It's difficult to answer your question without more details. In general, a child who becomes a citizen through parents obtains that citizenship at the time of birth or before the age of 18 (depending on circumstances). That child can apply for a Certificate of Citizenship at any age. If a non-citizen child age 18 or older enters the United States, they can potentially naturalize as a U.S. citizen (typically after 5 years as a lawful permanent resident).

@ My mom is a US Citizen through naturalization, she petition my younger brother and got approved from NVC before he turn 18, it stated on the letter he can acquire Child Citizenship Act of 2000, but he is turning 18 soon and the US Manila Embassy won't able to give him an interview before his birthday. There is a wait. According to the visa bulletin for this month, they are working on green cards for people with a priority date in November 2021. I don't know your specific situation. Hi, I have a green card and my mother became a naturalized citizen when I was 16. When I applied for my first passport, state department needed my foreign birth certificate which don't have. Is there any other way to go around it? I could try to get certificate of citizenship by filling N-600 but its too costly and the USCIS stated on their website saying I do not need one since I automatically became a citizen when she naturalized.

If you are using many sheet protectors, this would be very tedious to open for USCIS. There's also not much value to a sheet protector for a standard sheet of paper. Some people like to use a sheet protector as a pocket to hold their loose photos. That makes sense. If you need to use more than 3 sheet protectors, it's probably too many.

If one parent is a US citizen and the other is a foreign national, the citizen parent must have been physically present in the US or its outlying possessions for five (5) years, at least two (2) of which were after age 14. Based on your brief explanation, it doesn't sound like your child is a US citizen. Check with an attorney to be sure. Even if your child isn't a citizen, you do have the ability to return to the United States. Before doing so, you could petition your child for permanent resident status. Upon entering the US as a child (under 18) and residing with you, the child would automatically become a US citizen.

You're not wrong. This video was made before that USCIS statement. However, the overriding rule is to keep your package of materials organized. A paper clip is easy for them to disassemble. It's better to have paper clips than to submit a stack of unorganized documents.

I was born outside of the US in 1980. My parents brought me illegally to Puerto Rico (US) when I was 6 months old, but they adopted me when I was 14 years old in 1994. So my mom is Nigerian and my dad became a us citizen in 2014, they got divorced 2002 when I was around 8 months and the court made a decision for my mom to take care of me and my sisters, few years later 2009 my mom and dad got back together (not legally) so my mom went back to the court and the court ruled for my dad to take back his responsibility to take care of us. Fast forward my dad filed for me to move to the us, I arrived in the us in 2018 when I was 17 as a permanent resident upon arrival, I lived with my dad, I currently still live in the same address as when I arrived in the us, my dad passed away in 2019 2 days after I turned 18, fast forward again to 2023 after 5 years of been in the us I tried to file for n400 but in the process I keep getting a message that I might already be a us citizen through my dad, so I looked into it and I technically met all the requirement needed, so I sent my document to department of state to apply for a passport, 3 weeks after I got an email saying to send a legal document of my parents divorce and legal document of custody of me for my father. Tbh I initially forgot to send in the custody decree by the court in 2009, but due to the email sent by department of state I sent them the custody decree that shows that my dad can now take over taking care of me and my sisters, I also typed them a to whom it may concern later breaking down this information and explaining the timeframe of the documents and how I qualify for this child care act, I’m waiting on their response but I’m a nervous on the outcome if that document is enough for them, please what do you think?

Unfortunately, a permanent resident child must be under the age of 18 when a parent naturalizes in order to automatically obtain citizenship through parents. It's likely that you parent's citizenship date will actually be a little later than the interview. The date citizenship is granted is the date of the oath ceremony. Although it is possible that the oath ceremony could be the same day, it is typically scheduled a few weeks after the interview. If you turn 18 before the oath ceremony, you'll likely need to apply for citizenship on your own. As you mentioned, you would apply just like your parent. File Form N-400, Application for Naturalization, and go through the same process. Good luck!

I have a question did the law for the child care act that went effect in feb 2001 thay affects children born between 1983 and after pretty much what if u derived citizenship in 1999 when u were 15 can i derive based off the law prior to the child care act? It's sounds like you've already submitted the I-130 petition and have a receipt notice. That's progress. The receipt letter is an indication that USCIS accepted the petition for processing. Why is the agency that you used not helping explain this to you?

This isn't a common type of request. So we don't have a "typical" time frame. USCIS and NVC aren't extremely quick to respond to customers. It's likely a response will take a minimum of 4 weeks and possibly longer. The category may also be a factor. In other words, if the upgrade is to a preference category that still isn't current, they may not prioritize the change.

Yes, it does add a degree of difficulty. But if the father has maintained a relationship with the child (generally financial and nurturing), it's still possible for the child to establish citizenship. The applicant must father this evidence of "legitimation."

What would be evidence of legitimation? What would I have to do exactly to prove a child born abroad outside of marriage was mine and a citizen of the United States because the child is mine and I was born in the USA?

To be clear, the public charge rule isn't new. They modified it slightly, but it is for the better. Your answers to public charge related questions can affect the success of the I-485 application (for adjustment of status) and DS-260 (consular processing application for permanent residence). Before submitting Form I-864, you need to know how it will affect your application. Will it help or hurt? Generally, if the sponsor does not have an income that's at least 125% of the poverty guideline it will negatively impact the application for a green card. (You should expect a denial.) CitizenPath's service will help you determine if the sponsor is qualified. If the person who petitioned the intending immigrant isn't a qualified sponsor, you can also obtain the help of a joint sponsor, this would be a friend or family member that is willing to be the sponsor. There are options.

I got RFE for i-130, been asked ton attach original RFE letter on top. It can be downloaded copy of RFE received in email or USCIS account or it MUST be original copy which been delivered to postal address in states. Short of time need urgent reply please. Will be very grateful!
