And she wants a case showing they were NOT authorized to enter, although the constitution says they can't unless there are EXCEPTIONS. Is she out of her mind?

This, in my opinion is the complete bastardizing of QI. The purpose was intended to protect LEOs when split second decisions are necessary. There was no split second decision necessary. To the contrary, they had an abundance of time and resources available to insure that an innocent member of the public wasn’t wrongly arrested.

I guarantee if an homeless individual had a judgment for monetary award against a bank or local government agency and petitioned the court to hold the defendant in contemp and the judge paused the hearing went down to the bank with the bailiff and police and went in the the safe and told the plaintiff to get what's his or the judge went to the water works department with the police and made the employees empty their pockets and or bank accounts to pay the plaintiff the other side would be up in arms if this happened..

I truly believe that being a defense attorney is the toughest job as a lawyer. More often than not, your client has guilty as hell, and you are required to convince a jury that the shit sandwich being fed to them tastes delicious.

I recently had a bunch of police officers show up at my house, erroneously, and screamed at me to put my hands up when I opened my door (while holding a shiny object, my iPhone). My hands went up rapidly. I had a SWAT gun and a few other guns pointed at me. And some of the officers were Barney Fife's at best. So easy to make a mistake and kill someone. Now I was trained to be under stressful situations so I could react appropriately. But I can see many people reacting differently and getting shot. In fact, the same moronic officers tried to arrest a person with a warrant just a week before coming to my house. It didn't go well. It was the wring guy at the house - and that guy didn't react appropriately and was shot and killed.

Cops shrug their shoulders and look the other way every time a fellow officer wrongly assaults a citizen. And so-called 'drug recognition experts' are usually wrong... they've put people in jail even when they hadn't used any drugs or alcohol.

If cops knew that they were to be held accountable for false arrests they would be a lot more careful about who they arrest. If jailers knew they would be held accountable for false arrests they would make damn sure the person in their jail was the right person. Qualified immunity is the worst thing to ever happen to our justice system. There is nothing just about arresting innocent men and not doing your due dilligence.

So, according to the written decision if the officers have a "reasonable" suspicion that there is an emergency occurring (exigent circumstances) [A very, very low bar] , (even if they are wrong!), they may enter a home without a warrant. It is only because the victim didn't act in a threatening or obstructive way and did not resist the officers' entry into the home and wasn't given the opportunity to comply with her arrest, that they lost immunity. The lesson here seems to be to never consent to a warrantless search and seizure, to never obstruct an officers actions and also to never resist any arrest, lawful or unlawful. The defense occurs in court. If an unjustifiable search and seizure occurs (lack of problable cause), then any "evidence" gathered during that search is inadmissible. (Fruit of the poison tree) If you didn't interfere with the officers' actions, then you can not be legally arrested for obstruction. If you did not resist the arrest or indicate any intent to flee an arrest ( such as by stepping away or turning away from the officer or failing to comply with instructions), then any force applied during the arrest may be judged to be excessive especially if you are injured during the arrest. “Never interrupt your enemy when he is making a mistake.” ― Napoleon Bonaparte One thing I have observed in watching many of these videos is that many times, officers act as if they have problable cause to act when they do not. Very often, the victims act in a way that (to the officers' judgment) gives officers an excuse to act. (Refusing to follow instructions, running, walking, or turning away from officers without being dismissed, etc., resisting arrest) This is not to say that officers will not exceed their authority regardless of how you do or do not act, but rather that by not acting in a way a "reasonable" person would consider threatening or obstructive you deny the officers that defense of their actions. You may consider this an act of malicious compliance. Do not consent, but do not resist. Make sure you are alert and gather your own evidence, names, videos, etc. and question , every step of the officers actions in court. Why did they approach you? Why did they stop you? Why did they search you? Why did they take your property? Why did they enter your home? Force them to justify every step of their actions and defend themselves instead of the other way around.

I view that any case versus a law enforcement official (officer or otherwise) should not be held in the jurisdiction that the law enforcement official was employed. That a 3 state judge tribunal to sit over the case or a single state judge over a jury case. There is assumed to be prejudice in favor of the law enforcement in their own jurisdiction, through elected officials (sheriffs, locally elected judges, et al).

You are the first person I’ve seen mention this is the comments. This is a big issue and I agree with you. Right now I’m being forced to sue California scumbag law enforcement in California for getting a California warrant by fraud and then using that warrant to dupe Nevada imbecile law enforcement into arresting me and kidnapping my kids off the streets in Nevada. The idea that I have to sue them in their courts instead of my courts is ludicrous. We also need to get rid of the 11th Amendment.

Never forget.. Cops are PROFESSIONAL witnesses! They states they heard a gun being racked.. same as "stop resisting" simultaneously as they pull handcuffs out. Regardless of the suspects actions cops KNOW to exclaim "stop resisitng!" Juries and judges give deference to police officers as upstanding citizens.. they cops know and utilize this. They dint even have to conspire to get their storied straight in this regard. "Yes your honor.. you can clearly hear me stating to the suspect to stop resisting!" Partner gets on the stand and says the same thing. If it doesn't come up in court then they lost nothing by stating it. Watch arrest videos and see how often they will needlessly say 'stop resisting, stop tensing up' Add onto that "I smell an odor of an alcoholic beverage" we've seen that happen too often. Then when a 0.00 is blown it become I smelt Marijuana. Just remember cops are professional witnesses

I think the judge talking about case law supporting the families point about taking officers qualified immunity is wrong. While decided law is important it is not solely deciding. I don't understand why the response can't be. Your Honor, we are talking about police putting a special needs 10 year old in hand cuffs and taking her away because she didn't look scared for drawing a picture with violence in it. The police did not act out of safety or policy. They acted to scare a 10 year old with special needs to prove to her a point. That is not legal and trying to prove a point with other case law stupid. Have some balls, tell police when they do shit like this be prepared to pull out your check book.

To answer the judges question about what if we see this drawing and do nothing then the kid comes to school the next day and mows down the school. Nobody said do nothing. But, in fact, the school did nothing the same day. You can call the parents in, call the counselors in, call the school physiatrist in, call in your SRO and anybody else you think would be appropriate to discuss this and decide on an appropriate course of action. What you don't do is call the cops and have a special needs 10 year old dragged out of the school in handcuffs and berated by the cops all the way to juvenile detention.
