'Shows a lack of respect:' Judge steps off bench after 'rude' line of questioning by Travis McMichae

Judge Timothy Walmsley says he had to step off the bench after 'rude' comments were made. According to the pool reporter, Jason Sheffield began filling a couple of big pages on his board and it was all very visible to the gallery.
Judge Timothy Walmsley was not pleased with this and said this type of behavior will not be tolerated. Says he had to step off the bench.
Ahmaud Arbery was shot and killed on Feb. 23, 2020.
Cellphone video leaked to the public shows two armed white men in a truck approaching the 25-year-old Black man as he runs down the road. One of the men, later identified as Travis McMichael, and Arbery struggle over McMichael's shotgun before Arbery is shot and collapses.
Travis McMichael, his father Gregory McMichael and William "Roddy" Bryan, who recorded the video, are all charged with murder in Arbery's death.

They should aspire to be able to read a simple statute correctly and not give the wrong jury instructions that result in conviction of 3 innocent men. All that was required to stop Arbery was reasonable suspicion, which despite the DAs attempt to obscure was exactly what they had. Their conviction was wrong and it should be reversed on appeal

@@douglasbroccone3144 you can't accost a person on a suspicion. No one can, not even the police. There was no proof he had ever committed any crime. If that is the case anyone can accuse anyone of anything and be allowed to kill them when they tell you to get out of their face. The young lady that accosted the black chiod in New York is facing 10 years because she left her phone in an UBER and accused the young man of theft, she attacked that young man she is charged with assault and battery and several others. No one is playing with you crazy people that think you can harm someone over what you THINK. TRY it and see what happens. You can end up in jail for false imprisonment, assault and battery and murder.

@@annocsunamoon according to the previous Citizens arrest statute reasonable suspicion was all that was required to detain a person. The question is whether or not the Mcmichaels shooter pointed his gun before Arbery tried to take it and did that nullify the lawful Citizens arrest . At most the shooter was at jeopardy but neither of the other men should have been convicted... very possibly not even the shooter

He doesn't have to play games at this point, all the games were played already, before the trial started in discovery when he handcuffed the defense lawyers with the things were able to talk about, example, Arbery has ran from law enforcement 10 times in the past already, he had no idea if the McMichaels were law enforcement or not, however the state got to show that law enforcement normally wears uniforms on patrol when we all know there's undercover cops everywhere... I won't go into the other things at this point because I'm sure if there's a guilty verdict it will be overturned for these and several other things

And everyone was worried this judge would be too lenient on defense cause usually he is more more lenient to defendants. And I am guessing he is that way because he sees a wrong in other cases.

Basically since Ahmaud didn’t steal/burglarize anything, the defense attorney basically is trying to get the officer to say that he responded to the house because Ahmaud burglarized. It’s all about how they ask the questions. Instead of asking the officer if what Ahmaud did could be considered burglary; the defense attorney made a statement and tried to get the officer to agree. At the point it’s like the defense attorney is testifying and that’s a big NO.

What is important to remember here is, the defense attorney cannot answer questions that he just asks for the wittness. He had been repeatedly warned about his outrageous behavior. He cannot tell untruths such as, Mr. Aubrey was stealing because the home owner said he did not. The video of him in the home proves he did not. They cannot link this murder to another robbery had happened by unknown person and without evidence because it is not relevant. The question before the Jury is ONLY if these three defendants committed a crime not the police, not Mr. Aubrey.

@@z.z-g6106 not necessarily. The jury was picked under obvious racism and was chastised but allowed. And juries tend to believe cops over evidence. And the killers dad was an ex cop. But, we can only hope for is honesty from 12. Keep in mind that one was removed for comments made on another killing. Sooo, historically speaking it's not good. But, again we can hope for proper justice for him and the family

No home robberies were witnessed by the McMichael's or anyone else in the area. Travis reported his gun missing (from his *car* it should've been locked away in his home) but again there were no witnesses. Just lots of assumptions because they'd seen a black guy jogging in the neighbourhood. "Them cops" can't just apprehend a person because someone believed (without evidence) that he might’ve done something illegal! That would be like me telling police I saw you in my neighbourhood and you seemed strange. In addition a few cars had been stolen and I'm sure you did it. Would you expect the police to run over to your home and question you? Would that be fair? And no, the defence lawyer cannot sue the judge, prosecution team or the police for defamation or anything else. That's madness! Apart from the fact he wasn't defamed, the defence lawyer did not follow the judges direction correctly and deserved the dressing down he received. As for "them cops" they did their job well once they got the necessary evidence. You do realise this murder was covered up for about 2 months because the incriminating video wasn't handed in? Active duty police apparently knew about it but didn't investigate because McMichael Snr was a retired police officer and had worked for the DA. Your comment is full of misinformation and incorrect conclusions. And if English is your first language then its no wonder the USA doing so badly. This judge takes his position seriously and exercises his role with decorum and fairness. I have nothing but respect for him. I think the way he conducted himself, and this trial, should be a model for all criminal proceedings in the US. I've never seen one on a highly publicized, televised trial such as this be less controversial. He was personable, polite, ultimately professional, and even showed a sense of humor when appropriate. What a great man.

A Judge has a duty to maintain decorum in the Courtroom. We attorneys sometimes allow our passion to overcome our common sense, which leads to getting checked by the Judge. I think the Judge handled this very well and made his point.

Wow, the subtle yet powerful way he laid down the law was very good. When he asked the people to exit , it reminded me of when my dad would ask my friends to leave the house. Then I immediately knew I was in deep trouble. His tone, his stare, his intensity. Sent chills down my back. 😂

It baffles me to see how far a lawyer would play dirty especially in a high profile murder case such as this one. Then again, as I think about politics and the lack of interest many are toward human rights, it gives me a small level of understanding of such actions. I'm confused also as to when pre-February 23, 2020 information "completeness the defence has" the police are told by the state they don't need to collect (and only casually and don't need to follow up on McMichael's three times stated claims many burglary, car break-ins, etc. are going on besides just the eight this detective has done since 2015. If the state wants that to be Gregg McMichaels "3xlies" then why are they then so interested in keeping all the rest of Gregg McMichael's information following Ahmad's shooting to the two months before they get arrested. That is keep only the facts that condemn them and throw out facts in this case that may be evidentiary support to "justified citizen's arrest" in any way! Very confusing!

“Reserved” is a better term for what you are saying. “Conservative” (and yes, I am referring to the word in an apolitical manner) means adverse to changes or innovations over tradition or status quo. That is not this judge. He was very clear about his tolerance of unorthodox methods and approaches… he has a long leash. It just goes to show you how far this attorney abused that tolerance. In the face of that disrespect, the judge regulated his own emotions very well. He is the opposite of the judge in the Rittenhouse case, where the judge (who likely favors traditional methods) was not at all reserved and regulated in his responses.

I'm an attorney. Because of my type of practice, I rarely enter a courtroom. Nonetheless, I've had enough experience to see good and bad judges. I won't comment on the bad ones -- there are plenty -- but as for the good ones, they are admirable. A good judge not only needs to have a good handle on the law (especially evidence), but s/he really needs a certain type of balanced temperament that is not easy to manage and does not simply come with intelligence. It is a different quality.

Wow, this judge is very impressive and can see through the shenanigans to forcefully and respectfully let the attorney know the tactics will not be tolerated. We need more judges of his caliber.

@@mougen4138 Rittenhouse's judge wasn't biased, this one wasn't either. Rittenhouse's counsel generally played it very cool in the courtroom while Binger did some very questionable things that raised questions among some people about prosecutorial misconduct. If you can think of an instance where the judge showed clear bias I'd like to see it. For the most part the issue was that the law and the facts were biased against the prosecution, not the judge.

@@dcan5012 Both the judge and the prosecutor in this trial were on point. And I agree with this outcome. I don't like the outcome for the Kyle Rittenhouse trial but from a law perspective I thought it was right. I respected the judge in that one too, and the prosecutor was just terrible.

Yeah except for the bias of ignoring the defenses right to the doctrine of Lenity where any law that is ambiguous and in dispute must be decided for the defendant... So not so unbiased

Amazing how people find bias in judges but fail to see the bias in media. And I’m not saying that you personally are doing that. But I’ve seen a lot of people who think that way.

The way the judge handles the gaslighting attempts by the defense attorneys.....just brilliant. I would love to watch more cases he presides over because I feel there is so much the world could learn from him.

Attorney trying to make the victim a robbery suspect even after the owner of the property reported NOTHING wrong. Lots of people, even me, are sometimes curious about new structures being built in my neighborhood and just go in, look at the work, and most of the time admire the work and style itself. This man was being stalked because of his skin color. You are there only for a payoff by your clients and you know their case is weak as water but you are obligated to defend them. I hope you have a concious becsuse if you don't you need to find another field to work in..Being a LAWYER is not your forte!!

Then when you are trespassing and someone stops you, comply. Don't go for his gun. If he complied, he'd be alive. Skin color has NOTHING to do with it. You're inferring racism because you see everything through the prism of race. When was race even brought up except by certain news networks. No one at this trial is accusing anyone of racism - just outsiders who can't see things any way other than what the media tells them to.

@@Mechulus Why would he need to comply? They were not law enforcement officers nor the owners of that property. They were citizens who felt entitled to police another citizen. They had no right to stop or question him and this was proven in court. That is called false imprisonment. Also the owner of the property clearly stated that the victim stole nothing from his property. Anyway, they'll be doing life in jail now so, that should be a good message for entitled folks to mind their own damned business before trying to police people for whatever reason they see fit. Is there any particular reason why you are justifying two people killing another human being in cold blood? Even if they had stolen something- that doesn't justify his murder does it? Or maybe it does in that skewy head of yours.

Everytime the prosecutor asks questions and a response from the witnesses..one of the defense start coughing because they don't want the jury to hear it. . I thought I was the only one noticed it because I haven't seen any comments about it.

I love this judge. Very fair, very respectful, and you can tell he has a real love for the law. You can tell he was one of those law students that wanted to make a difference. We totally need more judges like this.
