കേസ് സുപ്രീം കോടതി യുടെ പരിഗണനയിൽ ആയതിനാൽ : അണ്ണാമലൈ യൂണിവേഴ്‌സിറ്റി, ഭാരതിയാർ യൂണിവേഴ്‌സിറ്റി, പെരിയാർ യൂണിവേഴ്‌സിറ്റി, ഭാരതിദാസൻ യൂണിവേഴ്‌സിറ്റി, മദ്രാസ് യൂണിവേഴ്‌സിറ്റി എന്നീ യൂണിവേഴ്‌സിറ്റി കളുടെ ബിരുദങ്ങൾ നിലവിൽ നിയമ സാധ്യത ഇല്ല invalidആണ്. Kerala public service commission, Upsc,ssc, southernrailway, Higher educationഇതൊന്നും ചെയ്യാൻ സാധിക്കില്ല സുപ്രീം കോടതി ഫൈനൽ വിധി വരാതെ. മദ്രാസ് ഹൈക്കോടതി ഉത്തരവ് യൂജിസി അംഗീകാരിക്കില്ല. കേരളത്തിൽ യൂണിവേഴ്‌സിറ്റി കൾ കൊടുത്ത ഇക്വലൻസി യും invalidതന്നെ ആണ്. ഇനി യൂജിസി അംഗീകാരം ഇല്ലാതെ ഇക്വലൻസി കൊടുക്കുന്നു എങ്കിൽ അത് ഇല്ലീഗൽ ആണ് സുപ്രീം കോടതി ഫൈനൽ വിധി വന്ന ശേഷം യൂജിസി സൈറ്റിൽ വന്നാൽ മാത്രമേ ഇക്വലൻസി വാലിഡ് ആകുകയുളളൂ. മറ്റ് ഗവൺമെന്റ് ജോലി കളിലും റാങ്ക് ലിസ്റ്റിൽ വന്നാലും പുറത്താകാതെ ഇരിക്കുകയുളളൂ. നിലവിൽ ഉളള സാഹചര്യത്തിൽ സുപ്രീം കോടതി യൂജിസി യുടെ കൂടെ നിൽക്കാൻ 80ശതമാനം ചാൻസ് ഉണ്ട്. യൂജിസി സൈറ്റിൽ നോക്കാതെ ഈ യൂണിവേഴ്‌സിറ്റി കളിൽ പോയി പഠിച്ചത് വിദ്യാർത്ഥി കൾ മാത്രം ആണ്. സുപ്രീം കോടതി വിധി 2005ൽ പുറപ്പെടുവിച്ചിട്ടുണ്ട്. യാഷ്പാൽ കേസിൽ അംഗീകാരം ഇല്ലാത്ത യൂണിവേഴ്‌സിറ്റി കളിൽ അഡ്മിഷൻ എടുക്കരുത് എന്നും,center,ഫ്രാഞ്ചൈസി കൾ തുടങ്ങരുത് എന്നും. ആ കോടതി വിധി ലംഘിച്ച് കൊണ്ടാണ് വിദ്യാർത്ഥി കൾ അഡ്മിഷൻ എടുത്തത് കൊണ്ടാണ്

UGC had also issued another public notice F. No. 1-2 2015 DEB-III dated 01-06-2022 for information of the general public, students and other stakeholders informing them not to take admission in any ODL Programme to be offered by Annamalai University Tamil Nadu for academic session beginning September 2022 revised from July-August 2022. In the meanwhile, the University had admitted students in ODL programmes during the period prior to 2022-2023, when it had no recognition from the UGC. The matter was considered by the Hon’ble High Court of Madras in W.A. No. 606/2015 UGC and Ors. Vs Annamalai University & Ors and connected matters, and vide judgment dated 20.01.2023, the Hon’ble High Court upheld the right and primacy of the UGC to make regulations for conducting distance education programmes, reproduced herein under: ‘60. In fine, we conclude that the University Grants Commission Regulations will prevail in view of the primacy given to the University Grants Commission under the University Grants Commission Act as well as the Entry 66 of List 1 of the 7th Schedule of the Constitution. While the Universities established by the State enactment and other private Universities can enrol students from outside the State, their other activities viz., establishment of learner support centres, conduct of the examination etc., must be within the State only. Insofar as the deemed to be universities are concerned, they can conduct online distance education programmes in compliance with the Regulations of the University Grants Commission upon having recognition from the University Grants Commission.’ However, the said Judgment dated 20.01.2023 has been assailed by the UGC by way of a Special Leave Petition before the Hon’ble Supreme Court of India in SLP(C) No. 015406 - 015427/2023, so far as it protects the admissions made by the University in ODL programmes for the academic year in which there was no recognition from the UGC. The matter is currently pending before the Supreme Court of India.

5-8-2024 Ugc Latest RTI Reply. : The degree(s)/diploma(s)/certificate(s) are verified/validated by the issuing authority i.e. concerned university/institution only. DEB, UGC can provide the recognition status of the university which is as under:- The Annamalai University, Annamalai Nagar Tamil Nadu is a State University. As per available records the erstwhile regulator Distance Education Council (DEC) granted post facto recognition to it for the programmes offered by it through distance mode for the academic session 1995-96 to 2006-07. Further, DEC granted institutional recognition to Annamalai University from Feb 2007 to Feb 2012. During the period of institutional recognition, the University was required to offer programmes approved by the statutory bodies of the University and after seeking approval of the concerned regulatory bodies, wherever required. Seeking approval from the respective apex bodies was the responsibility of the University concerned. However, no University is authorized to offer technical and professional programmes through distance mode. Further, the programme-wise recognition was accorded to this University for three years for academic year 2012-13 to 2014-15 for offering specific programmes. No recognition was granted to it either by DEC or UGC to offer any programme through distance mode from the academic year 2015-16 to 2022-23. This information is also displayed on UGC website at deb.ugc.ac.in/. Being a State University, it can operate within its State Only. The University is not authorized to open Study Centre/Off Campus Centre beyond the territorial jurisdiction of the State as per the judgment of Hon’ble Supreme Court of India in the case of Prof. Yash Pal vs The State of Chhattisgarh 2005. Also, these Universities cannot offer their programmes through franchising arrangement with private institutions for the purpose of conducting courses through distance mode or regular mode. You are requested to refer to Public Notice dated 27-06-2013 on territorial jurisdiction of universities and other matters related to distance education on UGC website, which is reiteration of earlier guidelines/notices issued from 2001 onwards. Further it is also informed that UGC has not granted any approval to the University to open off- Campus/Study Centre anywhere. Various complaints were received by the UGC-DEB against the HEI. Accordingly, UGC had issued above Public Notice dated 25-03-2022 for the awareness of general public, students and other stakeholders regarding the violations by Annamalai University in running distance education programmes without approval of UGC mentioning therein that The Annamalai University was only recognized to offer any programme in ODL mode till Academic Year 2014-2015 and no further recognition has been accorded to it to offer any programme through ODL mode. Accordingly, the ODL programmes offered by the Annamalai University Tamil Nadu without prior approval of UGC are invalid and the University is solely responsible for the career consequences of the students if any arising out of the same. Annamalai University vide its letter no. AU DDE 2022 dated 17-06-2022 was informed this office that it has stopped admission for the academic year 2022-23 for all Distance Education programmes.
