I watched your three episodes, back to back. I love your style of teaching and engaging your audience. I am apsychologist and do forensic and immigration type of work for the past 25 years and I always focused on the individual, personalize my reports and that was the edge the attorneys used to fight the cases in court. Hi Dr. Fonte. Thanks for the kind words. It's good to know you're in the Florida area. Once in awhile, I get cases down there and more often than not, their problem is that they have not developed their cases strongly enough, including the absence of psychological examinations. I looked at your You Tube channel. You have some really good topics for clients to watch. Thank you so much for these videos, that you can find them anywhere , I came to USA in tourist visa and lied in the application that I’m married but I was not , I’m married us citizen I got I-130 approved, now I have second court date for removal, I don’t know what to do , Thank you again

Thanks sir Carlos for the very informative video on hardship waiver. I've been following your presentation regularly. My question this time is: what should anyone do if while awaiting the interview for the green card (being married to a US citizen), the couple divorced. Most likely the US citizen spouse will not come for the interview anymore. Is there any other way for the beneficiary to get a green card?? What should she do? Thanking you in advance.

@BataralmmigrationLaw I watched all your videos from Part 1 to 3. I hope you can help us about Extreme Hardship. Am I (Beneficiary) the one to fill up the FORM I-601 or my spouse (Petitioner)? The officer told us to make a Letter (EXTREME HARDSHIP) based on my RELIGIOUS BELIEFS. Is it okay to consider the Letter of our BRETHREN even they are just our closest friends and Letter from my spouse's relatives? Thank you so much!

Supporting letters, made under penalty or perjury, can be helpful - so long as the letters address pertinent issues. The waiver request is made by the immigrant, but the hardship issues should center on the U.S. citizen petitioner.

Hi Attorney! I wanna ask something. If you will be approved for your form I-601A and you are under J-1 visa when you came to US, then you overstayed your visa, once you get back to your country, will you be having an interview for your visa interview right away or you have to wait after 2 years to do the 2-year residency rule? Is this form I-601A that was approved within US has no expiration date? (Assuming you were already married to your US citizen spouse within US).

@@MrBarbietxtx It is in the FORM I-601 Instructions. As what I understand as a beneficiary? My husband will do the extreme hardship and relatives can help too. I am not sure yet if I will do my own letter also.

Do you think a spouse (who entered illegally) of a US citizen has any chance of avoiding departure and time bar, if the citizen has an average paying job, no kids or major medical problems and isn't drowning in debt?

Maybe, maybe not. On the surface, the situation sounds grim. But who knows? The person's situation needs to be explored in depth. Then and only then can one provide an evaluation of a person's chances to win a hardship waiver.
