@sarabrant723
@sarabrant723 15 күн бұрын
News flash you actually have to be committing a crime that is a state or federal statute in order to be trespassed off of public property. ASU is not private property it is a public school. The supreme Court has already ruled that in order to trespass anybody off of public property they have to be committing a crime. Just because they broke a school rule does not meet the threshold of a crime. First amendment auditors on KZbin do it all the time there are policies at some public buildings and they cannot trespass you because you are not following their policy. It has to be a crime.. those students were not committing a specific crime they were trespassed off of public property because of an encampment that the school deemed to be against school rules. Show news flash you can't be trespassed from public property and threatened with arrest or arrested unless you're committing a crime on public property. Like I said the school making a rule that you can't have an encampment does not meet that threshold. Cities and towns have paid money to lots of first amendment auditors for that exact reason. You have a right under the Constitution to protest peacefully. It doesn't say you are not allowed to have an encampment to protest in the Constitution. The campus police charge them with trespassing that is not allowed, they will be paying out judgments to a lot of people for violating their constitutional right to protest on public property. There are lots of videos and then you have to charge each person individually and have proof individually for each person they can't say well the crowd was doing it. And I don't even support these protests on college campuses lots of people have tests and things that they were studying and they were interrupted. They are not allowed to trespass you from public property unless you are committing a crime under state or federal law. So like I said just because the school has a ruler regulation that the students weren't following does not meet the threshold of a crime under state or federal law in order to be trespassed. A simple Google search will tell you in order to trespass someone from public property you have to be committing a crime. It is really really bad and they are going to pay a lot of money to these adult toddlers who were protesting and it's going to take money away from other activities that the school could be funding. Like I said I don't support the protests I wish somebody would have thought about that before they started arresting people

It’s called consequences. Students get suspended for far less than these terrorist lovers. Free speech & trespassing on private property are completely different. Can someone please tell that First Amendment lawyer to go back to law school? 1) While everyone has free speech, you do not have the right to infringe on the rights of others- which these protestors are violating. Classic example, you cannot yell fire in a public place to cause mass panic. 2) Did these students seek and obtain a permit to protest on the school grounds? That permit is part of the normal/ legal process for voicing a group's views in a public manner while respecting the First Amendment. 3) These same protestors are violating the ASU code of conduct. In short, you do the crime, you need to do the time. Court will just be a formality.

I don't think the comparison tracks. Freedom of speech and religious freedom intersect in this context, not for all but for at least some of the students. I don't think there is an ABOR student conduct policy against peaceful protesting or freedom of speech/freedom of religion. ASU is subject to both state and federal civil rights statutes since they receive federal funding. Students should have due process even if they are charged with a conduct violation. A few years back many colleges and universities were sued for NOT following due process in Title IX cases so there is already a precedent for the universities who choose not to follow their own due process policies.

Bottom line: they messed around and found out! Besides that, the first amendment doesn't apply here because they were stupid enough to camp out in protest ON private property! By default, a college student is already expected to be adult enough to accept responsibility for your own consequences, so if they DIDN'T go into this fully aware and ready for that then oh well-sucks to be them-it's nobody's fault but their own for having weak convictions. Well this is great news, it is about time that people are held accountable for there actions & it is like Kevin O'leary stated this will come back to haunt these students and he is right and it is right now. Americans always thought they could do what ever they wanted without any consistences but that is now changing. And to add to this the student who do not graduate will still need to pay back there student loans as a Felon working at McDonald's (if they are lucky)

0:50 that lawyer seems kinda stupid. He claims that they haven’t been convicted of anything yet…………THAT’S WHAT THE COURTS ARE FOR. That’s what comes next. And you can’t “peacefully protest”after you’ve been told to leave their property

They were arrested for illegally building a camp and trespassing. People are entitled to the court’s presumption of innocence. They are not entitled to the university’s presumption of innocence.

Firstly, they do and enforce time, place, and manner restrictions on people exercising their First Amendment rights on school grounds. Second, violation of those policies can lead to a person forcibly removed from the area they’re trespassing. Third, depending on the contractual agreement the student made with the university, they can be expelled if certain threshold is met or with due process. It’s not a criminal court though. All the school needs to show in cases like this is that you knew about being warned and still did not follow through. Being arrested on the ground when you were told to vacate is pretty darn hard to talk your way out of it. And yes, shouting slogans that terrorist also shouts may constitute terrorist threats. Either way, you went from peaceful protestors into terrorist sympathizers shouting slogans not cover by the First Amendment.

If they're students living on campus, landlord - tenant laws are in effect. They can go to their residence unless ASU gets them evicted in court.
