The constitution gives complete authorization to ECP to conduct election until or unless written justification is not provided or the specific condition on the basis elections can be postponed. Anyhow, the decision of election date is to be decided by ECP with consultation with the President and SC can't impose any decision but only can direct the ECP to complete the process of elections. SC did not decide the date but agreed upon the date decided by ECP with consultation of the President of Pakistan i.e. Mr. Alvi.

I don't know how people justify Qazi actions. I have great respect for Ashir Azeem and he's someone who should be used for reforms as he is genius. Also, judgement is right as per constitution but the bench which they picked were against supreme court own procedures so its not right. Also, one party doesn't trust Qazi, he has conflict of interest as well. So it's not that simple. Qazi is wrong without a shadow of doubt. To PTI Qazi said that don't tell me about ballot boxes but show me notification. Now hes saying form 45 and 47 doesn't matter. Onlything matter is what's inside ballot box.

Nice, but timing of every case tells its intent. When Election comission was supposed to held election in 90 days as per constitution. Then what is your analysis? Election comission is executive body to do whatever is told by someone. Power is everything not the law.

Yes it doesn't say that it will not count but also vice versa... So use some common sense that such member gets de-seated the moment he gives false vote so how on earth would his vote be legal?? Though i agree with you on 2nd example of judicial overreach ( vote count). Elections act 2017 had been amended after elections, to include the provision which u specified. This was done to give ECP some leverage when it had started using stalling tactics to not form tribunals as said by LHC. Ur argument wud have been correct only if such provisions were already there in Elections act 2017. That illegitimate parliament who still has to prove his legitimate election victory can't create a self defense mechanism for itself. U should have mentioned that aspect too. Under normal circumstances i wud have agreed with ur points.

Sir, excellent vlog. I totally agree with your analysis. Being an ex Govt. servant , experienced all what you mentioned, suffered heavily, deprived of promotion (served 19, year in BPS 19 not promoted to 20) and finally had to lose my contract ( which I got after retirement). The reason was that I tried to clean up the septic tank to improve its efficiency.

Absolutely right. Ashir's analysis of the last case are the type of things he says that makes me think he is tunnel visioned. He only looks at things from operational perspective and loses the bigger picture. The case of analyzing Arshad Shareef's killing as a regular Naka mistakenly gone wrong was a big fat warning sign.

Sir,with due respect, its the timing of listening to a petition from chief justice of Pakistan that is questionable regarding 63A. Why is he listening to it just few days from his retirement? Why is he sitting in a bench when there is conflict of interest as this decision/ case suits him? Why was he in so hurry to wind up the case without allowing Ali zafar to argue? Most importantly this bench is unconstitutional as it is not formed by 3 judges...

All things you understand is misconception,there is no timing of hearing any case at any time in law ,second judge is judge till his retirement there is no restricting on him listen no case or what r other, thirdly it is two year old case with a constitutional impartance nature , decidesble early as as possible so Qazi took the stock of situation did right in the intrest of nation, 4 thly . as per constitution president can issue ordinance and rightly did and changed the committe fixing bench , that with majority of two members fixed the bench , how do say that bench was illegal.?

@@AbdulRaheem-tx2zo it is not about the majority among three judges regarding constituting a bench, as per my understanding they have to sit together and make a bench without the concept of minority/majority Secondly this is not a master stroke from JCP, its just watching an opportunity in his favour and with the help of "like minded bench" make a dicision in his favour. "Mein Apko context deta hun" se start ker k, apna poora analysis was out context diya hai. Context is, Jan 13th Judgement, Form 47 Rigging, Constitutional amendement to give Esa extension, kidnapping of PTI MNAs, Presidential Order to reconstitute SC Practice & Procedure committee. If you actually take the context into account then Qazi has clear conflict if interest. Even as per SC's own rules, if a Judge does not recuse himself, he cannot be replaced. Also an author judge if still serving, should be part of the bench hearing the appeal. So even purely as per the rules of proceedings 63A hearing was unlawful. I am sure you are not so naive to miss all this. So now this makes me suspect your intentions Mr Ashir.

Your analysis of Justice Isa's decision about Election Commissions decision is not only correct but also extremely honest. You can get a lot more views and make a lot of money by unduly favoring PTI.

@Freebird-p2i Brother you lack knowledge about review petition and formation of a review bench. Firstly review petition must have the same judges who originally heard the Petition or appeal unless retired. Since Ata Bandial and Ijaz ul Ahsan are retired, all the other judges are part of the Review petition who originally heard it. Muneeb Akhtar himself did not want to sit in the bench whereas his name is also in the bench. It is not the wish of PTI or Qazi Faez Esa who must be in the review petition, but it is what the law says.

@Freebird-p2i now this guy is saying 4 new members are included in the bench. Whereas only two members are new. If someone do not even know the facts of a matter and passing judgments and opinions on forums, do we even need to waste time arguing? Only Qazi Faez Esa and Aminuddin Khan are the new judges in the bench.

I appreciate your analysis and endorse it. The reason these people object Qazi Faiz is that he decides matters as per law and doesn't try to punish the government for being a product of flawed elections using his decision as a weapon, as this is mot what a justice supposed to do. I strongly believe that he is fulfilling his duty and deciding matters objectively disregarding who would benefit from it.
