When I’ve sold things online and at the meet up I always tell the person to open it and to make sure they are happy with it. I don’t want anyone bothering me after telling me something is broke or missing.

I assume once the plaintiff complained and likely sent picture proof of the damages, the seller used those to make a claim with the moving company. Then kept the settlement instead of offering it to the plaintiff, which may have satisfied her and kept this out of court. 🤷🏽♀️

I think the plaintiff should have also been awarded the amount that she spent on the u-haul truck/gas. She spent money to pick up a bedroom set that she was told had no damages (she definitely should’ve inspected the furniture herself!) which turned out to be untrue . Now she will need to rent a U-haul a second time to purchase a different bedroom set. Also, if the defendant ends up abandoning her damaged furniture at the plaintiff’s home (which I think is fairly likely to happen) the plaintiff will be the one who has to deal with getting rid of it. If she has to take it to the dump or Goodwill she’ll need to rent yet another truck to transport it, not to mention the dump charges. If the defendant doesn’t pick it up I hope the plaintiff finds someone to give it away to who will pick it up themselves.

But ones in big cities often don't have the time to review the cases ahead of time. I have 2 relatives that are judges, the one from a small town will go over his cases ahead of time, while the one who is in NYC doesn't have time to do this. Why do you think that Judge Judy always seems to have her mind made up as soon as she starts a case? Once in awhile a litigant will add something during testimony that wasn't included in the papers submitted ahead of time and then changes her mind and attitude, but most of the time you can tell from her attitude towards either the plaintiff or defendant which way she's leaning, from the paperwork submitted beforehand. But in this case things were being said that really weren't pertinent to the case.

If she had reviewed the case so well then why question the litigants at all? Just review the case and be done with it. Reviewing the case doesn't provide you with all the answers you need. Have you ever gone on The People's Court website? The information and/or evidence that's submitted to open your case is very minimal. Most information and/or evidence is not collected at that point. And you do realize that much of that information is false or misleading, right? Usually one party is lying in a civil suit (obviously), which is also reflected in the complaint and defendant's answer to the complaint and should only be taken at face value. But besides all of that...it's pointless to ask a question and not wait for an answer over and over again.

Terms and conditions have no bearing on a not as described dispute. This is part of the rules that govern any credit card purchase. Facebook's platform requires payment via credit card so the credit card rules govern the purchase. This is why it is extremely important to never sign anything saying it was received in satisfactory condition when the delivery is completed.

The defendant was definitely trying to get over. If she kept the plaintiff’s $600 and pocketed the $400 from the moving company- she basically made $1k (or a little over) and even if she had given her a little money back- she still would have made more than what she was selling it for. PayPal definitely charges a fee to send money to another person. They usually don't charge when you make a purchase from a store. Or, if they do, the seller absorbs the fees by adding the percentage into their sale price...

If the respondent didn’t look at the bedroom set and unwrapped it to see damage then how could she have made a claim for damage and gotten paid for damage if she didn’t unwrap it and see that there was damage. She’s a liar from what I can tell

Well the judge yells at her for not opening the package up. If you buy it in a store you can’t open it up either. You see a display model and purchase one in a box. Guess the judge never bought anything at a store before.

I don't buy USED anything. Call me crazy, but I would rather spend more money for new stuff and have guarantees, warranties, and be able to return it if something goes wrong.

If I happened to buy something 2nd hand I check thoroughly whether it a pawn shop or private citizens usually I buy brand new I like warranties

I've purchased and sold on FB marketplace and always note the damages and send pictures taken the same day as the post. Plus I always ask about damages in writing. This lady is a snake and isn't showing any remorse at all. Cleary she didn't care

Seems more like a basic ‘as-is’ sale case when the buyer didn’t inspect the item. I don’t think I’d consider ‘no damage’ as a specific warranty. To me that’s like a car sale saying ‘runs and drives perfect’ but that isn’t a specific warranty.

It sounded like Milan wasn'tt going to give her the cost of the truck or the gas, because "you had to spend that anyway," then it sounded like she gave her credit for that, at the very end. Anyway, these defendants who aren't surprised or angry after they lose, are just happy-- they "outsmart" others & get their faces on TV.... they're psycho!!

I always tell the truth and show pictures of any damage when I sell something. I'd rather tell the truth than have them complain afterwards.

A lot of people do list "scratches and minor damages" on stuff when selling used, But some people do scam and wont be honest lol.

At first i felt the seller was a victim as well but did you notice everytime near the end when JM was getting to the verdict she kept smirking...kinda let me think she knew damn good and well it was tore up....she was laughing as they drove off for sure!!

So...what I got out of this case..is that if you eat food you're gambling with your life and sanity...can food make you bad? Well..if its a matter of fact..yes. if the food is bad..but if the food is good and it's bad for you..then what's good? Or..why is it bad? Thus we have started in and went out..unsatisfied and exhausted or..complicit and open to solicitation or advice..but be warned..the spin of discernment differs from the sobriety of judgement. Those who soberly do not eat..for the sake of the self...are untainted...or..uninvolved with the case and process and verdict..those who do not eat..are untainted...are also..uninvited to the table...it is often true wisdom will not be derived from a resource without sources...good and evil..or bad..in this case...are not a part of the metabolism of the pure and untainted..but purification may be another product of another food...be not drunk with wine..but be cleansed..and healthy..and renewed. It is not wise to renew that which is suffering and goes unto suffering. Nor is it wise to age that which does not renew.. nor to renew that which has not aged nor multiplied...then what is it? To be..or not to be...if indeed that is the question...the answer will undoubtedly be a reckoning. What is death without a spirit. What is life with death in its heart and a mind of work? Is it a service...or a failure to connect to the server? Who has established these congruencies..technologies..but in that they have divided but a child from life..from its mother..from the breast..from the father's will and work and word and wisdom...even if he must suffer..suffering will secure him wisdom..and mercy..and grace...but if he is made new..redeemed..aged...increased..multiplied..suffered with abundance and destruction and desolation come to his work and wisdom...what is it then? Who has witnessed his ways? Abandonment. Recovery. Absolution. Ruins. Some things are not of the court designed...but of the land..and its laws...if any man remain..let him hold fast to whatever standard is righteous. If he should be cut down he is not alone. The truth will prevail..and if any house remains...he has his word. This will not serve him. He will serve it as he serves himself. 😉 The truth has been told. It serves the people. (Of course you realize...you have not heard the truth...and have not obeyed the law.)

Movers generally only give you a few days to be able to make a claim, so she DID know about the damage. Also, how would she have taken the photos to put in the advert, if she hadn't unwrapped them? She is a scam artist and knew that by having the woman come by when it was dark AND the stuff already wrapped, she could pull a fast one. And even in good condition, that stuff was NOT worth $600...

I kind of felt bad for the friend of the plaintiff. She easily could have said "he's a friend of mine" when the judge asked who he was. Instead she chose "oh he's just a friend" and it kinda sounded derogatory. He showed up to support her and his thanks was a rude comment directed towards him.
