I would never rent a car for anyone, but in the event of an emergency and I absolutely had no other choice, I do it right. It doesn't matter who's paying for the car, all the rental place needs to know is who's driving it, and whose paying for it. I'd make sure that the car was insured for full coverage and since the car is only supposed to be driven by the person listed on the contract as driver, the defendant should have been listed on the contract. If you can't prove that you have insurance on a personal vehicle, which she didn't own one, the rental company would have automatically put insurance on the vehicle to protect themselves and their assets. Anyone can use their account to secure payments for the actual person renting the car, they just have to be there when it's rented to give the company their name and billing information. The car can still go into the defendants name as if she was renting the car because she has to be on the contract as driver or she cannot legally drive the car. If she would've gotten stopped by the police for any reason, they would have asked for the rental agreement and the drivers name on the contract has to match her driver's license. If it doesn't, she can end up in a lot of trouble if the police want to arrest her for diving a vehicle that is not hers to drive, as she's not listed as the authorized driver.
