I agree sir I'm 90 percent now with 17 more claims waiting to see the judge 10 of them are 10-12 years old each by way of the effective dates

I am one of those Veterans who dropped my other claims after reaching 100% P&T. VA has not wanted to diagnosed my Asthma but continues to treat it. I’ve been thinking of filing a claim, but not wanting to rock the boat has been stopping me!

I would do it especially if your claim is ROCK SOLID!!! I've hearing that and also was told by me VSO but, where in the 38 CFR is that a written rule? I think it's a scare tactic and you would be cheating yourself out of possibly qualifying for special monthly compensation (SMC). I got two other claims awarded after reaching 100% P&T so I say GO FOR IT!!! Do your research and put in your claims!!!

Chris! This was my experience w DoD and VA and it’s a true horror story. I was AD for 8 but I think we’re judged for retirement the same way as R/NG. I receive my full ARMY pay rate, VA comp/disability and combat duty hazard pay rate for life, over $8k per month. I was PDRL’d in ‘08 bc I incurred two spinal fractures and a head wound. Add the fact that I have no cartilage in my knees, significant hearing loss, residual peripheral neuropathy and various other service-incurred conditions - that all led to a 100/100 rating across the board. I did not need 20 bc the cause of the chief complaint (spinal fractures and head wound) were incurred during my 3rd deployment (IED blast while we-125th ODA-were in convoy) bc we had 20-30 cub and military civ affairs and advisors we were escorting back to our OP. However, don’t think that life is hunky-dorey just bc you end up receiving $100k per year for life from the govt. Just bc it’s PDRL, don’t think they’re not going to keep tabs on you. After I completed my first PhD (Eastern languages, scope of my dissertation was on counter terrorism operations), fixed wing and rotary licenses, after about 6yrs, I started getting several calls to come into VA and the Army board of corrections wanted to re-evaluate me. It seems they thought I was ‘back in the game’ again. They even had an investigator pull up my dissertation on ProQuest and read my entire publication; lol, probably the only bastard, other than members of my committee, that read the thing cover-to-cover. They really wanted to know what I was up to. They interviewed my most recent 2 ex-wives, made credit inquiries, pulled banking statements for the past 10years. This was all in an attempt to relieve me of my primary source of income - my retirement pensions, or at least my qualifying concurrent receipt. Well, this went on in appeals court all the way to federal district court (that’s right before the USSC appellate, the highest court in the land). Their tactics were found unlawful but I could not sue them under a 1983 or any other procedure. I still get occasional calls and correspondences. Don’t think for a second just bc you have three bronze stars and two Purple Hearts for actions taken in war and wounds that you received that they are going to let you just walk scot-free with that lifetime money! Oh no, you will be monitored; and it’s a bitch!! My suggestion is to fly low, perhaps move to another country (I now have multiple residences). Because if you make too much noise, someone’s going to hear you. Look out for yourselves, your families and do what is in your and their best interest. Because when Uncle Sam decides you may not NEED that medical retirement money anymore - that money you almost died for - they’ll come for it, people. Be safe out there. Peace.

It amazes me what the VA/ Government does to veterans. Meanwhile civilians live an entire lifetime sucking free benefits from the government, section 8, link cards, medical benefits, etc how came veterans can’t get Section 8 benefits? I’ve seen people that live in better housing than I do, only paying below $100 per month for a 3 bedroom apartment wtf! It’s insane, let’s is not forget free utilities too! Discounted heat, gas, electricity, cable, etc. meanwhile those like us veterans don’t even come close to civilians.

Just won 100% P&T. The VA set my effective date to Oct 2015. The record supports an effective date of March 1997. There were also some "clerical errors" with my discharge... but between us, I think they did it on purpose. Regardless, we'll be appealing the effective date and we're looking into SMC now. Saw you in another video with Mr. Hill! Your videos have been great, and I thank you. Hill & Ponton have been my lawyers. They've been amazing!

Hi Chris, I just read a comment from HostileRespite about his 100% and his effective date was Oct 2015. The record was to be March 1997. When I received my 100% for CML bone marrow cancer in Jan 2014 the VA had my effective date as March 1st 2006 to Dec 2013 only giving me 8 years of back pay. When I filed my appeal in 2012 it stated I filed in Dec of 1994. Between that time and 2000 the VA kept denying me the benefit until I reopened my case in 2006. After it was approved in January 2014 the VA told me if I kept my case open from Dec of 1994 I could have gotten the other 11 years of back pay totaling 19 years of back pay. By the time I had found out about my other 11 years to file my appeal it was over one year and I couldn't get the other 11 years of back pay. Presently I just turned 65 and just filled a claim for Aid and Attendance in January 2024. If the VA does grant me this benefit will my effective date for this be the same as March 1st 2006 or the date I turned in my application (January 23, 2024)?

Great info. I'm #6. VSO told my husband since he was getting 100% PTSD, don't continue claim for Cancer. When he died 6 mos later from cancer, all benefits stopped. My last year and a 1/2, since he died, I've spent fighting VA to have his cancer cause of death rated service- connect so I can get DIC. Can't get DIC for PTSD unless Veteran diagnosed 10 yrs prior, died from alcoholism or suicide. VSO didn't disclose any of this when my husband had the chance to continue his claim.

I had a TBI rated at 80% IU rated 100 PT and I told a DAV service that I should be rated higher he told me leave it alone your already getting paid at 100% permanent and total and you don’t want these guys reducing you. I have been at this rating since 2002 and my age is 53

I served in the Army from Feb. 1960 to Feb.1963. I got an honorary discharge. While in the Army I did nothing but have earphones on, listening to radio signals for over two years.. Now I have a 24/7 ringing in my ears. I believe this condition is service related. Can I get compensation for this disability?

If I already am 100% P&T *combined*. I have Congestive Heart Failure with Internal Cardiac Defribilator(This alone should be a 100%, but it is not service-connected yet). CHF is secondary to my service-Connected APNEA... Should I file and pursue a claim even though I am already 100%P&T? Also, Asthma is now a PACT presumptive condition that was denied back in 2008 under Gulf War Syndrome... Should I re-file for it?

Thank you for this video. My father also died from a service connected condition sustained ALSO during the Battle of the Bulge. This advise is critical to the welfare of the surviving spouse, though sadly the information is rarely provided at the service member's time of death. In our case, the VSO refused to submit the claim because they didn't understand the medical terminology used on the death certificate vs. that which was maintained in the service member's records (they didn't match). Had the widow followed the advice of the VSO, the claim would never have been submitted. Often, and particularly with non-military relatives, they don't know what questions to ask or (more importantly) when to push. I'm so grateful to your VLOG for ensuring this information is made available.

I'm 100% P&T however in California you need to have physical mobility issues to get disabled veterans plates . So my case my physical disabilities were in the appeal status. So even though I'm 100% with PTSD ,gerd and migraines I don't qualify for plates even though I use aids to walk ..just another reason to continue to fight for your benefits

I had applied for Tdiu and finally received it but the reduced and even eliminated my ratings on 2 issues. They did this without evaluation . When I called them they said I have to file an appeal. I got frustrated and said it didn't make a difference. But I am in fear of them one day reducing my benefits. ??

When I became a Marine in 1955 I was a non smoker, when in the field I was given C rations that had 6 cigarettes (Lucky Strikes or Camel), I quit in 1985, now I have trouble breathing and they put me on Oxygen. Since they started me smoking and now blame the fact that I smoked for my problem, can I put in a claim?

This information is really helpful and appreciated. looking at ebenefits and totaling up my disabilities it looks like I have 100% but still states 90%. 2 of the disabilities are deferred, one is for a heart issue & the other is for Sleep Apnea. The VA is sending me a letter, I assume something is up.

I have been fighting the VA for almost ten years to adjust my condition. Considering that the Soc. Sec. rated me at 100% in 2006, I then applied to adjust my 60%- paid out at 50% my conditions were not recognized at the time of discharge, even though I mentioned it to them, which is in a VA report, anyway, they keep giving me the denied stamp, I have been to VA scheduled doctors, and actually am being treated for some of the disabilities, they still give me the denied stamp. Help!

Can vets get Va disability rating for mercury toxicity from amalgam fillings? I have 8 that they put in at boot camp 13yrs ago and I have nearly all symptoms of toxicity listed in the NIH study concerning dental Amalgams and the Navy refuses to remove them for me. I have significant memory issues on record for 8yrs now, chronic muscle spasms since 2007, sleeplessness, poor concentration, agitation/generalized anxiety disorder, I just recently found the link to Mercury in amalgams. I cannot believe they refused to remove them even if I showed them a blood toxicity report. It would cost me big $$$ to have them removed and replaced on the civilian side. So far I haven’t been able to find anything about anyone winning a claim like this. If anyone has suggestions please leave a comment. Thanks 🙏

Thank you so much for the information because I am 100 % but still trying to claim other issues but the majority of vso and organizations I have talked with always question me as to why since I am already at 100% which irritates me to no end. It seems like mores of these VSO's and organizations put more effort into challenging us than helping us. I just received a BVA denial and looking for an attorney or law group to appeal it. I had a total knee replacement on my service connected right knee the Va gave me a temp 100% for one year then dropped my rating to 30%. Can I still fight for the 100% rating because the knee is still not right and It's study swelling on me?

Go to your CVSO today, and create an intent to file, file the form for IU (individual unemployability) because of your knee, gather any new paper work pertaining to your disability, show pay stubs showing your loosing work, talk about how it’s effecting your daily life, did you stop working, did you have more depression because you were limited, did you earn below poverty level income? Those will be some factors. If you intent to file today, you have one full year to then go out and gather all these bits of information, you will give any non va provider paper work you think will help your case and to your CVSO to submit into your intent to file. Once you feel ready to submit your “intent to file”, anytime before your one year is up, tell your CVSO your ready to file your “initial” claim. This earns you possible back pay so if you hit 100%, it started to acquire now, and it gave you time to work on your case. I did this and they denied my claim at first. I didn’t stop, I immediately sent back a notice of appeal, with no plan. I wrote a personal letter back to the VA, with facts, figures and numbers, pay stubs showing I was earning under poverty, added evidence to the point they couldn’t justify not giving me 100%. And I did need it and do need it. Pain has no schedule, and time waits for no man. The everyday scheduled life does not coordinate with how I feel by even the minutes of the day.

+Khuong “Li” Hoang - the terms are very different, but could mean the same thing. 100% Schedular has to do with whether your %'age is based on the Impairment Rating Table. The term "permanent and total" can mean a lot of different things in the VA claims context.

Chris I currently have a tinitis rating and a hearing loss rating for each ear. I'm currently fighting for my back. I sustained a back injury while in the Marine Corps. It's in my medical records. I'm doing the appeals process now. I am limited due to my back injury/surgery as to what I can do physically. I have put on weight through age and my physical limitations. The VA determined that I now have sleep apnea. A condition I feel is at least somewhat due to my limitations. In your opinion should I persue a rating for this?

I'm currently trying to get service connection for a bleeding disorder. I was diagnosed with hemophilia a when I was in the army. Hi. I’m 70% tdiu for ptsd. I was reading that if I file another claim and I win, then my effective date starts all over to the new date. Is that correct. Also how do they rate hypertension if you take meds to keep it right most of the time. I was just told not to rock the boat about a month ago by a service officer at the Dav . Is that a term all of them use ? I currently receive 100% permanent and total . But I have other issues that need to be addressed. Should I consult an attorney or go it by myself ?

Some VSO are complete garbage and do not do anything that they say they will. They only exist to get government grants. The American Legion said they would automatically file an appeal when I signed up with them for representation only to tell me they have no record of me asking for their services when the claim was denied and it was time to file an appeal,

I have been rated 100%P&T for Asthma. I quit work after 2 months after 1 retro and 2 full payments. I then get a call from my VSO about 3 months after quitting work telling me the VA made an error and now want to take my 100% P&T away!!! My Asthma is BAD. WHAT DO I DO to keep my Rating?? I am now in a holding pattern waiting to have a decision made.

Curious, is VA Claims Insider a good service to have? They're not VA approved nor are VSO, but they do charge some fees, that I find a bit questionable but they claim to assist you more than a VSO, or any service rep. However, VSO are free. But with that being said, I've experienced terrible service from VSO's so I don't know what to do...

I received 100% rating and the effective date was for the time that actual appeal started. My question is I filed a claim 5 years prior and was denied. If I appeal my effective date could they take away my 100% total and permanent?

So I had my paper work submitted by a va law group name gustad. After about 5 years they notified me that he recieved some details about my appeal for increase saying that we won and it's being finalized. Also gave details saying I'm still employable getting full PTSD and 40 for my sciatica. Says the va are going back to 2016 and should keep a eye out for paper work or money in the direct deposit account. Idk how to feel but is it normal for attorneys to notify u before the case is finalized?

I would assume yes. Prior to receiving any notifications in the mailbox, if you were to log into and create your Ebenefits accounts through the VA, this site would actually show you case results and sometimes further information about your case(s). Ebenefits page will also track any current claims or appeals you may have.

Hi Chris, I've just been awarded a 100% disability rating which is not based on TDIU. My rating is based on service connected disabilities. Is there any chance of me possibly losing my 100% rating in near or distant future??

Ron Burgess Sorry about your misfortune. But it is very important for everyone to make sure they're mailing address is correct so they won't have to face what you're going through. Those reevaluation appointments are very important I had a friend miss his and his disability rating went from 100 to 30 percent. Fortunately I am considered P&T which is Permanently and Totally disabled. That assures me that I will never be reevaluated again because my disabilities are irreversible. Good Luck to you brother.

YellaBoi Thank you. Yes it is very important. I would have thought i would have received something in the mail with a change of address and was aware of the situation. I wasn't :/ they are telling me "reconsideration" and I have made my reevaluation appointment. I just hope and pray something happens soon.

Ron Burgess Oh ok, then you'll be fine bro. Once they reevaluate you then you'll go back to 100 percent. Just know that everything just takes time with the VA. The VA isn't out to burn you so as long as your disabilities hasn't improved then you're good to go. Also be very thankful that they're giving you an opportunity to fix this issue. Most people don't get that opportunity.

Static means you have a permanent condition. Most time you will find on your code rating sheet that a rating decision is derived from saying "no future exams". This would be the VA way of saying you are "total and permanent".

Disabled Veteran’s Response and Complete Account of where I (Terry Johnson) was Kicked Off of USAir Flight This letter is in response to the video placed on KZbin in which I ( Terry Johnson) am the subject. The video can be found on KZbin under the heading of, “Disabled Veteran Kicked Off USAir Flight.” I felt the need to explain the complete story that was not conveyed by the video. I purchased the round trip tickets through Sun Travel out of El Paso Texas for bulkhead window seating three months in advance. I let the travel agency know I was traveling with a service dog. They indicated they would let US Air know. Keep in mind, I had traveled all over with Bear, my service dog. This was the final leg of the return trip-and the only time I had any problem. On one of the legs of my journey the US Air Flight Attendant asked if she could take a picture of Bear up in the seat with me. I said yes. What you see is that picture. Since my beloved Bear has passed, I have used this photograph as my online picture. Keep in mind, that Bear’s place was on the floor in the front bulkhead but he was relocated to take the picture. The purchase of the bulkhead seating negated the need to purchase an additional seat for my service dog. The problem arose when my prepaid bulkhead window seat was given to a USAir employee. I asked the stewardess to remove the man from my assigned seat, but she refused. The air stewardess instructed me to move to an aisle seat. However, my service dog encroached six inches into the aisle. Next, the stewardess offered to have my service dog and I move to the two empty seats four rows back. I therefore felt in order to protect my dog's life, I placed him in the seat beside me. There was not a doubt in my mind that my service dog would not be able to fit on the floor safely. It was at that point that the stewardess said the dog cannot sit in the seat. If I'd been allowed to be in the seat that I had actually purchased, this situation would not have occurred. My dog was too large to safely lay on the floor as the space was just too small. The flight attendant told me that it was against the law for a dog to sit in the seat of an airplane. There is no such law. This is at the point where other passengers started videotaping the incident where I was fighting for my dogs life. There was a Veteran who supported me with applause, and another Veteran whom I am sure would have clapped but he had only one hand. You never see this support on the video clip. I checked in with the airline well over an hour early. USAir knew I was there with my dog and knew in advance the special situation which brought up the need for my buying the bulkhead seating. USAir did not follow Department of Transportation (DOT) Regulations and remove the man from the seat that I had purchased. The following will help explain how I believe my rights were violated: Seating Accommodations (The Airline knew I was flying with a service dog and they should not have ordered me to give up my advanced purchased seating). Complaints and Enforcement Procedures (I have repeatedly complained to DOT and nothing has been done). I even have taped conversations with some of these federal agencies. I was arrested and removed from the plane. During this time I was totally separated from my service dog. This was unacceptable as the whole point of a service animal is to be beside the person's side at all times. The judge dismissed the charges brought against me by USAir. I committed no crime, yet I am being treated as if I did by USAir, DOT and ACAA. Ron Hope, Commander of the Disabled American Veterans (DAV) at that time wrote a well written letter to USAir and they have not responded. The current DAV leadership has not offered to help what so ever, follow up on the outgoing commanders letter of concern about how I and other Veterans were being treated by this Airline. I want an apology from USAir, DOT and the ACAA. All anyone knows is what they have seen on KZbin and this is the part of me arguing to protect my dog's life. They do not see the reason for the confrontation which was the US Air employee taking up my assigned seating or the fact that the charges were dismissed. I have all of my receipts and documents of proving the purchase of the bulkhead seating. Any pro bono or contingency legal help is appreciated or any other help getting my side of the story out. I got hit with an ax over the head during a robbery happened in 1989 with 6 weeks left in the Army.I got discharged they told me go to the VA They gave me a 30% rating Tinnitus and Facial paralysis Than a year later they take the Paralysis away. Than in 1999 A Dr at the VA told me they shafted me so he got me 50% Ptsd so I was 60% than he sent me to his Neurologist friend I than got 20% SeizureDisorder my Vertigo went to 30% my tinnitus10% than my Facial paralysis’s was added again for a total 120% but their rating was 80 % Like you said they called me And said drop your appeals and we will rate you at 100% Tdiu Permanent and Total . This happened in 2003 and they back dated to 2002 . VA rep told I should have been retired by the Military in 1989 but in these years they have had me do CP 3 times already I’m 53 already with 17 years with this rating.
