Sir, sabhi wakeel husbands ko ye hi bolte hain ki maintenance to dena hi padega, khas karke bachcho ka. main dene to taiyar tha. per agar wife ke jhoothe cases me bachhe hi baap ke samne aake khade ho jayen aur baap ke khilaf statement aur gawahi dene lagen, court aur police station me bhi to kya husband bhi bachcho pe lagaya gaya interim maintenance aur Arrear dene se mana kar sakta hai?

Rare judgement. Kudos to the family court. The court should follow the written law i.e. the wife has left her matrimonial home at her own will. Many times exceptions to 125 CRPC are overlooked. Adv. Valentine

Sharma ji (वकील साहब)मैं आपकी सारी वीडियो बड़े ध्यान से देखता हूं और काफी कुछ समझने की कोशिश करता हूं मैं वकील तो नही हूं लेकिन मेरा भी Divorce case चल रहा है और कुछ कुछ ऐसा ही मेरा case है 49 months यानी 4 साल से पत्नी मायके में है और अभी तक maintance नही मांगा WS file करने जब कोर्ट आई थी तब उसने कोशिश की थी की maintanance डाले लेकिन उस वक्त जज साहब ने request लेने से मना कर दिया था,में ये कॉमेंट इस case के संदर्भ में दे रहा क्योंकि किसी पुरुष भाई की help हो सके दो जजमेंट हॉनरेबल Supreme Court की आई है एक 2015 में और एक 2021 या 2022 में जिसमें कोर्ट ने ये clear कहा की अगर पत्नी ने 3 साल तक मेंटेनेंस की डिमांड नही की तो इसका मतलब ये है की खुद पत्नी और उसके माता पिता इतने सक्षम हैं की वो पत्नी का पालन पोषण आराम से कर सकते है और कैसे खारिज कर दिया गया।।।।

my salary is 1.17 lac and magistrate in DV case has allowed 1.08 lac as interim maintenance. I am not able to understand shall cry or laugh. Moreover the magistrate is not uploading the order hence not able to understand reasoning

U have right to speak with magistrate, fight hard over there and say that you want to stay with your wife and shift onus on them to reunite your family, even if they allow maintenance tell them to hang you or give permission for suicide but you will not pay maintenance for no reason, fight as hard as you can.
