Yeah there are laws in the US that prevent setting traps that use lethal or maiming force. The idea is that you're not protecting the lives of the occupants if it's rigged somehow. You can defend yourself with lethal force against an intruder, but not when you have no idea what it's firing at. So that anti-theft system from robocop 2 that immolates a car jacker....totally illegal (not sure why anyone would want to smell burning flesh anyway) The big question is what chemical is being used and what it can do to the human body.

This is exactly my line of thinking. It's not a trap when the object clearly states - with a standardized warning icon - that it is pressurized and cutting it will cause an explosion. The same label and icon is on a can of spray paint, and that's not illegal

Alright, this video is old but I have some things to point out. Now, a booby trap is most commonly defined as, "A camouflaged or concealed device designed to cause bodily injury when triggered by any unsuspecting persons making contact with the device." A few things right off the bat: One (1), this lock comes with a clear warning label explaining the contents of the shackle, what they do, what they are capable of, instructions on how to safely remove if required by an official, and to not remove the label (LPL appears to have removed it for reasons unknown). Two (2), the release of the chemicals is not triggered by anyone coming into contact. The shackle wall is 24mm thick, and made of a sturdy metal. It is highly improbable that it will be punctured by accident, even in any sort of crash. Three (3), on the aforementioned label, remember I mentioned it had instructions on removal by an official? It clearly states that if the removal of the lock is required (for reason such as abandonment), to call a locksmith to come pick the lock, contact the company to obtain a spare key, or contact the owner to come remove it. Now, what about bystanders? Well, the nature of the chemicals is that while they may be unpleasant to passersby, it will only induce vomiting to those in a close range. What about the pressurization? While they are under sufficient pressure, seeing as the most probable method to puncture the wall of the shackle is with an angle grinder, I highly doubt that the perpetrator's face will be close enough to cause injury. It's common sense (not to mention basic safety) to not put your face up close to any sort of power tool, and if they are close enough to sustain injury, then they were not following proper safety for the tool that they were using anyways. If for whatever reason you were taken to court over this, it would be civil court - not criminal - but I very much doubt that the perpetrator would win the case seeing as it is very clearly stated on the warning label that, "Hey, bad things will happen to you if you try to cut this lock." If anyone such as a janitor or firefighter is made to vomit by this lock, it would also be against the label, which clearly says how to safely remove it. Also if someone attempting to steal your bike did take you to civil court, you would then have a counterclaim because there would be either an admission of trying to steal the bike, or at least it would be very suspicious on how they just ~happened~ to release the chemicals from a 24mm-thick-walled metal tube that can only be punctured through extraneous effort or use of a power tool.

Heavily depends on the juristiction. In many states, the definition is a lot broader, concealment is not necesarrily a factor, nor is the way to trigger it. In many states or countries, a trap is anything designed to harm someone who triggers it. However that may be. Boobytraps are also a felony. Also no there wouldn't need to be a counterclaim. One crime does not make another crime ok. It's likely the thief would also get in trouble yes, but that wouldn't clear you from having commited a pretty severe felony.

another relevant question is that if you lock your bike to a place where it’s not allowed or bike-racks which will need to be temporarily cleared for an event, then the locks will be removed by government employees rather than thieves. does this change your liability status? it certainly changes the morality of it at least, since the poor employee is completely undeserving of the skunk spray! edit: sorry i saw that you mentioned the situation of an official needing to remove it. i guess the remaining question there is who’s liable if they don’t see the warning label

Rather than a presurized chemical, I'd rather see some word of fouling material like Kevlar strands to bind up the grinder. I'd also like to see some conductors running through it. If any get cut, it breaks a circuit that sets off an LRAD type of deffense.

I also love the idea of this lock. But i have to wonder about it's longevity. I once had a can of mace explode in my face because the young lady's purse it was in was left in direct sunlight. (Several of us heard a slight hissing in class and followed it back to the purse. i’m assuming that the significantly thicker steel of this compared to a thin spray can will allow it to withstand significantly higher pressure. but the risk on the other hand is that when it finally explodes it will do so with a much higher force. so the question is what temperature is needed to raise the pressure enough to overcome the steel

Aside from LPL's point of what happens when someone suddenly let's go of an angle grinder and the severe damage that can cause, there is the fact that 10 atmospheres released suddenly in a narrow jet could easily cut through flesh. So we now have someone who has gashed his arm, hand, face from an angle grinder then is essentially injected with god knows what chemical. As ridiculous, absurd, and insane as it sounds, you are likely to be sued and lose. Most people will see it as overkill, especially for property like a bike. But then the one thing LPL did not include when he said the grinder can cause harm if suddenly let go of, is that if it kicks back just right, it will kill if it hits the thief's neck. Ahh, now we are looking at manslaughter, you aren't going to skate on that. The concept feels so satisfying and can get you into so much trouble.... for a bike. Think the risk is worth it? Risk - Benefit analysis 1: one out of every 10,000 causes great bodily harm to the tune of $200,000+. Are you willing to lose everything you have to preserve your bike? Risk - Benefit 2: one out of every 500,00 causes death resulting in you losing 5 years of your life in prison, AND losing everything you have to the family suing you for wrongful death, your criminal defense lawyer, and your civil defense lawyer...... For a bike? Yes the odds are very low and most of us like to think it won't happen to them. But unfortunately it can and it does to many people in similar circumstances. I actually like a combination of the suggested lower pressure and, from another comment, the dye used in a dye pack.

There was a case in Virginia where a man set a shotgun trap to stop thieves who had been breaking into his barn and stealing antiques that were stored there. A thief breaking into the barn tripped the shotgun and was so severely wounded that his leg had to be amputated. The thief sued. The guy who set the trap had to sell his farm to pay the thief for damages.

Is it considered a "trap" if it requires the destruction of the item in question? I compare this to a gas operated furnace. A thief could compromise the furnace in order to steal the gas being fed into it, but if it explodes on them, is the furnace classified as a "trap" in that case?

That's a stupid comparision. A furnace has a intended use, and the explosion occurs through mishandlement. This bike lock was specifically build to cause harm to someone, yes it is upon destruction, but it was specifically build to do that. A furnace isn't MENT to explode, this lock is. And yes, it is still a trap. A trap is anything that is supposed to cause harm to someone upon a specific intended action. If you get a lock that attacks someone trying to steal it, it's easy to argue that you wanted someone to try to steal it. You didn't buy the safest option, you bought the option that hurts someone. Why would the owner come forward and identify themselves to subject themselves to liability greater than the value of the bike? And in a city where this is likely to be used, I think you're overestimating how much the police would care. If anything they'd probably just mark it as a statistic unless the guy dies. It would be such a low priority that by the time the guy got something moving there probably wouldn't be any way for him to find the owner

Which law supercedes the label I think would be the argument at least for attempted theft. There's also the fact that the bike could be in an area local or federal Gov't officials need to be cleared like firefighters or is off limits so cutting the lock as many legally do would probably result in a lawsuit or even a claim of it being an attack. It depends on the standards of liability that end up applying. It was a while back, but in my engineering courses we went over legal liability and engineering ethics. If you get held to strict liability (being responsible for any way that customers use your products), a warning label is not sufficient to say that it is not your fault. Recently very few companies have been held to strict liability (see: Tesla autopilot crashes), but it may come back in style for the courts to use that standard. It used to get applied when people were using lawnmowers wrong and being seriously injured. A company could get in trouble if their product was conducive to being used in a dangerous manner, even if they had a warning not to use it that way.

Yeah, he is correct. Boobytraps causing physical harm are illegal in most states. Also uniformly a Federal crime to rig an unattended "spring gun" to fire in response to a triggering event/action. As some people have pointed out here there are two arguments to be made here: A) That it isn't a boobytrap because notice is given on the lock itself, and B) That inducing nausea isn't causing "harm." That said, I wouldn't want to be dragged through court having to make that argument. I can't see many DA's having much interest in charging this as a criminal offense but that doesn't mean you couldn't end up having to make those arguments in a civil suit.

So point A is heavily dependant on the state you're in. And point B is something that would be up to the court to decide, what exactly constitutes harm. How likely is it to break from rough handling when it gets a bit rusty?

The Reason for prohibiting boobytraps to defend property is simple: *They also work on emergency services* If someone on a Medical, Fire or Police emergency has to move you locked up bike (or is called onto your booby trapped property) they could be affected as well as any thief. In South Carolina where I live, I'm pretty sure this would be considered the "setting of a trap," which is mighty illegal and the potential civil court loss is profoundly greater than the price of any bicycle.

I think the more viable option would simply just squirt some china ink, the type used in anti-theft pucks at electronic stores. It would mark the thief and i think that's already good enough

The lock has a clear warning saying “chemicals under pressure, do not puncture”. That should make it legal as ignoring this warning is basically like the thief cutting open one of those gas canisters used to power grills willingly (although maybe not as dangerous as this doesn’t involve flammable chemicals). Those also have a similar warning.

Well, I am not a legal expert but, at least according to Iowa law, this may not be legal here. I don’t know if you could be arrested for using this however, if someone did get the chemical sprayed on them you potentially could be sued. If any one wants to find out why search up the Katko v. Briney case.

@@BodenM I'm not convinced it would, automatically, become dangerous. Depending on the failure mode it might rupture from the steel softening, but at that point the softened metal wouldn't crack and fragment so much as kinda moosh out of the way. This is entirely speculation on my part, of course.

@@BodenM They probably have a safety pressure release built in, which can be as simple as a thiner spot of metal that will rupture if the pressure exceeds what it is expected to ever reach under worst case normal usage.

I think it's worth mentioning that it's very likely Law Enforcement/campus security in many places would be victims when removing bikes that have been locked somewhere they shouldn't or for too long

Cops don't go around cutting locks off bikes. I've never seen a cop walking around with an angle grinder.

There's a way around that. Those signs say "Will be removed at the owner's expense". They don't say a thing about the locks getting cut or the bike remaining in one piece. Just cut the bike and leave the lock in place. Malicious compliance is fun like that.

Honestly if I saw that warning and my job was getting rid of bikes in places they don't belong I'd probably cut the bike and leave the lock. (where I went to uni bikes parked where they shouldn't be usually ended up scrapped)

The thing about this lock is it gives fair warning to those seeking to damage the lock. Regarding the shotgun trapped house is the firearm was set up to cause serious bodily harm to the intruder. With this particular lock, the chemicals used are simply applied to be a deterrent and to not cause any harm to the would-be thief.

All 50 US States (and some local jurisdictions) are going to have slightly different versions of this definition, some more vague than others. I think “I wouldn’t be confident enough that this lock is legal to use” is a reasonable response to this lock.

You're quoting the specific definition of one narrow offence under a federal drug statute. But the issues can be more fundamental cf. Katko v. Briney: The law has always placed a higher value upon human safety than upon mere rights in property. There is no privilege to use any force calculated to cause death or serious bodily injury to repel the threat to [property].
