Best guess as to why the defense "strategically" decided NOT to file the motion they've been promising the judge for weeks is that they didn't have any actual evidence to show egregious behavior by the prosecution... OR... filing the motion would have opened the defendant up to additional charges for her involvement in the illegal activities of Aidan Kearney to harass & intimidate witnesses.

The strategy is to delay, delay, delay, then blame it on what seems to be a single item of dna evidence that the def hasn't produced a single piece of what they intend to use as evidence. Jackson thought he was smooth using that tactic, but he's really stale. Judge called his bluff when she asked if def could produce evidence req'd within a day. He sputtered & spewed "well, maybe not in a day" big tell there.

*Not sure if she did it or not. But I do know there were a lot of illegal things done by the state as well as the investigators. Not saying charges should be dropped. There should 100% be a new grand jury that provides all of the information and not just the stuff that could get a conviction. The fact the judge acknowledged the state manipulated the grand jury and the FBI said the same thing, but the judges response to that is to bring it up in appeal in the case of a conviction is ridiculous to me*

This FACT is check mate because McCabe nor any of the house occupants should not know John O’Keefe is dead or will "die in cold" until Read returns and her and McCabe find John O’Keefe dead in the cops yard at 5am. That McCabe is searching “how long to die in cold” @ 2.27AM is because they already knew. Lastly, defense doesn't create resonable doubt. It exists or it doesn't. Bam! Get a reality grip.

In virtually every court procedural in the US, why do both Prosecutorial & Defence attorneys find it difficult to allocute correctly ? 99.9% of those speaking insert, "Uh" or "Um"in their speech when addressing the Judge; it is as listening to four year olds. Read's counsel are ill-prepared....they've had those four hundred pages of testimony for four days, as well as a USB drive - none of which has been scrutinised; at this rate of endeavour from her own defence team (or lack thereof), Read is going to lose - plying for a Mis-trial is no longer an option - they need to do their homework - & quickly.
