Mr. Kim, Thank you so much for this video. You made it so simple to understand. Seeing an example of a legal memo is so helpful, and they are not easy to find. Your notes and highlighting as you went along were also very helpful. I have been at a loss for how to write my legal memo for my paralegal class, and this will help me so much. Also, your voice and very kind and respectful tone are so encouraging. Thanks, again. You may have saved the day! :-)

Your video was so helpful. Thank you for taking the time to share your expertise. I am in a very compacted paralegal training program and at this point it's all a blur - IRACing, legal briefs & memoranda ...

Thank you so much, this was brilliantly explained. You have simplified IRAC for me, and just in time for my test tomorrow!

Dear Mr. Kim. Thank you for posting this video. I am a paralegal student in Ohio. I wish my instructor taught the way you do. This video has helped me understand IRAC, I did not fully understand it from the lecture my instructor gave on it. I will be subscribing to your channel. Thank you again. Best regards, Kristy D.

Here, like the defendant in Cohen v. Petty, Defendant Keegan was in good health at the time of the accident, and had never before fallen asleep while driving. Plaintiff Marino may argue that the present case is distinguishable because unlike in Cohen v. Petty, Keegan has a history of narcolepsy. Marino may argue, therefore, that Keegan should have known that he might suffer a narcoleptic episode while driving.

its very help helpful and very explained i have struggling with legal memorandum for long

This rule of law comes from Cohen v. Petty, in which the Court of Appeals of the District of Columbia held that a defendant whose passengers were injured in a car crash caused by the defendant’s sudden fainting was not chargeable with negligence when he had never fainted before and was in good health at the time of the accident. [cite].

In Washington, D.C., a driver who is suddenly stricken by an illness that renders it impossible for him to control the car, and which he had no reason to anticipate would occur while driving, is not chargeable with negligence. [cite].
@lrwprof11 жыл бұрын
The court reasoned that under those facts, the defendant did not know and had no reason to think that he might become ill while driving, and that he should therefore not be held responsible for the plaintiffs’ injuries. [cite].
@lrwprof11 жыл бұрын
But Keegan has successfully controlled his narcolepsy for the past several years with medication, and his last narcoleptic episode was over three years ago. Thus, he had no reason to think that he might suffer another narcoleptic episode on the day of the accident.

Hi Chase, here you go (one paragraph at a time): Under Washington, D.C. law, is Defendant Matt Keegan liable for Plaintiff Amy Marino’s injuries under a theory of negligence when he suddenly lost control of his car and crashed into a tree during a narcoleptic episode, but he has successfully controlled his narcolepsy with medication for the past several years, and his last narcoleptic episode was over three years ago?

A court will therefore likely rule that Keegan is not chargeable with negligence.

Dear Eugene, should we use "rule of law" lightly like that? Doesn't 'rule of law' simply mean that the law is above all? confused.. Great lecture anyway. should get me top marks!! **crosses fingers**

Thank you so much, Mr. Kim! You have helped me so much with this! I have been feeling so confused in class as everything is online. Watching this has simplified things enough for me to fully understand what I have unfortunately not learned in class. I start my internship next semester so I am so happy that I can now understand how to write a proper legal memo.
