Day 3 in the trial of the death of Ahmaud Arbery continues. .
.
.
Arbery was shot and killed on Feb. 23, 2020. Cellphone video leaked to the public shows two armed white men in a truck approaching the 25-year-old Black man as he runs down the road. One of the men, later identified as Travis McMichael, and Arbery struggle over McMichael's shotgun before Arbery is shot and collapses.
Travis McMichael, his father Gregory McMichael and William "Roddy" Bryan, who recorded the video, are all charged with murder in Arbery's death.

Even though I think that people who start shit, particularly when they have a gun, should not be able to flip over to self defense the law doesn’t agree with me on that. Zimmerman and the people who killed Ahmaud Arbery are super clearly and completely at fault for the initiation of the interactions, in situations that they should have do so, and needed up killing in “self-defense” so the situation they caused but the Rittenhouse situation is muddier. The initiation of the conflict was mutual. And even though what was throw at him was a bag of trash and not a Molotov like dumbasses claimed, him being chased offers plenty for them to latch onto and create reasonable doubt. Hopefully they learned their lesson from the Zimmerman case and went with charges that don’t carry intentionality. if you are denied an argument at the first trial, there is no making that up later on appeals, that's why lawyers act like this even if the appeals court rules he erred, they can only order a new trial but you approach it from guilty, so you will never get a fair trial and considering how often this happens, it always cute to see the lower judge think they are always right, and can do no harm I'll see what a real attorney has to say about this, considering its cut down too much for context

@sherrychilds2034
@sherrychilds2034 2 жыл бұрын
The Judge in the Rittenhouse trial had to admonish the prosecuting attorney on the first day of the trial for the same issue as this defense attorney. Are there so many attorneys who can't respect Judges ruling? Rittenhouse's lawyers objected to prosecution playing the sound in a video when Rittenhouse was not in sight, because you can't prove he is close enough to hear what's being said. Judge sustained it. He told the prosecution, you agreed to only play the sound when Rittenhouse was in frame, before the trial started, do what you agreed too! The prosecuting attorney started playing the video again, leaving the sound on. When the defense objected the second time, he said he was trying to prove Kyle Rittenhouse's state of mind, he said Rittenhouse could hear and see everything on the video. Rittenhouse couldn't possibly hear and see everything 100 feet away from him in a crowd or see around the corner. The Judge sent the jury to the library and admonished the Prosecution! He said it was grounds for an appeal and the prosecuting attorney needed to conduct himself according to the accepted laws of trial in the state. Sounds to me like Attorneys are the problem in both cases! I can't hear everything said in a crowded street or see around corners, nobody can. Don't know why you think convicting someone under those kind of circumstances, would hold up under appeal?

@whoeverelse

@@Liquid_Mike Not for me. I'm all for self defense, castle doctrine and some aspects of stand your ground. However for me to defend the guys in this case, I would have to drop my beliefs about another case being tried at this time. We can say they feared for their life when he reached for the gun, but we can't say he feared for his life when they pursued him in vehicles with guns drawn? They had no authority to detain him, even under a citizens arrest. It's not a question, the black and white is there. Honestly, with the footage that was released as well as statements from the homeowner - I doubt a trespassing charge would have been filed. One could say it was the gun stolen from the truck that really raised the alert levels, however in the same the truck was left unlock and that's the only time it has been noticed anything was stolen from the area. I mean, I'm sure some other things could pop up. I just don't see this going well for them, as well the cops were already on their way and likely would've been able to handle the situation. They arrived just minutes after all this, there was no threat to life. It's how fluid things can change. For example, in many areas under Castle Doctrine if a person were to break into your house and immediately leave, you would not be authorized to step out of your house and fire at them as they drove/ran away. However, you could drop them on your doorstep or anywhere else on your property as long as there was a perceived threat. But that's it. Man's running down a road, he's no threat at that time. There's been no loss of life or even confirmed that he was in fact stealing. And to be honest and connect it personally, my neighbor will call me or text me often to go do something in her house or garage while she's not home. I wouldn't want to be leaving her house and find someone on her doorstep with a gun out and on me. Just to hope that the person is chill enough to allow me to reach in my pocket and grab my phone to show them i was asked to do something.

He made a very rude remark after Linda's objection like "I don't know why I'm so confused here Judge" but in a condescending way in the middle of the Judge speaking. I knew as soon as the Judge asked the Jury to leave he was going to tear into that guy. Truly childish behavior you would never ever expect from an experience trial attorney.

@@daphnecopeland6007 Yes he is guilty of burglary. Burglary is entering property with the intent of committing a crime. It's just the intent to commit a crime. Which is what he did. The Defense Attorney is being unprofessional and attempting to psychologically influence the juries with false testimony painting the murder victim as a burglar (criminal) which he was not. The victim was murdered while jogging, he did enter a home under construction out of curiosity. I have done the same thing many times and luckily the Klu Klax Klan trio was nowhere near me or I wouldn't be writing this post. Please convict and put them on Death Row.

Would you want to be murdered by being shot to death with a shotgun? If you do then I pity you.

@Robert Why do you spread misinformation or lies? Here is the truth: When Mr Arbery was in high school, he received five years of probation for a first-time weapons charge and in 2018, was convicted of probation violation for shoplifting, according to the Atlanta Journal-Constitution newspaper. It emerged that, in 2017, a Glynn County officer attempted to tase him after he denied their request to search his car at a park. Police bodycam footage showed the encounter with officers, who said he was in a car in an area known for drug use. He said he was on his day off from work. The taser malfunctioned and he was allowed to leave on foot. Even given the above factual information I provided he didn't deserve to be murdered by 3 racism creeps while out jogging. I assume you are White by the time of your comments. I suggest you look into your soul as to why you are not outraged at this heinous murder.
