Locane's original sentence was way to low. 3 years isn't enough for recklessly taken someone's life. She got upset she had to go back to prison. Our judicial system needs to be reworked. Judges shouldn't have the authority to give 2 people who commit the same crime different sentences. The sentences should be standard across the board.

If you mean Amy Lacone, the "wording" is "kinda elusive". What really happened is, that a week after the sentence, the state appealed. The "problem" is that the appeal took 3 years to reach a conclusion.

I don't really have a problem with Amy Locane's resentencing. The initial sentence WAS most certainly too lean. And how she comported herself after she was released from the original prison stay should have no weight. Yes, prison is supposed to be about rehabilitation, but it's also about paying the price for your crime, and she didn't pay enough. That's not her fault, but she still didn't pay enough.

Double Jeopardy is very much still around, it is enshrined in the Fifth Amendment of the Constitution. Amy's case was a unique one, it was determined by the New Jersey Supreme Court that the lower court did not properly sentence her, they tossed the case back down for resentencing. Double jeopardy prevents a person from being retried twice for the same offense, Amy was not retried, only resentenced.
