Almost 99% of hip-hop is music that is sampled. More than 2/3 of every hip-hop song recorded most likely have samples that weren’t even paid for. (James, brown, George Clinton, and Nyles Rogers should be multi billionaires with the music that was taken from them and used to launch peoples careers.)

There’s an interesting interview with Bob James where he’s listening to hip hop tracks that sampled him and talking about how he got paid nothing as he didn’t find out until too much time had passed.

I think they knew the track would get a lot of airplay and give them exposure, which it did. It was a just a way of getting more people aware of them.

@@DJFurio it would be different if they used the whole instrumental, like artist who makes a mix tapes solely for promotional use but not when you took a lot of time to make a beat, with other samples and released a video for it. Now you’re just taking losses. This is a Wild story.

Samples should be chopped, remixed on a pad, sound modified in pitch or distortions.. I hate when I find out huge songs literally took a sample from the song with NO SIGNIFICANT changes to the original… like literally put the dang song in their song. Crazy lol

Yeah it’s just stupid trying to claim copyright on that. I know in the recent Ed Sheeran case, he took a guitar into court to prove that certain chords and phrases were so common in several tracks that they couldn’t be copyrighted.

For the record (pun intended), The Turtles' "You Showed Me" would be sampled a lot after De La Soul (Supreme Beings Of Leisure's "Never The Same" being my fave, but you also have U2, Maverick Sabre, Jurassic 5, Farolfi feat Corrina Joseph and so on...). Sad that De La had to pay that much, especially for a skit...

8:31 MISINFORMATION - It wasn’t Luke that tried to sue 50 Cent for the “birthday” interpolation. It was Luke’s former manager Joseph Weinberger, who owns the rights to Luke’s catalog from the Luke Records label. Even Luke publicly stated that he had nothing to do with the case.

This was always tough being a fan of Cam and Diplomats. In my opinion they had so many uncleared samples that never transitioned from mixtape to singles/albums because the samples wouldn’t get cleared. Diamonds and Pearls and You Oughta Know would’ve been crazy singles if Prince and Billy Joel played those samples. Diamond & Pearls was supposed to be a single on Purple Haze but the Prince and/or his camp never cleared it (think I read that Prince wouldn’t sign off if the artist requesting it didn’t own their own publishing). Dipset mixtapes had Billy Joel, Styx (think they sampled Castle Walls from Styx at least three times), Journey, Kim Wilde, Frankie Valli, Queen, Sam Cooke, Sting/The Police, etc. And if that’s not even touching on the movies, tv shows and videogame samples that they had. JR Writer rapped over something from the Soul Calibur and Killer Instinct games. And Cam rapped on Sephiroth’s theme from Final Fantasy VII (😂😂). Shouts out to the producers they kept around. It wasn’t just Heatmakerz, Ye and Just Blaze. To this day they’ve had some of the most obscure samples I’ve ever heard in rap

Mix tapes are given away for free which by U.S. law you can use samples as long as you don't profit from them unless agreements have been made to profit..

Towards the end of the vid did Biggie's estate mean to say "non consequential..?" Or else what do you make of the term "non sequential...?" Does it mean the notes in question had been resequenced..? As always, thanks again for another great video.

They did mean non sequential. They mean not in sequence so they weren’t one after the other. Basically 2 different notes were sampled but from different parts of the track. Thanks for watching as always.

Why does it seem that the legal system doesn't understand what hip-hop is? It's about cutting and looping the parts of your favorite songs and then rapping over the newly constructed mix/track. It's a remix of old songs with new lyrics effectively changing the original songs sound and meaning creating something different but recognizably similar (like electric guitar, songs are similar due to the instrument and how music is composed but each recording/performance is unique). I feel it's no different than movies/tv/KZbin that use the same sound samples (say the scream from the movie "the birds") over and over, some times it's so bad I feel like they could just sample a Marlon Brando line and have a modern actor just lip sync the words.

Artists don't like it when a song that samples their song does better than the original song itself. Its a combination of jealousy and not understanding what the art of sampling is. I love videos like this, but I *hate* stories like these, because it just further hammers the point that the artists who sue just want money.

How does clearing samples for a cappella/acoustic covers of songs work? For an example, I’ve found several great covers on KZbin. I received the MP3 files, chopped and made my own beat using the sounds of the cover. Do I have to clear the sample with the original artists or just the KZbin cover?

It depends if the KZbin covers have cleared the sample and you are sampling directly from that cover. They may have done this, which means you would need to clear it directly with them. If they haven’t cleared the sample, then you would need to clear the use of it with whoever owns the publishing rights of the original song. Depends what you’re using it for and if you are releasing the music or not.

Musicians who sue samplers are garbage. "Theft." Real theft actually reduces the amount of property, money, or future income that you have. Sampling literally gives the original artist more exposure and more money.

You welcome mane! Rappers get sued all the time for stealing other musicians’ work. It should be more on the producer than the artist itself. I remember MC Hammer got sued for stealing Rick James beat. Vanilla Ice got sued by Queen for stealing their bassline for his song Ice Ice Baby.

Yes but they won the case on a technicality. Only 2 of the 3 members of the band Trouble Funk that they sampled had signed a deal with the company that bought their rights and the judge said they needed all 3 members to bring a case.

@9:12 aren't all sample's comprised of individual common sounds? Like a drum kick is very very common in any song, just like "it's your birthday" is on your birthday. Also doesn't the "amen break" have nearly every drum kick ever all in one solo? How could anyone else have any similar drum kick after that song? It just seems the laws are twisted to protect the rich originators more than the broke innovators.

Definitely. I think some of the time back then they didn’t even ask what samples had been used. Or thought they were so obscure they would never have any issues using them.

If it’s a direct sample, then whoever owns the publishing rights to the original track. Not always the original artist as Michael Jackson bought the entire Beatles back catalogue and owned all their publishing rights. If you want to replay the melody, then it’s whoever wrote the original track that needs to agree to it.

It depends. The rights to a song as a composition can be different than the rights to a specific recording. For example when Eric Prydz wanted to sample the song Valerie for his track Call on Me he actually got Steve Winwood to re-record parts of the song because Winwood doesn’t own the recording rights but owns the songwriting ones. You have to figure out who owns both the publishing and who owns the songwriting and get their permission.

To the producers and beat makers that sampling songs here's a simple advice. Before you use somebody's record you must have clearance. Wheater if is songwriters, publishers or the artist themselves, Because many songwriters are not too thrilled of hearing thier songs from a Rapper and some R&B artists

@@DJFurio yeah I tried to find it yesterday, it’s more of a modern one and he’s working as a renovator on a property that he’s flipping. He starts talking about the law suit and how he ended up buying the Queen song. If he’s lying it would make an interesting case as he seemed very genuine about it. I’ll keep looking for it.

@@DJFurio so in the end queen and vanilla ice settled and shared the publishing rights, he lied in interviews saying that he bought the sole rights to under pressure, that’s just not true. There is a misleading story out last year based on the Patrick interview how he bought under pressure, then a spokesperson for Queen came out and said it was inaccurate and the publishing rights were shared. The law suit went for a long time.

To think about that's crazy to begin with. Queen's melody is not even a melody, it's basically one note repeating itself with added low note at the end. Every child can come up with this. It's like have a patent for Am-Dm chord progression.

So I think what they meant was that they sampled the end of the track, but 2 different parts. They then changed the pitch of the parts they sampled to significantly change it from the original recording. Similar to what Mobb Deep did with the piano sample in Shook Ones Part II and this was classed as Fair Use. If a sample has been manipulated so much that it’s almost impossible to link the 2 tracks together, it’s easy to argue that there’s no financial loss to the copyright holder.

@@DJFurio people just greedy af, 4 orchestral shots… millions of songs out there sound the same… luckily, it’s easy nowadays to create your own realistic sounding loops with kontakt libraries and such, back then it was more difficult and folks would need a team of musicians just for 10 second loop, I can see why folks just sample

This song came out in the late 2000’s, but Lil Flip - Game Over, was a huge lawsuit with Atari. They sued after the song was already platinum and was a obvious ripoff of Pac-Man. It was huge hit at the time.

You will never convince me for even a second that by adding 1 single note he’s changed this sample in any significant way. Even friends of his laugh at him for that crazy interview he gave at the time. Check what Havoc from Mobb Deep does with his piano samples. Then we can talk about how to change samples from the original.
