The only possible way this would ever be acceptable in my mind is if the attorneys negotiated their own settlement separate from ours. And the Bellwether trial litigants were also separate from the 6 billion pool.

There’s no way they’re settling these cases for chump change without some sort of side deal already worked out. You don’t win landmark cases for over a million a piece and call $8333 reasonable.

3M can walk away at any time if there is not a 98% - 98%! - participation rate. 3M is unlikely to stick to that number. But goodness it is aggressive. For $8,333.33 (before fees and costs) you can probably settle your case as early as this year. 3M wants to pay this money out early because it really wants to bait plaintiffs to take the quick money to reduce the claim count. This is not the average settlement. People in the comments are getting this wrong. It is just for those who want to get out before submitting their records and such.

I do not understand how the lawyers can agree to a set amount of money? We were always told, this is not a class action. Everyone is getting paid based on their injuries. That was the purpose of the bellwether trials, for juries to decide our compensation. Not our lawyers agreeing to a limited amount of $6 billy and then doing the math to spread out that restricted amount. This is not what was told to us.

Question for Jeff or the community. I submitted documentation to my attorney from my ear nose and throat "ENT" I have severe bone growth in my right ear which would require surgery to fix. How is it that 3m was fighting tooth and nail against a settlement I wonder what changed? Some lawyers negotiated a very good deal for themselves not the vets for sure. The lowest verdict in the bellwether case was for a little over 1 million $ so how is it that they negotiated for so little. What happens years from now when our conditions get worse?

3M was going to have to try hundreds of thousands of cases all around the country and that was not sustainable. They also had the Aearo bankruptcy dismissed, and the appeals court decision on the talc cases eliminated the "Texas Two-Step" in bankruptcy. 3M had to accept reality.

That's down to economics. While 3M is a very profitable company, they don't have $16 billion in cash just lying around on pallets somewhere. The PFAS settlement of $10 billion factors into how these settlements are paid.
