It actually happened to me. When me and my friend were detained on the suspicion of burglary, even though we were acting in no suspicious way. I didn’t consent to a search, I was beaten with a baton when I tried to resist being searched because I literally had done nothing wrong. I got his badge number, his stations address and his name. I took him to court and got him fired for violation of my rights, harassment, causing me alarm and distress and abuse of his power.

These are good things to keep in mind. In this day and age, it's difficult to know exactly who to trust (I have major trust issues) but all police officers I've come into contact with have been respectful and such. I almost got "arrested" once I think, and yet I wasn't put into any danger nor was I actually touched by an officer.

The only time ive ever had to deal with a police officer was when i was younger and was supposed to be babysitting my little brother, i made him mad and he stormed off, i figured i would give him time to cool off, my older brother comes up and says that him and my parents were leaving and said nothing about my other brother going with them, a few minutes later i realize its to quiet, so I go and check on him, i realize hes not anywhere in the house or outside, i tell all of my neighbors that hes missing, and this was before I had a phone and our house phone broke, and i didnt know my dad's number and my mom was at a meeting, i call the police on my friends dad's phone and try to find a recent photo of my bro, my parents finally come home and im talking to the police, they freaked out and my mom ran out to figure out what was going on, i look over and see my brother hopping out of the car and was extremely relieved, i confronted my parents on not telling me that they were taking him and they said that they sent my older bro to come up and tell me, i spent around 2 hours looking for my brother because of miscommunication, thank you for taking your time and reading my story

You dont have to identify yourself unless you are suspected of a crime. If you are randomly stopped ask what crime you are suspected of, and if you are being detained. If you aren't being detained walk away. Also, probable cause doesn't allow the police to search your bag. There is an exception for your vehicle and anything in it, but any other search is illegal without consent.

Lol one time police came to my house and me and my mom were surprised. Apparently, someone had called 911. We honestly didn't think it a true cause my mom always talks to us about emergencies and 911 and stuff lots of times. So we checked all the phones, and o one it was still dialed. I hanged up, and since we didn't know who did we asked my brothers. My littler brother went all quite and then he started crying and we and the police officer spends 20 minutes trying to calm him down and everything. I was really funny cause he thought he was gonna go to jail! :)

The best question you can ask a police officer is "what is the name of the victim?" or "may I have the name of the victim please?" and just keep repeating these questions until the encounter is over. If there is no victim then there's is no crime.

No. Unless it involves national security, there is no reason for the name of the victim(s) to be classified and one of your Constitutional rights is to confront witnesses against you. This is why only a fool pays a ticket produced by a traffic camera because a camera can not be a witness. It is only partial evidence. This is also why only a foolish person pays a ticket produced by a police officer when there is no victim except for the person who is being extorted by law enforcement over a victimless crime.

I've been pulled over a couple of times for minor things. 1 such example was in Arkansas, I was pulled over for high beaming a cop. He pulled me over behind a Sonic restaurant and told me that the reason he stopped me was because I had my brights on at night. I apologized to the officer and stated that I had my high beams on the night before and must've forgotten that they were on. The officer was very professional and simply said that he believed my story and he let me off with a warning. He also asked me where I was going and I told him that I was on my way to Circle K to meet up with a friend of mine and he said ok have a good night

I have dealt with police for a variety of reason's, I've been stopped in road check's and for speeding. I was even stopped while driving a military vehicle the officer asked me to get out of the cab as it was a M35 transport truck, I informed him I was armed and got out with both a pistol and a FN rifle both of which I handed to him even though I didn't have to. If I get stopped for breaking the law then that's my fault and I can't blame anyone but myself, if I felt I was being wronged by the officer I will get their name and badge number and deal with it later. Arguing with the cop is not the right thing to do as they have the power at that moment, and anything you do at that time could go against you. Being respectful has gotten me out of lot's of tickets over the year's.

a lot of homeless have some kind of mental issues. I feel for some but not for others. because mc Donald's is always hiring. and you find a roommate in a news paper and keep finding better jobs. a good part of the homeless population could work. even if it's something they hate. they didn't become homeless over night. they were born went to school had chances.

Some police officers may take cash but you allways get a receipt and some have a credit card machine. You usually only need to pay in cash (or ATM) if you live outside the country or you are due to the police. (as the police officer need to do much more paperwork if he take cash, this isn't a standard police officer, it's usually the same person who you may pay in cash at the station)

I started laughing at the last question "what do I do if I need help from the police" because once my sister and I were out with this guy, we were being driven home when my sister started to become unresponsive (she was still conscious but she was acting and breathing weird and not answering any of our questions.) I had never seen her like this before and didn't know what was going on but she was getting progressively weirder. A cop just so happened to be driving buy when the guy we were with rolled down the window and waved down the cop. They pulled over and we told the cop what was going on he then called for help and an ambulance and fire truck showed up. The ambulance took her to the hospital to find out what was going on with her. Turns out she was having a severe panic attack she had had them before but didn't tell anyone (she even says she was aware of what we were saying and wanted to tell us she was fine and didn't need us to pull over the cops but she couldn't) so we didn't know not too. I just thought it was funny that we got to pull over a cop.

Rhiannon Rapplean Sounds good. I doubt they follow the rules they're supposed to all the time. Not everyone can afford the time and money and risk of retaliation of going to a lawyer would involve. Granted they can believe you really do have a lawyer, but most people don't and can't afford one, so cops are free to harrass lots of people without hearing about it through litigation. That's not an argument for answering their questions, just challenging your optimism.

Yes, over the years Ive had many dealings with the police (some good and some bad) Ive never been arrested because I always let them do what they wanted me to do. Some I thought were unfair but I said nothing. The most recent one was I was out walking and a black lady who was just being friendly stopped me to talk. I didnt know that I was in an all black neighborhood and at the corner the police stopped me and asked if I was buying drugs! I used to work nights and I walked to work. I was always being stopped for something (car burglaries, drugs, you name it!) It isnt always black men who are being stopped by the police!

An officer doesn't know whether you're a good guy or bad when they approach you. Remain still and follow instructions. They will tell you what they want and when to get it. No need to ask. I know it seems a bit odd to honest people, but police have people in cars pull guns all the time. The same reason police tell you to "stay in the car." They have to control the situation for their safety. Once they know you're not a threat they tend to calm down and their demeanore usually softens. Until that point, you're considered a threat until they know different.

Never give them your documents. The law in every US state only requires you present them for inspection. This is because of the 4th amendment, the state cannot require you to surrender your papers to law enforcement. If you voluntarily hand it over that's different. Only open your car window a couple of inches so you can hear them and hold your documents against the glass so they may inspect them. If they wish to stand on the side of the road and copy the information they are welcome to do so, but you can also put limits on how long you are willing to allow them to inspect the information since it's some effort to hold them there.

There is nothing wrong with that however often an officer will ask you where they are so when you move to get hem when requested, they are not surprised by your movement. They do the same when they stop other police off duty. If you are armed you are obliged to tell them, (same as a CCW holder), and they'll ask "where are your credentials or i.D.?" This is so when you reach they know what's going on. It's all about safety and courtesy. Stopping a vehicle is one of the most dangerous things an officer does.

I recognize it is not a requirement for CCW in all states, however even cops when stopped by the police identify the fact they are police and armed. It's just the smart thing to do, requirement or not. All the cops I know do it and that should tell you something if the police do it with fellow law enforcement officers.

Questions to consider: Q. If I were pulled over and wanted to write down the name and badge number of the officer, how would I do that without removing my hands from the wheel? Q. Couldn’t that act alone, (reaching for a pen & paper-even if I let the officer know what I was doing) be interpreted as a potential violent act? Q. And Even though I / we all have the right to ask for the officers info and have the right to write it down, how could I prove I had asked? Q. What if the officer claims I didn’t ask for that information? Q. Couldn’t I end up in more trouble because it would be the officers word against mine? Yes, It is our right to get that information, but I’m not so sure it how well it would be received by the officer or how willing the officer would be to accommodate such a request. Don’t get me wrong, I love and have the utmost respect for all the people who protect us and put their lives on the line everyday for us. They have a lot to deal with every day, and they are well trained, but they are also human beings not robots. They have the same feelings; fears, frustrations, family issues, work related issues as we all do. I think I’d pass on asking for that information unless, of course, it was absolutely necessary to do so. And even then, I’d make sure that there were witnesses (for both myself and officers). One additional question or FYI... Don’t regulations, policies, and procedures for local, state and federal law enforcement agencies differ? I am a former public school teacher and regulations, policies and procedures varied. All school regulations had to comply with Federal Regulations but the school district policies, the local and stare regulations could differ (as long as they included and complied with state and federal regulations).

Umm, yup! Im not proud of this but I have a very bad short term memory...which freezes under stress. First I’d have to find where I put my pen, and after I found it, chances are I would have forgotten what I needed it for. Then I would probably ask the officer why I needed my pen. And finally, at this point, I would not have a choice about having to get out of my car...Yup I’d be outside the car singing my Abc’s! Lol, lol!

No sir. In the US a peace officer is required to wear identifiable information on the uniform or provide it upon request. Most will give you their business card if you request in large departments as a matter of policy. In large departments they will introduce themselves when they approach you with their name and department number.

Because some courts have said that act is giving them consent to go into your car, essentially you give them the right to then go into your car. All you're doing is talking, the window only needs to be open enough to hear and be heard, and to pass your travel documents back and forth. Any more than that, you're essentially telling the cop they can search your car. And we all should know by now that not all officers are on the up and up so one searching your car may happen to "find" something that was never there before they "found" it and it can land you in jail. You MUST protect yourself from the cops

I was rear ended by an off duty police. The first person on the scene was an off duty police. Two other police came to the scene. I was knocked unconscious for over half an hour. The person who rear ended me refused treatment and was not given a breath-a-loser test. No pictures were taken and my wife was not called by any of the officers for two hours. After arriving at the hospital a nurse asked me if anyone called my wife. I did not know as I was in and out of consciousness. So she was the first to call more than two hours after the collision. My wife was very concerned she had called me several times with no answer. What do I do with this kind of police behavior?

Talk to a lawyer. And fight as hard as you can that's your life and your memory that those individuals just took from you . the whole system isn't bad but that isnt to say there arent bad people in the right job line . that's what happened to you ... Lucky for you a kind nurse made sure your wife was notified and if you could find that nurse and figure out around or even the exact time and gather all the information and names basically become a detective for a bit while working with you lawyer . Thats what you need to do . No one can replace those hours or fix the stress . only you can find the satisfaction in bringing the truth to light . So get to it man !

Why would they give him a pbt? If you were unconscious how do you know how much time passed? an accident and injuries ambulances come automatically. How far was the hospital? Did they have to cut you out of the car? Where was your phone? In the car or pocket? Do you have a passcode on your phone? When your wife calls does it say wife? Hipa laws prohibit telling people of injuries and treatment.

A routine traffic stop IS a form of detention. As such you are only required to produce your driver's license, registration and proof of insurance, if asked. Beyond that, you are not required to answer ANY questions. The police will tell you that they are just making conversation. DON'T BELIEVE THEM!!! They are fishing for information to use against you. You need to formally invoke your right to have an attorney present before any further questioning. And you need to formally invoke your right to remain silent. And then REMAIN SILENT! Don't say ANYTHING no matter how innocent the question may appear. Remaining silent means just that. SILENT!
