Have you ever faced a situation where a former employee after resigning claims that the resignation was obtained forcefully by the employer? Recently, this issue was dealt with by the Supreme Court ("SC") in the case of M/s Bharti Airtel Limited vs. A.S. Raghavendra1. The employee contended that he was forced to tender his resignation because of discontentment with the performance appraisal rating given to him and non-recognition of his work.

The recent judgment of Nipun Aneja & Others v. State of Uttar Pradesh revolves around the prosecution of three senior officers from Hindustan Lever Limited (HLL) in connection with the suicide of Rajeev Jain, an employee of the company working with the company for the past twenty-three years. Crux of the Case Rajeev Jain committed suicide in his hotel room in Lucknow after attending a company meeting. His brother, Rajnish Jain, lodged a First Information Report (FIR) the following day, accusing senior officers of HL, of mentally harassing his brother by pressuring him to accept the company's VRS scheme.
