My Father is an American Citizen and my mother was a Filipino Citizen when I was born (but she later became an American Citizen too after a few years of us living here in the US). My father was in the US Navy and I have always been an American Citizen since birth, even though I was born in Japan, where my father was stationed in the Navy there. I was brought back home to the Phil. when I was 4 years old and I grew up and went to school there all through my 1st year of college. Then, we moved to the US (California) since 1981 till today. My question is this, will I qualify for a dual citizenship? If not, what will I need to have, so I can retire in the Philippines? Also, when I go on vacation in the Philippines, do I check that I am a "Balikbayan" or am I considered a "tourist" in the Philippines, since I was never a Filipino Citizen? Please advise!

I am a Fil-Am, born in Philippines, now a naturalized US Citizen based in Las Vegas. When I go to Philippines, they stamp my US passport 1 year balikbayan visa. I have a condo in Makati, I do not have a need to own land, start a biz, work, etc in the Philippines. I only stay in Philippines 25-40% of the year, have fun, visit friends , etc, then I travel to US, Europe, etc, the rest of the year. I am not a dual citizen, just a US citizen. I feel like a "tourist" when I am in the Philippines, but I blend in as a "Filipino", and for me, that is fun! I will keep it like that. Condo is good enough for me. Low maintenance, in Makati, like living in a 5-star hotel, great location, great amenities, good security. I do not want a big house and lot - lots of upkeep, maintenance head ache.. For each his own. my 2 cents.

@@nicanorreyes1700, first off, you need to go to your regional department of foreign affairs (not sure) or any agency that handles overstayed foreigners or balikbayans. Second, check with Australian immigration if they recognize dual citizenship and if not, apply for permanent residency in the Philippines.

Ok your situation is easy just like my Mom and Tita. You have to file your Birth Certificate at the PSA if you don’t have it not a problem 1947 it’s going to be in a big book at your city hall of the city of your birth. My Moms was in the city hall of old Manila cause she was born in Tondo. So once your birth certificate is registered at PSA and after a processing time then get a copy of the PSA and now you can get a Filipino passport like I did. Cause you are born there in the Philippines it should not be a problem. I know that you are not getting help cause the lawyers will try to make money off you. That’s what happened to me until my Cousins General Baby daddy helped me out.

@@ivanbanishtok7603, the person you are replying to already relinquished his Filipino citizenship. He cannot apply for Philippine passport, otherwise, he won’t be able to go back to Australia. His only option is for him to go to regional immigration office and apply for residency or relinquish his Australian citizenship for or go back to Australia.

Why not just make it easy for former Filipino citizens to regain their citizenship by the President to write an executive order giving all former citizens to just renew/re apply for a new Philippine passport? Eliminate the lengthy paperwork documentation, etc.? The Philippine consulates can still charge the $50.00 fee and other fees to do this. They will not be losing money, they will only lose busy work! This move will bring in tremendous financial DOLLAR gain to the Philippines because more Filipinos can go home and invest in the Philippines!

I'm a US Citizen since 2003. I petitioned mt married daughter and her family. It was approved last 2009. All docs were submitted at the NVC. The NVC commentwd all docs are complete and just wait for the Welcome Letter and US Immigration Visa Interview. Need to verify the comment about being not eligible to work for US Federal Jobs if having dual citizenships. I think but not sure, that it only applies for jobs that requires secret clearances. Please research this, Also, I thought there was bill passed few months ago that foreigners can fully own (100%) properties in the Philippines as long as the properties or infrastructures are not critical to the national security of the country. Few examples , such as sea ports, airports, utilities, and communication network.

Dual citizenship is good if you are younger. But not if you are already retired. A lot of older Pilipino comes back to the USA for medics like benefits. But in case of emergency The USA will transport USA citizen first. Those dual citizen are not a priority because the Philippine law will take care of them,

If you are a dual citizen, you can stay in PH forever. However, if your stay was > 1 year in PH, you'll have to pay travel tax if you leave PH.

According to the general consul in Los Angeles when I got my dual citizenship he said when leaving and/or returning US present your US passport only but when entering and leaving the Philippines you must present both US and Philippine passports. If you have no Philippine passport you must bring you dual citizenship certificate.

By that time, I would have already spent more than a year (close to two years) in the Philippines. My question is, will I get questioned upon arriving at the airport in the US regarding my close to 2 year stay in the Philippines? What documents wilI have to provide if any? Hello. I don't think you will be questioned because you are a US citizen too. You can stay outside US indefinitely. You can use US passport to travel back to the US. I would also advise to get a PH passport in Philippines because it is more difficult to get PH passport in the PH Consulate due to limited or no slots for appointment scheduling. If you have both passports, present them both when exiting US and entering US.

You don't have to acquire for Philippine passport if you have dual citizenship certificate in your possession. In NAIA just present your US passport and dual citizenship certificate. When you get to US just present your US passport. Don't worry about over staying. Your dual citizenship allows you to stay in the Philippines as long as you want. And since you have unexpired US passport US Immigration Officer won't bother you.

I’m confused because of taxation. Somewhere along the video “taxes are exempt if no income earned in the PH” yet also in the “cons” of your being dual you also say “taxes MAY be taxed twice”. Does this mean the USA and PH will double tax if you live both in the USA and PH? Or because of higher income limits? OR Does one just answer NO to the question “have you lived in another country in the past year?” on your USA tax return?

You need to file not only U.S. taxes for your worldwide income, but also Philippine taxes for your income earned in the Phils. With the tax treaty, taxes paid in the Phils will be used as a foreign tax credit to reduce your US taxes to avoid double taxation.

Foreigners are allowed to own up to 40% of units in a condominium building. So if there are 100 units, only 40 units can be sold to foreigners. If you own 1 or 2, it won't be a problem.

If ( fil Am citizen ) was a retired service member and receiving retirement pension, does still need to pay taxes in the Philippines 🇵🇭 if dual citizen ? If you are a US Citizen by birth through your father and you were born in the Philippines to a Filipino mother but you have been using your father’s last name or your legal american name but your Filipino birth certificate does not include your father’s last name but you have an Identification Certificate from the Bureau and f Immigration from Manila stating you are recognized as filipino Citizen and in the certificate it states your American legal name a.k.a. the name that appeared your Filipino birth certificate, but didn’t get the certificate of Oath of allegiance. as you gave said that if I'm citizen I can stay in the Philippines for not longer than 6 months but if I'm dual I can stay for good but I have to filed my incomes tax here in the US how about Philippines do I need filed too ??

I think you only need to file income tax in the Philippines if you have business/income.

Hi.. I'm biracial, mix Vietnamese and African American. I was born in Saigon 1967, along with my 3 other siblings as well. We arrived in the USA 1972, and was automatically naturalize as US Citizenship. I graduated in 1986 from high school here in America and soon after, I attended college for approximately 2 years. I joined the US Army in 1988 and retired now! My mother is 100% Vietnamese and we still have family from my mother's side of the family currently living. I have 2 uncles from my mother side of family, and several cousins as well. I just recently gotten married in Vietnam, April 24th 2022, my wife is Vietnamese. She lives in Dong Thap.. Now that I'm happily married and retired from the military, I was thinking about living in Vietnam long term, what will be your best advice to be able to live in Vietnam long term legally without risking losing my US Citizenship.. (long term for me is like staying in Vietnam 3 to 5 years in Vietnam and back in the US periodically. Please advise if you can help, thank you and looking forward 😊

I suggest you contact the Vietnam Consul near you to get the right answer. They may have different policy and regulations for staying long period of time in Vietnam or applying for dual citizenship.

And don’t ever bring up that you were in the US Army. I too am ex US Army and would travel to Vietnam only on my Philippines passport. Did that going to Cambodia 2 times already. Much cheaper cause it’s free visa on arrival. Probably that same with Vietnam

You are not going over naturalized foreign nationals that become citizens of the Philippines. Dual citizens can also be naturalized Filipinos.

@@ivanbanishtok7603 You do not know or understand the law. Under the old constitution Marcos could grant citizenship to anyone he wanted when he held both executive and legislative powers. Ronnie Nathanielsz was naturalized by presidential decree No. 192 in 1973 and he was from Sri Lanka with 0 Filipino blood. Under the new constitution, Judicial naturalization and Legislative naturalization can turn a foreign National into a Filipino citizen. If you are married to a Filipino/Filipina and have lived in the Philippines for 5 years under a 13A visa, you can become a Filipino citizen through the process of judicial naturalization, on the other hand, if you have done something amazing for the Filipino people, you can become a Filipino citizen through Legislative Naturalization (which is done by an act of Congress). If you really claim to be Filipino, you should learn the laws of your own country. You don’t need any Filipino blood to be a Filipino citizen.

My mother is 93 yrs. old and a dual citizen. She is planning to visit Philippines by this year but she doesn’t have a PH passport yet. Her birth certificate is missing, will it be ok for her to travel with only the dual citizenship certificates and a US passport, and she will apply for PH passport when she get to the Phils.?
