When there was condition in the contract document that solar equipment/material required to complete the project can be imported from other firms then other condition that bidder should be producer of solar equipments/material has no justification except imposed to avoid fair competition and intent to favor some specific bidder. The bid documents also looks contrary to the cvc India guidelines issued from time to time.

I am a little confused by the dichotomy of arguments presented in this piece; SECI organised a national tender so clearly the lowest bidder would have won the tender (I.e. no one else could match their price)? If that’s correct,why their price was unaffordable and if it is, what’s that price level vs electricity from Hydro, thermal, wind, nuclear etc? Comprehensive analysis should also talk about replacement pricing, business know how and circumstantial evidence proving that pricing per UNIT was inflated to give oversized returns to winning company. Lastly, for God sake, don’t base your journalistic critique on US DOJ’s charges; they credibility is in Tatters of late and would be better you avoid latching on to their line of reasoning. Be rest assured, they might end up losing their case! And basic economics 101 clearly demonstrates that economies of scale will give a few players in a given market/sector a clear competitive edge; doesn’t mean there is necessarily a corruption there. Bottom line, better to have a thorough analysis before CLAIMING BLANKET CONCLUSIONS that solar energy price structure in India due to this project is highest and penalising Indian consumers. Thanks

You seem to have picked up a few points in defense of Adani / SECI. Here are a few to consider 1. The tender was framed in such a way that Adani was the winner 2. The New York Manhattan Eastern District FBI is amongst the top cadre of ethics and professionals - the Best in the World. The FBI would normally have not investigated this case - but, they have a burden to act if a whistleblower reported the fraud. The FBI would not have moved if they did not have sufficient evidence. Also note that this case has been reviewed by a Grand Jury - means that there is justification for the case to proceed. However, Adani / Modi got lucky that Trump will be the President who may dismiss this case - per request from Modi. 3. Your economics doesn’t add up - because you don’t have all the numbers. You are basing your argument based on your intuition. Economics also plays into - The solar panels getting cheaper over time, but the higher rates are fixed for 20 years.

@ first of all, not interested at all in defending anyone here; not sure why such assumption was even made and/or any motive is ascribed in the first place! Point-wise; don’t you yourself consider that point#1 is rather assertion, which tender terms made it company specific (size and scale reference could be business-continuity specific and common practice in capital intensive industries). Point #2; there could be merit in your argument as for NYMED but unfortunately very difficult to assume Gold standard credibility of other countries’ institutions (besides, what I am rather confused is that if this court is so solid why would they quash charges if Mr Trump comes to power; either they stick with the due process or they don’t)-anyways can’t objectively gauge the credibility angle at least at my end . Point#3, precisely-would be better to have the comparative electricity costs from alternative sources so as to draw informed conclusion. I don’t know in depth about those (had some broader ideas though but was hoping to get that clarity from this content which I couldn’t get).

The US system of Government gives extraordinary powers to the Office of the President and, unlike others, the President can overreach and withdraw the filing of the case. Trump would do this as a favor to Modi 3. The Modi Government has implemented several restrictions and conditions that force the States to buy from SECI.
