@@feurigerStern true! I was hoping during one of these times he would have jumped on their table…..wonder how quickly the bailiffs would have responded.

Rights aren't absolute, they just happens to be law in that particular country. And I honestly think this law, which allows a suspect to question his victims is a big mistake. The right to represent oneself in criminal matters also isn't a great thing, but I generally don't mind because it only hurts themselves. But I do think they shouldn't be allowed to question victims and/or their close relatives. Ideally, as I see it, defenders should be forced to use an attorney if they went to question/cross victims, or be allowed by discretion of judges on a case by case basis.

@@gmimi2 I know. In US law. And I think it is a mistake. Some people, especially Americans, for some reason consider a constitution as some kind of immutable divine revelation, and not as a bunch of laws written and updated by a bunch of dudes over a span of several hundred years. Don't get me wrong, US Constitution has mostly good stuff there, but also a bunch of stuff, that I think is quite wrong. Like this one, for example.
@Hidakaku56
@Hidakaku56 Жыл бұрын
@@gmimi2 Actually you don't have a constitutional right to confront your accuser. Everyone in the United States has the right to "*be confronted with the witnesses against him*". If the accuser isn't a witness in the prosecution's case or if the defense doesn't call them separately, you don't actually have a right to confront them. There's quite a few times where the prosecution for one reason or another can't bring the victim of the crime into court and instead has to rely solely on witnesses of the crime or law enforcement that was able to piece together the crime scene, and those cases are still valid and legal because the defendant is allowed to confront the witnesses rather than the victim themselves. There was a case - I think it might've been like 10-15 years ago - where a guy committed a bunch of assaults over like two or three days and none of the victims (all prostitutes) were willing to come and testify and yet the trial went on because bystanders and law enforcement testified to what they knew. I'm pretty sure but not 100% that the guy tried to appeal citing that he didn't get to face the 'accuser' and the appeals court didn't accept his appeal at all on those grounds.

Maybe it's just me, but I think a case involving SA of any kind should automatically disqualify someone the ability to defend themselves. The trauma it inflicts on the victims and their families is just too severe.
