I'm confused because my spouse applied for the I601-A from INSIDE the US and it was denied because the officer said if approved, it would be revoked once he goes to his consular interview due to fraud/misrepresentation. I guess an I601-A does not waive fraud/misrepresentation?

The I601a does not overcome fraud or misrepresentation. Your spouse needs the I601 waiver for fraud or misrepresentation.

Only time in your home country is counted towards the two years. Time in the US is not counted. Hope that helps :)

You need to fulfill the two year home residency requirement before filing for a Marriage Green Card. However, you can file the I-130.

Mr. Kaushik Rachod, First of all I want to say thank you for such excellent KZbin video with well-thought out questions and answers on J1 issues. I am presently on a J1 visa as a High School Math Teacher. I just check my DS-2019 and I am subject to the 2 yr residency requirement based on skill list only. I want to apply for my waiver now that I am already in my 3rd yr and I have applied for the additional (max) 2 year extension. Based on your explanation on the waiver list 2024, I am from Nigeria, The explanation you gave appears to be in conflict with what I know. In a nutshell, am I exempted from applying for J1-visa waiver? since I am ONLY subject to the 2 yr residency rule based on skill list only? I don't have any government funding, and I am not a medical personnel member.

Thank you for your kind words. An applicant can review the new skills list to determine if their home country is still on the updated skills list. If they home country is on the New skills list then they would still be subject to the two year rule.

Hi 😀 Yes in general, it is two years in your home country. Time in the US on a tourist visa will not count towards the two-year rule.

Thank you for this! I'm a US citizen & my immigrant spouse entered after 97' with an Italian passport (He's not an Italian citizen). He applied for an I601-A and it was denied. He willfully departed the US for a family medical emergency recently. What other waiver can he apply for? An attorney told him an I212 and I601, but we're not sure.

Hell they skipped over two groups for I-129F this year in 2024. I submitted our application 5 July 2024 and other groups that submitted late July and August already have their NOA2 and while I’m really happy for those couples, why is it taking them forever to process the group we are assigned to? It’s frustrating.

If your wife is not in the United States yet, then the appropriate process is filing for an immigrant visa, because coming in on a visitors visa with the intent to Mary could subject her to a Denial due to misrepresentation.

@@hebaallahahussein2280 Most Egyptians that apply for hardship waivers that are our clients have government funding. If you have gvt funding you still need the waiver. If not you may be able to adjust if the applicant is ONLY subject to the skills list.

I am a Permanent Australia resident as well as she is. Does time spent in Australia as a permanent resident count towards the two-year home residency requirement ? Moreover If after getting Australian citizenship does this will change the applicability of the Section 212(e) ?
