These law enforcers rely on us not knowing the law. If anything they need to be taught the law and not treat us as stupid. They would rather make it up as they go along in the pretense they know what they are doing. They believe the uniform gives them some sort of power over us, which is often abused.

You don't have to answer questions at all. If your in a situation like this, you asked if you are being detained and that you don't answer questions, and your not taking any paperwork. As simple as that! If they do take up your time you can charge a fee of what ever rate you want! Providing they agree to detain you.

People should start stopping officers on the street and getting their information. As citizens we do not have to provide identification unless we are being investigated for a crime. Officers of the Peace however DO have to provide identification for the purpose of investigating impersonators and simply because they are public servants. Imagine how they would like being stopped 5 times every day for the next few years. This has everything to do with corporate law. A corporation can not be imprisoned, therefore it can only be fined for all the bad things that they do. When BP destroyed the Gulf of Mexico a few years ago, were any people charged and convicted for the incident; No, all that happened was they got a large fine to pay. The same can rules can be applied to citizens. If a corporation has the rights of citizens, then the laws can not distinguish from either. If you represent your names, you are representing your person as a corporation so therefore our person can only be fined for our crimes as well. I am not sure about the full intricacies of how this works, but maybe a civil litigation lawyer can help fill in some of the blanks. I do believe you have to print your representative name in full capital letters on any documentations as well. Actors do this all the time with their pseudonyms. This is how LL COOL J can swear on national television, because he has a license under his representative name LL COOL J.

As a law student I can confirm that you are right and you were not legally obliged to provide the PCSO your personal details. Additionally, you obviously weren't 'in the act of committing an indictable offence' or 'guilt of an offence' and she didn't have 'reasonable grounds for suspecting you to be committing an indictable offence' or she would have the legal ground to arrest you (as specified under PACE section 24[a]). furthermore, you did the right thing to ask "am I being detained," then walking away. This video is a good example of exercising civil liberties.

Your comments s24A of PACE are spot on but the other bits are wrong - under the Police Reform Act 2002 you have to give your details for various reasons to a Constable when asked. And yes, the PCSO had the powers of a Constable in this instance and various others. You should know this as a law student of which I am totally taking your word for it as everyone on the internet is who they say they are.

Thinking about it.. I've come to the conclusion that law enforcement actually must admire the Gestapos tactics of running a police state. The reason I say that is because they actually employ those tactics on unsuspecting members of the public. How to deal with the police? PC: Can I have your details? You: Am I being detained? PC: No. You: No. Then walk away. or PC: Can I have your details. You: Am I being detained? PC: Yes. You are under arrest... You: I am enacting my right to silence. Keep mouth shut until they try to interview you and when they come to take you to the interview room enact your right under PACE to refuse the interview. Ultimately almost futile but boy do they hate it when people do that. Plus it wastes tonnes of police time.

mrkayo87 Firstly, why give your details if you're not being arrested? If they've no evidence that you've committed a crime why then should you have your details on permanent police record? It's a matter of principle. Secondly if you are arrested the police already presume you guilty so you may as well waste their time, especially if you actually are guilty. On top of that if you are suspected of something pathetically petty like a public order offence having evoked your legal right to silence (in this case I prefer the more accurate Americanism: the right not to incriminate oneself) and then refuse the interview there is a significant chance they will, having made you sit in a cell for hours on end, let you go. My identity and personal details are no business of anyone else, especially an organisation who's job it is to collect intelligence and maintain the government's status quo.

And if they don't keep your details "if your innocent" then why are their files full of details of law abiding activists, friends & families of criminals, witnesses of crimes, people who have filed complaints against them, etc, etc... much of which, like any "intelligence" can be presumed to be inaccurate? Every interaction you have with a police officer (save asking for directions or the time) they are obliged to make a record of. These notes are indexed and filed away and when and if need be can be used against you such as when you're obliged to make a Disclosure & Barring application before being offered a job. Unless you are being detained on suspicion of a properly defined crime their is no legal obligation whatsoever to give police your personal details. So why hand them over for the sake of getting to where you were going a couple of minutes earlier? I'd say enforcing my legal rights regarding my personal data and privacy when being harassed by someone who is trying it on and knows I'm not legally obliged to talk to them is easily worth a few minutes (or indeed hours) of my time.

PCSOs generally are less trained than officers when dealing with the law. They are told to do specific tasks and are not required to know the ins and outs of the legal system. Just as a person working at B&Q may be great at the diy stuff but then might get phased by a question about the tills

He didn't give really a good advice on to dealing with police. If you didn't commit any crime, you are not obliged to answer any questions, especially you don't have to give your personal details. This because once your details are on their system, they will keep recorded there forever. For what ?? as less information you give to police, better is for you. If the police needs information for an investigation, they would find them anyway.

they have no right to arrest or even speaking to you when filming in a public place if it was in a shoping centre or a store then you need permission of the council or head of store to flim inside also you should never answer questions unless detained as stated
