a tremendous amount of money to defend a federal case for a defendant and it takes great courage to throw it all to the wind and fight on. It's very very difficult but you got to weigh what is important to you and consider your chances in winning. This experience is not for the faint hearted.

This was a surprising interview. I've always read that the vast majority of federal cases involve plea deals, and insisting on a trial would result in additional charges and greater penalties if the defendant loses. He said healthcare cases are different and that going to trial can work.

While I would have said yes in a heartbeat, I would have missed out on a few genuinely good moments in life that I will never forget. Prison will mess you up in ways you’ll pay for years down the road if you let it, but just like war it also has moments that are good and can change your outlook on life. The meals made from smuggled ingredients, the softball games the few times we actually got to go out, the quiet in the unit on Saturday mornings waiting for your name to be called for visitation… all are memories burned into my soul forever. There was plenty of bad, but there was also the occasional break from the bad that made it survivable.

If you get a target letter, you should automatically assume a case is being built against you. It's that simple. In the case of prescribers, that case is being built on different levels, depending upon the classification of your alleged illegality. it may not just be "prescribing" but in addition an alleged "partnership" or agreement with say a pharmacy that is illegal according to the Stark regulations. Unfortunately, many physicians are unaware of the Stark laws. This has tragic implications. I have worked defending clients with attorneys in different classifications. I am a retired surgeon. I am not interested in "extracting" money from clients. instead, I have a goal of providing a substrate for physicians to have the opportunity to prescribe narcotics without getting in the sights of Government. I have done this through the invention of "Digital Chart Audit." DCA(TM) is a system of statistical charting that sets up "point values" for prescribers of pain medications. The biggest target are physicians who prescribe for back and spinal pain. Next on the list are those who prescribe for terminal care. I have DCA worksheets for both prescribers. Government is interested in severely cutting down the numbers of narcotic pain prescriptions for any and every cause. This is in direct conflict with physician autonomy. I publish under Medscape on this issue, (and others). Even though I work with specific attorneys, I have not gotten into the area yet of using Digital Chart Audit (TM) to protect physician prescribers. In a nutshell it goes like this: Patient A has enough "points' to prescribe specific narcotics. Patient B does not have enough, so they are not being prescribed yet. Patient "C" is terminal but not yet in the late stages of life, approaching death, but point values are still be accrued. Setting up statistical point values is a DIRECT THREAT against the ability to collect data against physicians. Because you can FIGHT each of them on a specific level that can be installed into spread sheets. This is a powerful weapon against Government. I can help Ron Chapman by allowing him to use my worksheets for his clients to see where they "lie" on the point value continuum. I am not in the search for clients because I am very successfully retired. However, I AM interested in changing the metric to allow physicians to prescribe with autonomy. If I were auditing your clients Ron, I would set up point values for their narcotic's prescribing. I would also call upon my colleagues at Medical Justice.com to help, even though they are in competition with you. If you are interested, you can call Medical Justice to start a relationship. I understand why many people who see this site for the first time think that its purpose is to “excuse white collar crime.” I used to think that too. But lawyers and leftist Politicians do their best to CREATE complex laws that treat some professions unfairly. This is true for the Stark Laws that make FELONIES against physicians out of ordinary business practices that attorneys and Real estate agents do all the time. I’m not saying you should “feel sorry for doctors.” I am saying that it requires very special care to avoid breaking those laws. Of course the doctors need to be very careful. Hmm I would not be advising people that 6 months in federal prison is no big deal. If you end up in federal prison for white collar crime, you did a bad thing and should feel bad about it. That's the point of the American prison system, to make sure people feel bad about what they did This video is just flaunting how rich people are above the law

Justin, I respect your work. But I dint agree 100% with you all the time. Bearing arms is a constitutional right! If a arm was not used in your committed crime, it should not be ripped from you. That's not a right a judge should take. Be real, there's a difference between statues (man made laws) and our American constitutional right. This is just all wrong Justin. Why don't you make videos where you hold corrupted judges and government stakeholders accountable for their over sentencing abuse? But I know what you are trying to do. Being on the government's side is what will increase your viewing, but each video I see, I yet have to hear how the judicial system has failed its citizens. Let's be real.

Hey Justin. Thanks for these videos. I am on Pretrial waiting for my case to finish up. I have a question for you. Do you have any idea based on the number of cases you’ve seen, the percentage of defendants that get probation vs time? I’m first time offender, and looking at 12-18 months. I have not gone for PSR yet or anything. Prosecutors going to send me a plea deal for 1 yr 1 day. (White collar charge) Another question you might know the answer to… is there a way to skip going to a re entry halfway after serving sentence? Thank you

You’re welcome. Essential you prepare properly for the probation interview. We have a free course on the probation interview. We can send you. In fact, go to the homepage of White Collar Advice and you’ll see a digital brochure. Page 18 gives you access to some courses. If you get sentenced to prison time, you will want to go to the halfway house, presuming you are prepared. It’s possible to bypass it, but I wouldn’t. For now, you should focus on the probation interview. And also writing your life story.

Yes, that is one side of it and very much a CHOICE. It has been my experience that once they convict you of something, they seem to view it as an opportunity or reason or excuse to do it over and over again. I am currently working on a way to extricate myself from their flagrant abuse of civil rights and violations of their oath.

I find it shocking that many physicians of all ages are NOT FAMILIAR WITH THE STARK LAWS. The physicians who decide they want to play the “procedure code dance” with Medicare are putting themselves in danger. Many physicians earn an income at least 4 times the average American. I’m not saying they aren’t entitled to it. But Medicare EXPECTS certain care to be donated. You should not play the game of trying to get it paid. Rather, invest in rental RE. I did that and enjoyed some wonderful “family time” on painting and remodeling. Best of all: Government was NOT INTERESTED IN ANY OF THAT. Sanjosemike (no longer in CA) Retired surgeon
