Im a special needs disabled person and my niece the self appointed attorney-in-fact came in and took my veteran ,rosie the riveter,private child advocate parents acreage of 62 years while keeping my 86 year old mother whereabouts unknown for 2 years until mom passed away.Niece came in my parents house and the new attorney she brought in with my mom being 86 years old had my parents house to herself and her attorney said I was not welcome at my mothers house and if I set foot on property I could have criminal charges put on me and Im not to contact the executor or she can put a restraining order on me and I could end up in trouble.My dad 76 years old on July 15,1990 showed me a copy of his and my mothersd joint will which read that he leaves everything tto the eldest son which is me and then my dad told me he was a millionaire becasue of good investments.My dad passed away 2 months later on Septembe 01,1990.

Probate sales and foreclosures are similar? Probate sale is a choice of the family's and foreclosures are when the bank sells a property on the court steps, with minimum bids being the outstanding mortgage plus all the fees that will added as the bank sees the equity will cover. Except I have to just put this out there, if you have a loved one who passed away with a low interest like my fathers 3.5% rate 30 year fixed, please be advised after a certain amount of years , the banks no longer make money off these mortgages, because they pay themselves upfront, look at the principle being paid and the interest, when u can see the mortgage balance seems less and less. The truth is its ok too keep paying the current mortgage payments till the home is paid off. However if you are made to believe no one at these large corporate bsnks wells Fargo the non loyalty mortgage company. They will turn u away every time u make an appointment or not , at least in nor nev. Then let go of there own employees in there corporate offices that handle deceased accounts and mortgage services. Until they refused too pay themselves monthly and sell your property before you have ever been given the opportunity too speak with a grown up, other then tellers who not there department. No bankers . For over a year. Be on hold starring at the one banker who now just has too sit on hold over 2 hours, but nope can not start that process until u sitting in front of these people. Then still sell your father's mortgage because they already paid themselves, and they don't care 30 year great customer all accounts in their corporate hands, aka investor's in whales not the middle hard working class. Who are the baby boomers and must not like senior citizen's who didn't get some loan they couldn't qualify for , and it sure feels like 2008 Except we didn't do anything wrong. But the only legal next of kin, out over 150k because of banking and locally policies too protect corporations, not us. Sell your familys life work way below current market value and its a sporting event of u don't exist , too much equity too miss out on the court house steps auction. This is what happens when you have a loved one pass away at home instead of a hospital where the proper administration can make sure the family and loved ones have the state and county information and explain options and learn a word , no child has ever made aware before, called probate. People there are equity Wolves out there, especially if a only child and or a single female. Ok just female. I think this is a great way too make a career choice, until this happens to you. Except u will be prepared. Wish I had. 😢

No need to visit the Probate Courthouse, they are free online but you do have to know what documents to look for especially Independent Administrators and where to look for Real Estate.

As an additional comment: I believe the Probate Referee's valuation of the property must be completed and dated prior to the acceptance (signing) of a purchase contract, or the court will disallow the sale and some of the process has to start over. I had that happen to a buyer I represented, where the Listing Agent was not too familiar with the probate process. I even asked her directly if the valuation had been completed and she thought it was, but the attorney that was handling it, was also not well versed in probate, so the valuation was not completed prior to my Buyer signing the contract. And therefore, the purchase was voided at the court hearing.

Executor or Trustee however you want to put it, automatically has the court on their side. So if you are a beneficiary and your being completely ignored and not provided any information and you don’t have the money to hire an attorney and go all the way then it’s best that you just go on with your life the best way you can. Because what’s not mentioned here is that the Executor or Trustee has the right to do as they please. The Will or Trust is at the complete discretion of the Trustee as how things will be handled. The Trustee can sell estate assets, keep them for themselves, doesn’t have to inform beneficiaries what they are in titled to or even if they decide not to allow a beneficiary their inheritance. The principal is gone and the Trustee decides what happens. Just because your a beneficiary doesn’t mean you have rights because what they don’t tell you in these videos is that you don’t. Sorry for the bad news but it’s best to be honest and not sugarcoat the subject and get peoples hopes up relying on a video that leaves out very important information.

My mom passed in January of 2023 and then my sister passed away a month later leaving my olded brother and I. I trust him for the most part but he can be a control freak. He's contacted a lawyer and got the deed to send to the attorney I guess to start probate? He hasn't said much but it hasn't been long either. If a probate court is overseeing it and there is a lawyer helping handle it is it pretty much safe to assume the shares will be split fairly/evenly as it should?

No but at least yours has a probate judge, sometimes trustees don’t involve the courts and proceed to take advantage of the beneficiaries by not distributing their inheritance. Keep in mind that a trustee Does Not have to abide by the principle’s last wishes being a will trust or both. The trustee can literally keep a beneficiary completely in the dark

Still very confusing. I just got the appraisal and it's $200k (65% over valued) over what the house would sell for in it's current condition. I was not given the opportunity to submit information regarding the condition of the property and My attorney told me that I could do that. Now that it's done, my only concern is who this affects my Future property taxes, or other expenses. I could care less is this only affects the amount the referee and attorney are paid.

Hi Kim, I listened to your talk and have a question and hoping for some direction. My mom passed on 9.10.22 and my sister and mom were buying a house together. My sister hired a probate attorney and as I understand the probate attorney said that the house does not have to be assessed for value and can go off the Fair Market value. I have learned different in that a 3rd party should do the assessment of value. needle to say, Teresa (my sister) had a friend in real-estate bring up the fair market value. Teresa does not plan on selling the house which is fine with me, it's her house. unfortunately, my mom's will has caused a rift in our relationship. I am looking to walk away with a fair and even settlement as my mom wanted for her daughters. Currently, I have a trust issue with my sibling. what advice do you have for this situation? thank you in advance. 🌸

So many messy situations. I’m in one currently. My stepfather passed many years ago. My mother passed at the start of the year. There are 2 mortgage-free properties on the same street. One was to go to my sister and the one my mother’s been living in, was to go to me. My sister has been living in the other home. But both properties are still in our mother’s name. Now that Mom has passed, my sister “decided” she was the executor and hasn’t made any legal moves. Either our mother died intestate OR my sister didn’t like the Will, if there was one and some my mother is considered to have died intestate… I have, however, found my stepfather’s Will in county records and, if I have it correct, I am to inherit all and distribute at my discretion and I am to become my mother’s successor executor. Because there’s drama in this case, it has been difficult to hire a lawyer. So, I’ve written up and filed the OSC, VC and Proposed Form of Judgement. We have a court date coming up. Hopefully, my stepfather’s Will will carry weight at the hearing. My sister is also against me selling the house I’d inherit, although she, basically, already has a house. But, I intend to liquidate as, I do not wish to live near her. So, yes, many family situations are messy and complicated.

@@patrickprendergast9589 this is long. But will have things people may want to know. Supposedly, we’re a week away from the end of probate. It has been a year. We’ve had a few hearings and case management conferences. We’re both pro se litigants (representing ourselves). This is both because we can’t afford and didn’t want to spend money on a lawyer. But also because, since my sister would neither renounce executorship, nor want to be co-executor, she utterly stalked the case and I’d have been stuck, living in a home, where I’m a squatter, could neither sell, nor insure. My personal belief is that, even if she didn’t understand that, it would be exactly what she want, because when I die, being the oldest, my house would immediately revert to her ownership, as next of kin and she might wish to accelerate my death, for that purpose. Despite her mostly being gone for 30+ years, because I left 4 years before our mother died, since I do not tolerate narcissistic abuse, my sister “decided” she owned everything, which is not law. Earlier this year, I asked the court appointed admin, if I could change the lock on the door of the house I’m to inherit, they said yes, my sister did not like it, broke into the house and changed it again, damaging the door and I have since changed it again. Both houses are damaged/cluttered. But hers is, perhaps, worse, with a hole in the roof and a raccoon. Mine has a new roof, but a wet basement. If you’ve never been in probate before, depending upon your state, how it has been handled for us, is that the judge vacillated about whether or not to sell the homes. They decided to let us keep them. The admin wanted to get quit claim deeds, but I wanted something with more protection, against my mother’s debt (perhaps) and we’ve instead received modified bargain and sale deeds, after the admin consulted with a title company. My sister submitted receipts to the court, which the court took as investment in the estate. I was never made aware of, nor signed for these expenses. But the court decided I owe her $7K, which the Surrogate office knocked down to $5K. My sister is still fighting for the $7K, gaslighting the Surrogate office, similar to how she was gaslighting and manipulating the judge. Most recent paperwork has not mentioned that I owe anything. If I do, I’d like to know about payments - line $10/mo. Plus, a new door and lock might cost up to $2500, which she should pay for. We have deeds now, which means that, if my sister breaks in again, I can have her arrested this time. One might think I’d hesitate, but I do not want to have her as a neighbor, who is harassing and doesn’t respect boundaries anyway. This weekend is personal property exchange, for which I made a chart for the court, of what we have/have not agreed upon. I will have police presence there. If we do not agree and personal property exchange is not completed, a new judge will be assigned next week. I don’t know what happens after that. Oh and, I am the executor of my stepfather’s Will, which probably means nothing, at this point, although my layperson’s interpretation of his Will is that I’d inherit all. And my my stepfather’s Will has no effect on my mother dying intestate. I assume it’s possible to find my mother’s Will, if there is one, as I continue going through her things. But, I t’s such a mess, it will probably be too late to mean anything. If I find it, I will inquire. Again, I don’t want my sister as a neighbor and I’d evict her. I’d probably sell both homes and buy something else, somewhere else.

I’m battling my custodian of my UTMA account for access since I’m passed the age of majority and I was told by the clerk that the probate court is limited in its capacity. They refused to do my motion for summary judgment. The clerk stated the probate court doesn’t hear summary judgments. I’m trying to get my case transferred to Civil court under their recommendation but the clerk isn’t returning my calls. They said they’d call back on Thursday and never did. I called and left a message. The judge also did a decree for a full accounting of my assets which is 30 days. I also just placed a motion to transfer. I’m appalled how slow the probate courts are. I’ve been going in this a year so far. I heard it takes years. It shouldn’t be like this to get justice from an abusive custodian who refuses to release my assets to me!

PHD should of trumps bad contract, Vulnerable sector, old young disabled Fed act 2005 can’t take decision making it not court order you have right to refuse. getting 1/4 If I had not been born, a rich man. So, let's say an older son who lived with his mother, who recently died, and took care of it for ten years, can't buy the house, makes absolutely no sense, these real estate rules and laws are ridiculous.

I don’t know why ANYONE canNOT buy any house. It’s not a matter of being barred from it. Just not given first refusal. Personally I’d hate someone living there automatically being given “rights” to buying it. I’m dealing with it now. But if it’s just about being ABLE to buy it, no problem.

My mother died without a will. She has five children. I was the one who actually lived in the house with her because she'd lost mobility and was DPOA on hospital records. The property is in California. Do I get to stay in the house or have more rights to it since I was living there already for 5 years? Or, do you think Probate court will split everything equally?

Executors cannot take action to manage the estate prior to being appointed. If you want to change the locks to protect the assets while the system is taking a very long time, is it ok to change the locks ???????
