We are four siblings, mum remarried , then mum died unexpectedly from cancer and our other youngest sibling lived with her as he has an incurable illness,...long story short, our younger sibling didnt get on with my mothers partner and moved in with other sibling to be looked after 24/7 care. 2 years later we recieved a solicitors letter giving us 2 weeks to reply to a contested will of my mothers and her husbands estate where he is demading the ENTIRE estate for himself under 3 grounds (fraudulant will, not contributing towards household bills and some other accusation). My mothers husband also stated that he is not letting a penny go (mainly because he says we are not his children) and apprently he will 'sit on the estate money' until it is all gone so nobody will get anything. Can he do this? (we have been in touch with his solicitor and we are willing to negotiate, have proof and evidence to the contrary to the accusations and have been communicating freely whereas the accuses is inwilling to negotiate and is hard to get hold of, both parties are willing to go to court)

Unfortunately everything he said is true. Thia highlights what is wrong with the English legal system. It is one of the only proffessions where you can make up bills afterwards, and also two bills, one for if you lose and one for if you win and want the otherside to pay it? Not only is it money for old rope and used as a tool, but the delays in every aspect of the current legal system means it really is not fit for purpose. Do not use/ go to court unless absolutely necessary?

As a defence litigator of 25 years experience there are by and large three defences. First, In the minority you defend on the merits. Second, negotiate. You use the 'threat' of defending, to compromise, Third; obfuscate, delay, bluff etc. In my opinion the third is seriously unsatisfactory and does not suit my style but the reality is that you are obligated to do the best for your client ... and well, what can I say? it seems to work. Have not read the book but did use the legal surgery at a cost of 150.00. This was a complete waste of my time and money. The consultant told me to make sure i sent all the info needed to review the case prior to the schedule meeting as this was the only way to ensure i got value for money. Despite me doing this and despite my date being cancelled for another date someone called Daria eventually contacted to have the meeting and she knew absolutely nothing about it. Ironically she still managed to do most of the talking which was a waste of my time because she was just generalising since she knew nothing about my case becaus eshe hadnt read anything. Like the saying goes. If you really want something doing, do it yourself from start to finish. They got 150 for nothing.

How complete should the documentation be? There is relevant and irrelevant communication. Some just refers to entirely unrelated topics like the actual business that was being conducted. There could be huge attachments with hundreds of pages, or videos, skype messages, slack messages, phone calls, etc. One can never document everything and/or share it.

Dear Sir, I have property dispute where it was agreed that my late parents property was transferred in a siblings name to hold in trust until such time our parents were deceased. Thereafter to sell and distribute shares etc. The sibling has failed to cooperate as she has deceived parties with intentions they had and reliance. How can I obtain a court declaration of beneficial interest in UK and which court would this be filed and under what jurisdiction? What is the legal standing of the registered owner..e.g a representative/administrator / etc.

Hi. Thanks for your invaluable advice. I deal with the IP court on a regular basis, because copyright theft has become rife. I concur with your view of the court, which I find to be entirely dysfunctional. It allows itself to make all manor of errors, including grammar and spelling mistakes, yet the litigant in person is held to account throughout the court process. I have even turned up at court, only for the judge to say that there was an adjournment, which we had not been informed about. So, if the judges know about these failings, why don't they speak out in order to make the changes?

Really unhappy with the customer service provided Hastings my car insurer, due to their incredibly poor service they had me spend hours writing complaint emails and make telephone calls. Ive been misdvised numerous times, I've complained 4 times and they only replied to one complaint. I raised this with FOS and bizarrely they admitted both that Hastings should have communicated better but simultaneously that they believed Hastings didn't have to do anything further to rectify their shoddy service (despite never at any point addressing three of my complaints). Ive already plundered so much time and energy into trying to get them to address their service but FOS have given them the green light apparently. I really dont want to let them off the hook, so im wondering, please can you advise if there's any chance of having a claim uphold for distress, inconvenience and time loss in small claims court? im only looking to claim £300 to cover the time wasted, let alone the stress and anxiety they have caused.
