The judge is diagnosting the man as if he is a doctor. This is laughable, this is how mahabharat happened. Judge nyay dena nahi chahte hai. The man wanted nyay not suggestions, diagnostics, tareekh, etc from the judge. then he says stay kar dete hai chakkar marte raho, which is soo wrong. Talwana is urdu word for आव्हान (challenge) with process fee form of course. They will give you everything but nyay.

Why is the judge scolding and pontificating to this working man who is standing there in his court looking to get justice due to workplace injury that has made him unable to work in his earlier capacity. The judge has no business lecturing this man. He has never picked up a tool in his exalted life to know what can this man can do and cannot, to earn income. The whole judiciary seems to be full of “Desi Babus” with inflated egos and sense of superiority. The whole of Indian judiciary needs to be reformed wholesale. Very shameful.

He is not. Judge is making the case for defense which might have been argued beforehand when the petitioner's lawyer was not present. It should be more on the petitioner lawyer who isn't fairly representing the man to the extent that he isn't even present in the proceedings and hence the case was thrown out. Judge did an excellent job in staying the decision for a fair hearing.

Everyone hating the judge, please note: Judges give a verdict based on proof of evidence. The labourer has no medical proof at his disposal that he has suffered an irreparable injury. His advocate isn’t present and he possesses half information. Judge has done his best in present circumstances to give him a better chance and stay the order and give him an opportunity to present his witnesses. Hence asked him to deposit the fee for witnesses called as Talbana. The judge asking him repeatedly regarding doing some other work is basically an enquiry to assess the injuries suffered by him and severity of such injuries. At the same time he is recommending him to keep working and not wait for payment of Damages in case he wins the case, as it won’t be enough to sustain him. He is suggesting and ensuring that this isn’t the intention of the petitioner. You see the labourer pleading, please also see the patience and efforts taken by the judge to present him an opportunity instead of telling him that he is wasting court’a time and resources and abrogating the case or declaring it ex parte and adjudging based on the half information presented, only to cause more harassment to the labourer later or making him appeal the case later.

It's the judge's job to ask for medical evidence, not to conduct a clinical examination. It's the judge's job to seek EVIDENCE about an injury, not question a man's career path. It's my, the citizen's, expectation that the judge be courteous and respectful, which frankly, he fucking is not.

But, that does not give the judge any right to say to the worker that "Nyay leke kya milega aapko", it is not the duty of the judge to decide that. It is the duty of the Judge to judge the case. Apart from that the Judge lives in such delusion that he thinks that a mason can earn 50k in 2 months. These people live in an ivory tower and sit in AC rooms and have no real life struggles such as those faced by the poor people of the country.

People, having the knowledge regarding law and labour law , can they explain what should be the compansation provided to a person, who lost his livelihood because of an accident happened to him on his workplace while the person is on-duty? Only 2 months wages? Or this should include the harrasment from the police, the boss of the labou, and even from judiciary system for being financial incompetence and not having proper education?

Everyone who is suggesting that the Judge should not have questioned him regarding the case, or should have helped him because he is poor and not educated, should remember that it is not the job of a judge. If a rich person/ a government employee was questioned in this manner, all of you would have praised the Judge or even criticize them for a lenient line of questioning. When we ask for equality we should ask for equality, not privilege. When you romanticize the poor and demonize the rich, it has dire effects on society. Being born poor is not in anyone's control but being poor in your middle age is based on one's actions. Being uneducated is not to be celebrated at all, one should not be empathetic towards someone being under-prepared. I am not saying underprivileged and privileged are on equal footing but after 75 years of independence, the least a society should expect is for everyone to be out of poverty, or at least be educated (basic education, not suggesting the formal education).

In this case of electrical shock accidentally resulting in physical injuries to the complainant. A complete assessment of injuries and present physical health status should reviewed by constituting a Medical Board and complete medical case history as well as present health status should be done by medical board and submitted to the relevant authorities/ labour court. Quantum of compensation should be calculated on basis of the findings of the medical board. Prima Facie case is of accident occurred in work place and daily wage employers i.e. construction contractors should be held responsible for not providing a safe working environment, thus grevious injuries sustained by the petitioner a mason by profession. Therefore the contractors should be summoned to the court and on basis of all observations and reports of medical board the compensation should be awarded as per the law.

It is a matter after dismissal in lower court due to absence of counsel, For restoration of case and stay this drama by labourer in person was necessary and the director of the drama is his advocate standing outside court. As a lawyer i understand behind the scene, judge knows that this was a drama by advocate do he behaved like that with labourer, Judges and judiciary never can be bad, they are trained to justice giving

Now I understand why the selection of judges is such a difficult process. Most of you folks in the comments section are emotional fools who will simply flow in emotionalities like poverty, gender, family etc rather than following the correct process of justice. The process of justice requires hearing both sides, looking at evidences, ascertaining whether the evidence is admissible, weighing the arguments and the evidence and finally giving a decision based on principles of equity, fairness and justice. A judge cannot allow his personal sentiments to overtake the due process. The process of justice is there to ensure that no one is unfairly punished. Here, we as viewers, who are making judgements about the court do not know the facts of the case and are making judgements based on only what we have heard from the labourer. What if the judge takes a judgement on emotions and gives a favourable judgement to the labour, when in fact he was lying? That would he injustice to his employer and would set a dangerous precedent
