I’m low income and on disability but have about 200k in savings and these new asset limits affect me. I’m already on section 8 and my housing authority said they’re implementing this later in 2025. Is there any type of housing that just goes off income only or am I completely screwed and have to burn through all my life savings? I don’t really want to do a special needs trust because I like to have money readily available for possibly buying a home in the future, medical expenses, vacations, and emergency fund.

What about if you get a settlement for wrongful termination and loss wages in your ex employer and you go over the limit can they terminate your section 8?

My sister who had lived with my mom for many years and was only approved for ssi just a little over a month ago. She passed away this past weekend. She had her first check delivered but was in so much pain that she was unable to cash it. Now the ssi ppl are telling my mom she must send it back. She needs that money to pay her funeral costs. Does this sound correct?

If you are a live-in provider, meaning you share a residence with the recipient, then your IHSS earnings do not count as income when qualifying for Medi-Cal for yourself.

@Freethinker1967 is there some proof of that? According to medi-cal, it is income. And I may loose my medi-cal and go to shared cost because I make to much as a live in provider for my adult son.

Please help, I have two bilateral hand amputations and receive now 967 SSI a month, but I was hit while on a bicycle by a vehicle, and will receive some form of injury settlement, how can I not affect my SSI what does it and how does it work with annuity structured settlements, and what is the amount in Oregon I can earn over the 967 a month

It sounds like you might need a 1st party SNT. You should work with a special needs planner in Oregon on this; Academy of Special Needs Planners has an online attorney search engine.

Hello, Im a mother(70) of disabled adult child (40years old since 16, schizophrenia) she was on my SSA(as a DAC) for 8. years.( I claimed SSA at 62). Recently my husband (70years) claimed his SSA and we swited to our DAC to undert my husband's SSA and its denied. (she got diagnosed when she was 16) and last year she worked anout 8 months right before we claim under my husband SSA claim..(her wage was under SGA) we are trying to appeal. we live in Los Angeles, CA. how do we do it ? Thank you for the information. I live in Illinois and get SSI. I have a question. My sister created a special needs trust for me and she put money in it. I have no access to the money. She’s in charge of it all so I’m guessing that’s considered a third-party Trust? I have to report it to Social Security and the lawyer said all I need to give them is the certificate of supplemental needs trust and I don’t need to give them anything else. Is that actually true or do I need to give them more info than that? Also there was a miscommunication between my sister and I and when she created this trust in July, she told me that the lawyer was gonna take care of all the paperwork and I didn’t need to do anything. So it’s January 2025 now and I found out that they never did send it anything. Now I’m scared that they’re going to take away my benefits or punish me in someway.

Ellen, There is the Medi-Cal 250% Working Disabled program and persons with disabilities can earn much more than $1,670 per month. Actually, under the California Medi-Cal Working Disabled program, annual earnings in 2024 much higher for adults with disabilities.

It gets abused. That's what happens in Canada. If someone is poor and in bad health they are told, "You could do MAID." That is instead of helping that person. That is what I have a problem with this. If someone wanted to do this, there is no need for this, DIY, a boom stick.

Where do we get the rule book ? I thought it goes like this:: Unearned income - $20. Then subtract $65 from your earned income ( if you had earned income). Subtract those from your SS INCOME. Then :::: divide what remains by two. That is the countable income.

I live in Minnesota. Can you discuss questions I have about my situation with regard to receiving a small inherence, in a family group of 7 siblings, as my mother's estate (parents will) is prepared to be settled in Carlton County? I am disabled, working part -time and as close as a few weeks😂 to having finally made it through the Met Council wait list, to actually be offered a real Housing Choice voucher (S8). I'm being urged to write a quit claim for my portion of the Estate, on the basis of being qualified for protection from harm, should the asset received cause the disruption of benefits from programs I am qualified to receive based on needs and very low income. Can you help me understand if a Special Needs Irrevocable Trust is my best way to retain my share of the 11-acre non -salable real estate?

A nursing home will frequently receive the income of a resident, as the share of cost. I suggest you consult with an elder law attorney to learn more.
