Interesting case for sure. OKC bomber was pulled over for a expired license plate and jailed on a unrelated charge (I believe possession of a loaded firearm) and was in a county jail for a few days before the Feds realized law enforcement already had him... lol Its an interesting read as well. Goes to show you just dont know who or what you are pulling over.

They shouldn't be able to do a property freeze(car, cell phone or other object) for longer than a person can be held without charges, typically 24-48 hours. Either get the warrant or release it.

Balanced opinion and I sincerely appreciate that. The issue is that removing a citizen for “officer safety” makes a citizen much less safe. Why not stay put and finish the stop with respect, without ordering a lawful gun owner out of his vehicle?

Wow...what terrible advice. Some perspective: Two wrongs don't make a right...when the Police do get involved, the crime has ALREADY BEEN COMMITTED. It is super cool and dramatic to come in later, guns blazing and 'Make it right'...however, if it is the wrong persons - now you've committed a completely new crime [however these crimes are rarely prosecuted]. Citing home no-knock warrants for non-violent crimes, performed at 2am at THE WRONG HOUSE and now innocents are DEAD. As Gandolf said in the Lord of the Rings: "Do not be so quick to deal DEATH & JUDGEMENT....many have lost their lives who were innocent....CAN YOU GIVE IT BACK TO THEM?" In your specific story: the offense already occurred, the victims are no longer in harms way. The police can scan all the car license plates, stand and observe... How about: Empty all ADJACET ROOMS so during the 'de-escalation' phase then the police draw and shoot - they don't kill innocents in the adjacent rooms...Cause Ms Wilson in room no.19 visiting her sick sister should meet her maker tonight by a stray bullet...for a sex offense. .. [Such a small sacrifice on the alter of justice] I know that's just too complex a concept to grasp...Protect & Serve... I know you did not intend to be so caviler however this situation can spiral into a very intense situation, especially where the path leads to confrontation.

The call to 911 does not mean the geust was giving the hotel a problem. The hotel can make errors and if they neglect to register a geust, that is not the fault of the guest.

So I would be considered a democrat but I agree with this law that law enforcement officers retired and active should be allowed to carry a firearm concealed to protect themselves and their families. It will be a good thing to have a law enforcement officers with a gun in the event of an active shooter event.

the fact that an officer takes his oath seriously is a good thing, and under the circumstances i can see their concern about showers and evidence. however what i feel would have served all concerned would have been if the officers planted their butts in the room until the warrant was obtained then proceeded to detain/arrest the suspects. their presence stops any evidence from being destroyed without stomping on the fourth too badly.

Great info for us in the field. And i love the fact you highlight the reasonable doubt many officers have that regarding case law vs. "thats just the way we do it" attitude. We cant ask the public to submit to unreasonable infringements of their rights, and at the same time we need to do things by the book to ensure the real bad people out there get the justice served to them appropriately. Prosecutors cant try a good case if we arent doing our due diligence in respecting the letter of the law. Subscribed! Love this content.

You are not so clear in this video. You say it's a fourth° fourth amendment violation usually except for extenuating circumstances. But you didn't go into that exception for motor vehicle you need to go into there I'm gonna have to look it up because now I'm not so clear

The exception for the tint meter would be the Motor Vehicle Exception under Carrol. But police need probable cause first, then they could use the meter. But they most likely will have it. Is that what you were referring to?

The problem is cops are of the notion that it is us against the citizens. That is why a traffic stop whether real or not is fishing for probable cause for arrest. In most cases if they get your gun it will disappear in the system. Cops are not accountable to anyone. Yes a few get caught but generally they have a system in place that protects them from even a murder charge. It's called qualified immunity. They are not your friend. If you allow them in your house you have given them keys to your kingdom. Anything in plain sight can send you to jail and/or prison. Cops are not your friends. You can help a rattle snake stuck under a rock and he will bite you. After all he is a rattle snake.

I know you have already created a video on "ID Requirements for Criminal Trespass in Texas", but I would like to know what the law is in California? Today, the Midwest Safety KZbin channel uploaded a video called "Woman Fights Back During Simple Trespass" (kzbin.info/www/bejne/rZK7Z2xmbKqLbdU) in which the police arrest a woman for obstruction because the woman, who is outside the store, refuses to follow them to their car to give them her ID for a criminal trespass warning. So I'm wondering, was it even legal for the officer to ask her to come to the car to give them her ID, even though she wasn't in the store and was walking away from them? With kind reagrds Gian

Just saw a video yesterday about a female cop trying to disarm a licensed fire arm instructor. The driver (fire arm instructor) was pulled over for expired tags. The driver told the officers he was licensed and armed. They wanted him out of the car. The backup female officer tired to remove the handgun and was struggling. She then proceeded to use her finger on the trigger to help pull it out. Get what happened? She shot the man with his own gun.

Well if you arrest them for the contraband can't you simply search the vehicle incident to arrest based on Arizona v. Gant? I would say it would be reasonable to say evidence of drug possession would be within the passenger compartment of the vehicle.

The officer didn’t give a damn that I had my driver window rolled all the way down & gave all necessary information.. he still ended up charging me with obstruction cause the passenger window was not rolled down for backup. No dark tint, can see perfectly fine. No weapons, drugs or open containers, nothing on my person either. I was the only one in the vehicle too.

Cops must proceed as Innocent until Proven Guilty... even if Not locked is not enough to take away from individual... yes if they are afraid they can Seperate them from gun by removing 'em from vehicle if on hip ... don't reach for it ... again no reason to remove without further issues (under the influence, highly aggressive Proven by body camera)... 2nd states must Start enforcement of 2A their restrictions are Constitutionally Illegal (short of Lawfully Prohibited by Constitutional Due Process ie: violent crime sufficient enough to suspend rights)

Sorry man you made more questions and more confusion by discussing it just get to the point A) yes they can be arrested or B no they can't Give simple explanation as to why and not running through detailed codes I know that's important later but for the moment the common Joe needs to know Yes or no and what the common citizen can do either video record someone stealing in trying assist Community by doing what..? I was following that case! Luckily, the prosecution was able to secure a guilty verdict as they had to work around the illegal search and use circumstantial evidence.

Well first off unless a cop had articulable facts Mimms does NOT just allow them to pull people out of the car. Most cops think it does but since Mimms is based on Terry there MUST be "a reasonable belief that the person "may be armed and presently dangerous." Notice the PRESENTLY DANGEROUS part? If that is missing then Mimms fails to apply.

@Marcus_1776 True that about SSN. I was in a class action lawsuit in Oklahoma about their use of the SSN for the ID number on the Ok. Driver license. They had to do it a different way. It was never supposed to be used as ID except for SS purposes.

You have misunderstood mimms. Police can order driver and passengers out WITHOUT any reasonable suspicion because traffic stops are inherently dangerous. That does not automatically allow a pat down. A pat down requires articulable RS of a weapon. But you can be ordered out of a car during a traffic stop.

So to the Idaho officer, congrats you got a warrant arrest. Per Utah v. Strieff the arrest is good and the guy goes to jail, no issue there. But I sure do hope you didn't make a misstatement of law and say anyone at any time while driving must present ID, but it sounds like you did and often do. Cause now this guy, from jail, gets to do a unlawful seizure 1983 civil rights violation on you for the initial stop. He won't get to claim the arrest as a violation, but the demand for ID and not letting him go(if that is what you did to get his ID) will be valid damage claims. The moment you do a show of authority, and start making demands, you better have evidence of a crime occuring, and that the guy you are making demands of had some involvement of it. 4th amendment is a thing, and people are learning what it means. Good thing your supervisor is now limiting liability of himself and his department.

What gets me now is the DUI checkpoints. These checkpoints seldom result in any DUI arrests, the last several in our area netted 0 DUI arrests, but bunches of outstanding warrants, suspended/revoked DLs and insurance violations. It wasn't really a DUI checkpoint at all, but a warrant sweep and documents check run under the guise of a DUI checkpoint, which I don't think follows the intent of the DUI checkpoint.
