Hi, Thank you so much for the webinar. I have a concern regarding my deposit. My contract ended, and I provided my forwarding address, but I have not yet received my deposit back. Yesterday, I received a notification that my landlord is taking me to dispute resolution, claiming I didn’t allow showings of the house and that I owe one month’s rent due to the loss of rental income. I did allow showings; the landlord completed one and canceled the other. Despite this, she kept both my security and pet deposits. Given these circumstances, can I claim double the amount of my deposit since I should have received it back? Thank you for your assistance.

The woman who narrates this video sounds like she is talking to a 10 year old, or even a 5 year old. She is excessively slow, soft and gentle. It is fine to talk slow and clear, but as everyone watching this is an adult, she does not have to gently baby-sit them.

An appraisal is not specifically required. You can use the value on the BC property assessment. But getting an appraisal done can protect the personal representative. That is, if the personal representative lists the assessed value on the P10 form, it might be significantly different from the market value. If the personal representative ends up selling the property for a lot more than what was stated on the P10 form, that might open up the estate to a capital gains charge, taxable at the deceased’s marginal tax rate.

You can contact the Residential Tenancy Branch to learn the steps to enforce their decision. The Branch has the power to fine the landlord, for example. www2.gov.bc.ca/gov/content/housing-tenancy/residential-tenancies/solving-problems/tenancy-compliance-enforcement/outcomes

Thank you for your great probate video, it is very helpful. Is it correct in looking at form P2 drop down, that there are about 30 probate registries that I can submit my application? Can this be done by mail or only in person? Thank you

You are correct that there are multiple (30) probate registries to submit your application to. The form P2 has a dropdown menu from which you can select the specific probate registry you wish to submit your application to. You can choose the one that is closest to you if you'd like. As for the method of submission, you must file the probate application in person. It can't be done by mail. It's a good idea to check the specific requirements of the probate registry you intend to use by contacting the registry. What if asked for the instructions to what should I do with the car when I go to the mechanic, but the seller told me I don't have to do anything, except change the oil, as shown on the sticker from the mechanic? On the second day right headlight stopped working, low/high beam switch stopped working, there was a leak (also asked couple of times what was the reason for the leak, but got ignorance of the question) which led to the ovearheating on the third day, as a result a need of a costy repair of 50% min of the initial price? And the car became undrivable? It was said by the seller, that he went to the mechanic recently and changed the oil, but nothing and never was mentioned about the leak and possible consequences of such a system failure? Can I somehow make him pay for the repair or get the money back?

Hello, i have a tenant that came in a sub-lease and was not properly screened. We have gone through months trying to evict him and were granted a Order of possesion, monetary order from RTB as well as a mutual agreement to end tenancy initiated by the tenant in exchange for not doing an expedited eviction. Still the tenant didn't leave on the day, so we had to hire expensive baliffs and before they finished loading up the tenant's rented uhaul truck based, he went to Supreme court to obtain a stay order based on his petition to us and RTB that he was under duress. He showed the court baliffs who had to stop the eviction and give him the brand new keys and now they are back inside my new townhome with another month of no rent, he has not complied with any of the orders from RTB. I had an agreement to rent to a nice responsible kind family and would like to know what to do now as I am completely at my wits end at how tenants can get away with all of this and implicating so many people in the process, tons of strata fines, neighbour complaints, new tenants can't move in, financial hardships to the landlords who have to cover month after month of late and unpaid rent, baliff costs, etc etc. WHY? Landlords are hard-working responsible law-abiding citizens and why are we expected to provide free housing that we cannot collect on because tenants don't have the money to pay. So many landlords getting out of the business due to this very reason further contributing to the housing crisis.

We are continually having Bullying and harrasment courses thrown down our throats but when we were bullied into having to participate in an experimental medical procedure to keep our jobs the bullying and threats for that by the organisation was condoned and the employees had no say.

IMO, buying a car privately is much cheaper and no more riskier than buying a vehicle from a dealership. In many cases the dealers have pooled together to force fees and add-ons that end up costing 20% to 30% more than the retail price, so you are going to pay too much.. and much more than the insurance will pay if you were to write it off in an accident. The dealership also usually pays much less than the wholesale price for a trade--in; that is usually about 20% less than wholesale price. By buying a used vehicle privately it is not unusual to buy a perfectly good vehicle for 25% to 50% cheaper than buying from a dealer, and the seller is doing better than trading it in at the dealership. I've been buying privately for years. I have never had a problem in 45 years of buying used vehicles from private sellers. I have saved thousands of dollars. NEVER buy a used car from a dealer; you are bound to get ripped off. Due to the rip-off wholesale price that the dealers are offering for the trade-in, a private seller is very happy to get a reasonable and better wholesale price from a private buyer, as he is able to secure more money in his pocket. Just take the vehicle for a drive, and have it looked at by a mechanic before you buy it. Dealers are crooked middlemen that are well trained to rip you off. There's a lot of illegal activity in the auto industry; stay away from them.

On the probate forms themselves, you might notice a few spots where you're instructed *not* to write "not applicable." In these instances, you should clearly state *why* the question or paragraph doesn't apply to you, rather than leaving the answer blank or writing "nil" or "N/A.

If you are getting a lawyer, does the lawyer file for grant of probate on the executor’s behalf? If yes, do you put the lawyer as the applicant on the P1 form or the executor’s?

The applicant is the executor or administrator seeking the grant of probate or administration so they can handle the estate. (Not the person who files the paperwork on their behalf.)

No, the P1 form is *not* included in the forms submitted to the Probate registry when applying for the probate grant.

Good day thank you for this helpful information. I have a question with regards to the mutual agreement to end tenancy. If someone signs this agreement and decides to leave early by providing a 30 day notice to vacate (tenant written) is this considered valid? For example if there is a mutual agreement signed in February 1 2022 to end Sep 1 2022 but then in July 1 2022 the tenant decides to provide a 30 day notice to vacate to the landlords to leave at the end of that month. As a landlord what are your options. Thank you very much in advance for the advice.

BC's residential tenancy law entitles landlords and tenants to mutually agree to end a tenancy early. If the tenant wishes to end the tenancy before the stated date in the mutual agreement to end the tenancy, the first place to look would be the terms of the agreement for the rights of the parties. If the agreement is silent on this point (the standard form doesn't mention it), it's likely that the tenancy would be treated as a fixed term tenancy. That is, the landlord and tenant have entered into a legal contract for a fixed amount of time. Generally, in a fixed term tenancy a tenant isn't entitled to give notice to end the tenancy before the end of the term. If they do, they typically have to pay the landlord an amount to compensate them for the months of rent they would have received had the tenant stayed until the end of the term. if a person dies without a Will. They had no spouse and no children. Parents and grandparents are predeceased. There are 5 living siblings and 1 predeceased sibling. Question: does the predeceased sibling receive their share? If so does it pass to their estate and distributed according to their will?

Today I had somebody commit verbal slander against my person and it hurt my feelings greatly and I'm not interested in their money but I do think they need to watch this webinar and it needs to be dealt with internally thank you for the legal advice and the perfect definition of deprivation of a person's character since character hopefully they don't add written verbal slander of my character to the verbal slander that they made in the hallway when making a mockery of Justice and affecting my reputation And trying to say I should be charged with mischief giving me a criminal record which would affect my livelihood as I want to take the basic law enforcement course which I also explained to that person in policing

Hi Emie - Assets held in joint tenancy typically pass *automatically* to the other joint tenant on the deceased’s passing. So they do not need to be put on the P10 form.

The PID is the Parcel Identifier. It's a nine-digit number that uniquely identifies a parcel in the land title register of British Columbia. You can find the PID for a property by looking it up on BC Assessment by the street address: www.bcassessment.ca/

If the person only owns 1% of the house, do u still put it in the real property column and how would u put it and for the value at that year she died. Are we talking about the value of that house at that year she died

If the deceased owned a share of real property as a tenant in common, you need to include that on the P10 form. (If they owned as a joint tenant, their share typically passes automatically to the other joint owners and does not need to be included on the P10 form.) The value to put in the form is the market value as of the date of death of the deceased's share. (You can show the math in the middle column of the table. That is: total market value of the property is X; deceased's share is Y; value of deceased's share is Z.)

Can a landlord give a 30-day notice to the tenant to move-out in BC without giving any reason on why the landlord is serving the notice?I live in vancouver and lately my property manager hasn’t been liking to fix maintenance issues in my apartment and today he told me I can move-out if I don’t like living in this apartment and the fact that owners of the apartment don’t like spending 100s of dollars to fix maintenance issues, my owners live overseas. I told him I like to live in this apartment, it’s just that the maintenance issues need to be resolved and he didn’t like it. So just on the basis of owners not liking to fix maintenance issues, can they serve me a move-out notice? My 1-year lease got over few months ago and now I live in the apartment on a month-to-month basis. Thanks ahead of time for your response!

Good question. A landlord can only evict you for a reason that's acceptable under the law. Here's some information from a tenant's rights organization, TRAC, on this point: tenants.bc.ca/your-tenancy/evictions/ A tenant can't be evicted for asking the landlord to undertake repairs and maintenance that the landlord is legally responsible for. Meanwhile, a tenant *can* be evicted if they seriously damage the rental unit or don't fix any damage that they caused. For property, do you list the full value of the property such as what is listed on the BC Assessment, or ONLY the deceased’s share of the property?

On the P10 form, the statement of assets and liabilities, you list property held by the deceased, valued as of the date of death. If the deceased held a *share* in property, the nature of their holding affects whether you list it. If they held the property jointly, as a *joint tenant*, then the property isn't typically included on the p10 form at all. It typically passes directly to the surviving joint owner(s). If the deceased held a share in property as a *tenant in common*, then you would list their share in the property, and the value of their share (less any secured debt on it). What if you are the sole beneficienary and you dont want the executors to be the executors? The executors have been dishonest and not in good faith and cooperative with the family who they were caring for and the beneficiearies? Can you challenge the executors ? How much cost and time would be to proceed with this issue? The executors can take a 5 percent commision being the executors I was told. If the beneficiercy does the executorship then it is cheaper except the lawyer costs?
