Bad advice since one of the elements in court is reporting complaints to supervisor/HR. If you don’t complain nothing happened or didn’t give the company to correct the issue.

I'm glad you mentioned the risk of escalation when pursuing a restraining order. We had an employee who threatened to shoot everyone after he was terminated but never heard from him after that. When a restraining order was considered, we decided against it because the risk of setting him off was greater than the potential benefit. That was last year and we haven't heard from him since, but that might not have been the case had we continued to pursue legal action.

One of the best presentations I have watched. Thanks for your work. It will help in my lawsuit against my employer who retaliated, discriminated and failed to comply with laws. I gave them three years to comply, a stay in patient treatment and impatient treatment and I finally had to constructively discharge.

General industry for COVID-19 was given by OSHA more than once. Once as a Full plan, March they gave another emphasis on 1910.134(d)(1)(ii) & (f)(2) as well as 2 more in April of 2020 all from Patrick Kapust via Amanda Edens out of Boston, Regon 1 branch of OSHA.

Most companies that institute their policies fail to do a proper hazard and risk assessment of if the policy will truly be beneficial for employees. In terms of safety toe shoes in particular, yes it will help prevent foot injuries if something is dropped on or driven over the foot. What is never considered as a balance is the definite long term consequences of wearing safety toe shoes (versus slip resistant and other safety shoes provides). Things such as hip, knee and ankle pain that WILL be caused due to the unnatural foot and toe mechanics that result over time. Unfortunately no one is willing to do a long term study on this. Only found one from Britain that got no press about a decade ago I believe. There is without a doubt areas that the benefits out way risks, but not the blanket policies OSHA pushes and companies blindly follow with short term thinking without looking at long term outcomes for employees that likely only work for a company a decade or so. Thank you for the great information, but can’t stress enough a proper unbiased long term assessment.
That isn't unfortunate in my opinion. OSHA should not have the authority to force mask or vaccination mandates. Federal government has grown to large. A burdensome beast that has tried to outweigh the individual rights.

It would have been a MUCH BETTER presentation if you had left your liberal bias out of it and just stated facts. For instance, OSHA was MUCH BETTER off without any leadership than it is now with extremists who are pushing their political agenda and calling is safety...

The USSC's per curiam opinion reads, "Under the law as it stands today, that power rests with the States and Congress, not OSHA." How does this apply to the District of Columbia-- with its Mayor and Council-- since it is not a state nor has congressional representation. Will you help me understand what the USSC decision means for the DC GOVERNMENT work or please direct me to a source that can help me understand?
