(I'm a part of the group that got an early physical copy but not a watermarked pdf): I reached out to wotc and flat out asked what we could show once the embargo lifted; their reply, word-for-word : "After the embargo releases (right at August 1st, 2024 @ 6:00 AM PST) you’re free to cover the contents inside of the book how you would like (with the only exception being re-uploading full page copies, basically abiding by standard Fair Use)." There was ZERO mention of a permanent embargo of the index, zero mention of a permanent embargo of stat blocks. SO.. many of us showed those exact things. In my case, I got an email a full 3 DAYS later citing that there was a permanent embargo of those two sections, when previously they cited that I was "free to cover the contents inside the book how you would like". Be VERY careful taking them at their "share all you want" because they obviously have no issues walking back after the fact and altering the restrictions. A viewer of mine said it best, "It's difficult when the powers that be keeping changing the rules, or won't tell you what the rules are, until you break them."

That's what makes it doubly inexcusable. Not only do they send the guy a review copy to review in a KZbin video, and then copyright strike him for doing so, but they did it over concerns which are literally nonsensical. No one who wants a free copy of these books is going to fail to get one because you can't screengrab 300 pages off a KZbin video. An HD scan will be up online, for free, within 24 hours of wide release.

@@ericcorso the thing about piracy is that it's not about whether the content is available to pirate. It's about accessibility. Sure you can swipe the new rules off of a pdf, but first you have to find that pdf on one of many super shady sites with who knows what viruses. Most folk will be too scared and just avoid the risk by buying the pdf legally. On the other hand, having a KZbinr read through every word of every page risk free creates a bigger problem for WoTC who clearly want you to buy the book

Here is a timeline of what happened A video was released with high rez captures of the book itself as complete pages WotC tells them to take it down and blur the pages this order goes out to a number of content creators Many content creators took down their videos to edit and comply, Jorphdan delisted the video but kept it up while editing WotC starts the strike process because delisting isn't taking something down. Jorphdan reuploads the video with the content blurred Strike gets processed, Jorphdan is upset makes claim of unfair and some members of community grab their WotC pitchforks. WotC sees the correction was made and pulls the copyright strike because the issue was finally resolved like they asked. Not a scandal, not greedy Hasbro/WotC trying to punish someone for not doing anything wrong. One email from Jorphdan to WotC saying hey guys it is fixed please check and remove the strike and it would have been fine without all this false rage.

The person I most blame is whomever decided to send a DMCA takedown notice instead of a copyright claim. The channel was actively working with WOTC's community content team!! DMCA takedowns are the harshest possible option short of a lawsuit and really should be reserved for the most egregious cases. Even if WOTC thought that the creator had ignored the rules given to him, claiming the video to take it down and then having a discussion would have been the right way to go. Striking channels is a permanent relationship ender. Don't expect to ever work with a creator ever again whom you have ever struck. Even in this case where they retracted the strike within 24 hours, there is probably only a 50/50 chance he'll ever do pre-release content ever again for WOTC.

Yeah. It sounds like there was a set of instructions given to those with a pdf limiting what they could show. Even less restrictions were sent to those that got physical copies but didn't sign NDAs. But it also sounds like neither match what WotC is now asking for.

However, I don't think they were told they couldn't show an entire page, and it sounds like they were told they could. Those who didn't get the PDF and didn't sign the NDA weren't told anything. I don't think anyone dropped the ball, I honestly think this PDF floating around caused WotC to act.

If you check out nerd immersion's coverage, he mentions upfront what pages were off limits. I didn't see the video that got struck, but I did notice dndshorts use a page with stat blocks that I believe was one of the banned pages according to ted from nerd immersion. It might just be an issue of some youtubers not noticing that restriction

Idk if DND shorts got a pdf copy, but Only the people with a PDF copy were told the index and stat blocks were off limits. That was not communicated to those who refused to the sign the NDA, but got a physical copy of the book later. There is a possibility someone dropped the ball and never notified those who only got the book.

Re: 2024 PHB giveaway, if it were me, I'd keep my signed copy. Stephen, even if you don't find it has sentimental value *now*, I'd still recommend you keep it as a memento of your time at Gen Con this year. Now to WotC and the PR firm, they should rescind the copystrikes, release a statement apologizing to the influencers (much as I am loathe to use that term), then do a simple investigation. Reach out to the influencers affected and ask them to forward what they received from the PR firm (& WotC, if follow-ups were directed their way) regarding what could & could not be shown. Talk to the PR firm and ask for the same thing. Two weeks later, release a summary report: Here's what happened, here's where we messed up, here's where other people messed up, and here are the next steps both for us and for our PR partners. It's such an easy way to counter yet another "own goal" they made that I, after sleeping like garbage and can't brain very well, can come up with on the spot.

Honestyl sounds like the pr firm just assumed everyone in "media" knows standard procedure. Problem is, you tubers / influencers 1. arn't trained in this and don't know media standard procedure, and 2. come from a frewheeling internet sharing culture and are thus likely to assume sharing is ok unless otherwise specified. The PR firm should 100% know how influencers think , and how to talk to them so that they understand. (it's not like influencers are some tiny niche, and it's not like they are acting in bad faith.) they are a PR firm. Getting the message accross is the ENTIRE POINT. Something similar recently happened in the lego comunity. A (entierly well meaning influencer misunderstood and shared something confidential and lego A. didn't punish him that much (they actulay just released a set based on his work) and B. made sure they were MUCH clearer in the future.

Now is it good PR companies to claim copyright infringement probably not. Would this case stand up in court probably not. (although it’s seems solved now) How do companies win most of the time….the little guy can’t afford the lawyers to fight on their behalf

Stephen, another great vid. Having had a friend who is an insider at WotC for years I'm very well aware of their dysfunction internally which has gone on for years. Ted at Nerd Immersion went over which pages he was allowed to show and which he wasn’t with the advanced digital copy he got. I imagine that doesn’t necessarily apply to anyone who got it at gencon but ultimately it seems like wotc cleared things up pretty quick, Jorphdan praised their quick response and has permission to show the video but says he’s made the decision to keep it private for now. A misstep for sure but probably not that big of a deal in the big picture

It's on WotC (surprise, surprise...) communication. PR company really should tell them just to avoid issues. And WotC could be gentler with the takedown or at least remove the strike (after the video went down), if they didn't already. Even if the guy is wrong by doing a flip through, the company should have taken due diligence and make the terms clearer. Also: I totally get not shipping all the physical books right now BUT they could have delivered the digital ones, like some sort of "fomo BS preorder bonus" on DnD beyond when the embargo was lifted. People hate WotC, you can bet money a high quality scan will be available really soon - out of spite, if anything - especially if people can get multiple copies (unbinding one to scan + getting a pristine one for use). There are probably 2999 books now, one likely "took a hit the team". That kind of weird release is bad for people who bought the PDF legally and will end up reading it after people who pirate it. That said - if you ever get your hands into a watermarked pdf (to prevent leaks), well, don't show anyone said PDF. The watermark is there for a reason. In this specific, you don't own distribution rights because the NDA was lifted. What he did was essentially leaking the pdf with lower quality after some extra steps.

My understanding is that WotC requested Jorphdan to take the video down and edit out the specified pages. He delisted the video while he was editing it. WotC of course has it's own internal documentation trail, in which, someone got the link, saw the video, and was like "WTF, he didn't take the video down!!" so they submitted the CR complaint to KZbin. So add bureaucracy to the list of mistakes here. Just an unfortunate series of mistakes up and down the line.

I'm actually surprised about how little an understanding of youtubers and influencers have about how review samples and conditional embargos work when dealing with larger companies. I too have experience from a "previous life" and have dealt with Hasbro, Paramount, Activision, etc. I guess it's just a matter of them having an audience but not really having much Press/PR experiences.

Paizo for example, creators can make what they want a few weeks before release and you can even read ALL published rules and monster for free in their official archives of nethys right after release. Maybe the difference between Paizo and WotC is they release books that are totally worth their money and not just a cheap cash grab and players will because of this buy their products anyway

This story just support my position that I shouldn't be buying any Hasbro/WotC products until they change their corporate culture of supporting AI usage outside of D&D and Magic, sending lawyers and union busters at members of our community, and treating their staff better. I hope the community stay together at not supporting the D&D 2024 edition.

It does seem that there is confusion between the different arms of the company. So, I would have to agree that a written agreement is safer than verbal. Also, maybe get any vague areas or questions answered and highlighted before committing to any videos. Would it make any difference if thses agreements were attached to the video as well, just in case?

If they sent those books out for review and the reviewers stayed within the guidelines actually given, then wotc is out of line and likely hasn't a leg to stand on. And if they sent them out without pre-negotiating the rules then it's doubly on them and not the reviewers.

smoke & mirrors... they don't care about pdfs, there are pdfs for 2014 books and there will be pdfs for 2024 books... this was to get people talking about something other than a lot of the youtubers and youtube viewers don't like a lot of the changes.

You can't do a page by page zoom in flipthrough of a book that's supposed to be a product for sale in a couple weeks. Jorphdan knew this and chose to do it anyway. Very bad poorly thought out decision when the clear intent of the content he was allowed to make was to talk about the book's contents, not show them directly. Anyone with common sense in this position should have been able to know that what he was effectively trying to do was give people the ability to take the product for free. WoTC are generally the bad guys, however after removing the strike they are not in the wrong at all this time.

Pathfinder would do the same thing if people flipped through almost the entire book after admitting they didn't sign any contract. That's just blatant posting of copyrighted material.

It's a great way for WotC to shoot themselves in the foot and chase off more supporters, fans and third party developers who offer critiques and criticisms as the company shifts it's focus to producing addictive video games with microtransactions.

Hasbro and WotC corporate can never be trusted. There's no reason to support the 2024 reprints when there are at least three different third-party versions of 5e coming out within the next year.

It's WORSE they are going to super micro transaction & start to push more virtual editions of D&D. We read the files. Its going to get the WoW treatment & they legit didn't even hide that they basically wanna hire people to design D&D Beyond to milk us dry & never really OWN any handbooks/sheets/characters/races we get. Just like in WoW it's going to be a free to play, but they want to make the basic version so unfun and unplayable that you have no choice but to use their subscriber tier systems & microtransactions for every facat of gameplay. Plus they wanna add other IP to D&D similar to Fortnite & DBD. So in long story short?? Let's all agree to vote with our dollars like we did with the OGL. I can't believe they are trying to do this again but in a much sneakier and underhanded way.
