When I’ve sold things online and at the meet up I always tell the person to open it and to make sure they are happy with it. I don’t want anyone bothering me after telling me something is broke or missing.

So if the original owner claims she didn’t wrap the furniture, the movers did…implying that she had no clue it was damaged, then how is it that she put a claim in with the movers for damages and they gave her $470? Can’t have it both ways, lady! She’s a liar and a scam artist!

Maybe after the plaintiff started complaining about damages, she filed and got that money. Then offered plaintiff $200 from the money she got from the storage company. Maybe.

I assume once the plaintiff complained and likely sent picture proof of the damages, the seller used those to make a claim with the moving company. Then kept the settlement instead of offering it to the plaintiff, which may have satisfied her and kept this out of court. 🤷🏽‍♀️

Reminds me of when I drove a few hours to buy a pc, guy came out with it in the box, I asked to see it working, guy didn't want to, so just drove back home, due diligence is always worth it, if something's already packed, to me that's a red flag right there.

I think the plaintiff should have also been awarded the amount that she spent on the u-haul truck/gas. She spent money to pick up a bedroom set that she was told had no damages (she definitely should’ve inspected the furniture herself!) which turned out to be untrue . Now she will need to rent a U-haul a second time to purchase a different bedroom set. Also, if the defendant ends up abandoning her damaged furniture at the plaintiff’s home (which I think is fairly likely to happen) the plaintiff will be the one who has to deal with getting rid of it. If she has to take it to the dump or Goodwill she’ll need to rent yet another truck to transport it, not to mention the dump charges. If the defendant doesn’t pick it up I hope the plaintiff finds someone to give it away to who will pick it up themselves.

I agree but she needed to say I got the u haul just for picking up this furniture, not let it be assumed she had it for other purposes. I think that may be part of it. It goes with why there was 17 dollar charge from Paypal and she couldn't explain it to the judge. paypal fee is there to protect anyone who is buying/selling.

No because if she drove a U-haul there, inspected it & declined purchase, the seller would not then be liable for the U-haul charges.

PayPal is shady as heck. They don’t tell the person sending the money about these fees, it’s completely hidden and the receiver has to pay. Avoid!

Not the plaintiff tho. She was very nice to her. She tried not to speak over her and would stop when she heard her voice. Defendent got the brunt of her rudeness tho.

If reviewing the case meant so much then there wouldn't be a need for trials. The judge would simply make a decision based off the complaint.

@@KennuhWayne judges, tv or actual court ones, usually review what evidence is presented before litigants get there. But ones in big cities often don't have the time to review the cases ahead of time. I have 2 relatives that are judges, the one from a small town will go over his cases ahead of time, while the one who is in NYC doesn't have time to do this. Why do you think that Judge Judy always seems to have her mind made up as soon as she starts a case? Once in awhile a litigant will add something during testimony that wasn't included in the papers submitted ahead of time and then changes her mind and attitude, but most of the time you can tell from her attitude towards either the plaintiff or defendant which way she's leaning, from the paperwork submitted beforehand. But in this case things were being said that really weren't pertinent to the case.

If she had reviewed the case so well then why question the litigants at all? Just review the case and be done with it. Reviewing the case doesn't provide you with all the answers you need. Have you ever gone on The People's Court website? The information and/or evidence that's submitted to open your case is very minimal. Most information and/or evidence is not collected at that point. And you do realize that much of that information is false or misleading, right? Usually one party is lying in a civil suit (obviously), which is also reflected in the complaint and defendant's answer to the complaint and should only be taken at face value. But besides all of that...it's pointless to ask a question and not wait for an answer over and over again.

This happens a lot on Poshmark. Someone listed a “brand new” white knit sweater and when it arrived it had dirt stains on the sleeves. It was disgusting! I took pictures and opened a case so luckily I got my money back. Poshmark doesn’t tolerate people like this.

I agree with you on that, that furniture deal was really no different than a used car situation. It's the buyer's job to look at it and or drive it unless you have some type of warranty. I mean it's just common sense

@@peachesandpoets Doesn't matter if the seller is Lucifer himself, the onus is on the BUYER to inspect products to make sure they are not damaged, parts missing, faded, stained, color wrong, etc. Some people volunteer to be victims because they are willfully ignorant/stupid. ALWAYS do your due diligence when purchasing any used product.

Whenever I buy online, I ALWAYS inspect it. ALWAYS. You can't ever just take people's word for anything. And she knew she was wrong for selling it to her that way when she had to sue the moving company herself! She should have known there was damage to the rest of it.

I do too. Never ever buy anything without looking at it first. Sometimes things look different than in ad pictures. Whether it be damage, color, style, size, etc.

I once bought a camera online around Christmas time. When it arrived, I inspected it, of course. Inside, the guy had folded up a Santa hat & stuck it in there. What if I had never opened it, & just said, 'camera's here' & tossed it in the closet? I use that hat more than the camera!

That's because the litigants usually take too long to respond or do not answer her questions with a direct response. Yeah, it sounds rude however she acknowledged that in one of her shows.

Of the TV judges, id rather be on JM’s court than the others. She may yell and talk over the people but her judgments are based on the facts and are fair.

Millian’s hair was on POINT this episode. Been watching since I was a child when she first took bench and this might have been the best she’s ever looked. Plaintiff was smart even though her actions during purchase were not. Good judgment. They still need to fire Doug though. Lol

Terms and conditions have no bearing on a not as described dispute. This is part of the rules that govern any credit card purchase. Facebook's platform requires payment via credit card so the credit card rules govern the purchase. This is why it is extremely important to never sign anything saying it was received in satisfactory condition when the delivery is completed.

No she didn't have had to seen the furniture. I am going to go out on a limb here and say the plaintiff told her about the damages (there is testimony to support that theory, add in you know lady was mad and said something to her) and she turned around and filed a claim.

The defendant was definitely trying to get over. If she kept the plaintiff’s $600 and pocketed the $400 from the moving company- she basically made $1k (or a little over) and even if she had given her a little money back- she still would have made more than what she was selling it for. She thought she was going to come up!

defendant didn't blink an eye when the plaintiff said she wanted her money back. Defendant knew exactly what was wrong with her furniture. She should be ashamed but of course she is not. I bet she never went and picked up the furniture. She is a real piece of work.

So the seller not only got $600 for her furniture then got another $470 from the storage company on top for damages to furniture she sold! Why didn’t she offer that $470 so the plaintiff??

You cannot misrepresent your items. That nullifies the as-is sale. Same would apply for cars if an explicit warranty was given (e.g., engine is in perfect condition or newly built).

How did a moving company get pink stains on the furniture? Seems it happened while she was using it. Maybe the little chunks missing rhe moving company did by hitting it on something while moving it but i dont see how they could stain it up. She at least knew about the stains.

I always make sure people check things when I’m selling stuff. Even if I pay money I tell them to count it. I don’t have time for stress after the fact.

When people face a judge, superior in rank or any of their elders I don't expect to hear "Yeah". I still expect to hear "Yes, Judge; Yes, Your Honor; Yes...etc... but NOT "Yeah". It's disrespectful and the manner in which you speak with your social buddies (IMO) but I personally don't use the word.

Never accept 2nd hand furniture or anything blindsided & had paid for it that was pre-wrapped up.to find the items destroyed. That was the Plaintiff's fault. The Defendant claimed there were No damages. That's what the Plaintiff accepted as the truth.

PayPal definitely charges a fee to send money to another person. They usually don't charge when you make a purchase from a store. Or, if they do, the seller absorbs the fees by adding the percentage into their sale price...

If the respondent didn’t look at the bedroom set and unwrapped it to see damage then how could she have made a claim for damage and gotten paid for damage if she didn’t unwrap it and see that there was damage. She’s a liar from what I can tell

Well the judge yells at her for not opening the package up. If you buy it in a store you can’t open it up either. You see a display model and purchase one in a box. Guess the judge never bought anything at a store before.

I've purchased and sold on FB marketplace and always note the damages and send pictures taken the same day as the post. Plus I always ask about damages in writing. This lady is a snake and isn't showing any remorse at all. Cleary she didn't care

Seems more like a basic ‘as-is’ sale case when the buyer didn’t inspect the item. I don’t think I’d consider ‘no damage’ as a specific warranty. To me that’s like a car sale saying ‘runs and drives perfect’ but that isn’t a specific warranty.

It sounded like Milan wasn'tt going to give her the cost of the truck or the gas, because "you had to spend that anyway," then it sounded like she gave her credit for that, at the very end. Anyway, these defendants who aren't surprised or angry after they lose, are just happy-- they "outsmart" others & get their faces on TV.... they're psycho!!

So...what I got out of this case..is that if you eat food you're gambling with your life and sanity...can food make you bad? Well..if its a matter of fact..yes. if the food is bad..but if the food is good and it's bad for you..then what's good? Or..why is it bad? Thus we have started in and went out..unsatisfied and exhausted or..complicit and open to solicitation or advice..but be warned..the spin of discernment differs from the sobriety of judgement. Those who soberly do not eat..for the sake of the self...are untainted...or..uninvolved with the case and process and verdict..those who do not eat..are untainted...are also..uninvited to the table...it is often true wisdom will not be derived from a resource without sources...good and evil..or bad..in this case...are not a part of the metabolism of the pure and untainted..but purification may be another product of another food...be not drunk with wine..but be cleansed..and healthy..and renewed. It is not wise to renew that which is suffering and goes unto suffering. Nor is it wise to age that which does not renew.. nor to renew that which has not aged nor multiplied...then what is it? To be..or not to be...if indeed that is the question...the answer will undoubtedly be a reckoning. What is death without a spirit. What is life with death in its heart and a mind of work? Is it a service...or a failure to connect to the server? Who has established these congruencies..technologies..but in that they have divided but a child from life..from its mother..from the breast..from the father's will and work and word and wisdom...even if he must suffer..suffering will secure him wisdom..and mercy..and grace...but if he is made new..redeemed..aged...increased..multiplied..suffered with abundance and destruction and desolation come to his work and wisdom...what is it then? Who has witnessed his ways? Abandonment. Recovery. Absolution. Ruins. Some things are not of the court designed...but of the land..and its laws...if any man remain..let him hold fast to whatever standard is righteous. If he should be cut down he is not alone. The truth will prevail..and if any house remains...he has his word. This will not serve him. He will serve it as he serves himself. 😉 The truth has been told. It serves the people. (Of course you realize...you have not heard the truth...and have not obeyed the law.)

Movers generally only give you a few days to be able to make a claim, so she DID know about the damage. Also, how would she have taken the photos to put in the advert, if she hadn't unwrapped them? She is a scam artist and knew that by having the woman come by when it was dark AND the stuff already wrapped, she could pull a fast one. And even in good condition, that stuff was NOT worth $600...

I kind of felt bad for the friend of the plaintiff. She easily could have said "he's a friend of mine" when the judge asked who he was. Instead she chose "oh he's just a friend" and it kinda sounded derogatory. He showed up to support her and his thanks was a rude comment directed towards him.
