I always wonder how defense attorneys can actually take on these hate crime/murder cases and still sleep at night. I get that everyone deserves a defense, but some people just deserve the same results as their crime.
@promise3723 жыл бұрын
Because not every defendant is guilty, you just don't see those cases they rarely show them in the news. A defense attorney can't decide innocent or guilty, only that the trial is fair and the rule of law is followed. Representing some evil (even they are entitled to due process even if we don't like it, them or their crimes) so that no innocent go to jail is a price we are willing to pay.

I believe, had the owner concerns regarding trespassers or theft of items from the site, he/she could/would have or should have sought out a fencing company to enclose the site for protection. I do find it interesting the property owner does have video camera(s) installed on the property yet no fencing enclosure. I work in construction and site protection is one of the priorities due to trespassers, theft, graffiti, etc. of/on the site. My next question, had the property owner reached out to the neighbors to monitor the property, to notify the police of trespassers?

@George Vaughan Hey George, I'm pretty sure he was running (not stopping) before anything like that happened. But, I don't want to argue. I asked an honest question for precisely the reason I described (I'd stop and ask what's up). You're position (I guess) is it would've been irrational for Aubrey to stop ask what they wanted - and, apparently, that's what you would've done if in the same situation. Okay, no problem. So, you and I are different and, as such, perceive and react to situations differently. In this case, you'd run; I'd stop. I can respect that. Unfortunately for Aubrey, running wasn't the solution. I just can't help but think had he simply stopped and asked_"What do you want of me?"_ he'd be alive today and no less for the wear at that.

Please don't make them tell the truth. It's legal to stand in the road with a shotgun in Georgia. It's legal to make a citizen's arrest if you assume that someone running away from the scene of the crime is guilty according to the Civil courts and supreme court if you are fleeing you are considered guilty. It is not legal to try to steal a shotgun from a man's hands. Especially if you are a convicted felon on gun crimes. Our little saint try to steal a gun. If his fingerprints are on the gun it's proof that he was engaged and stealing it. If the fingerprints fit you must acquit. He tried to take a gun from a man who had the right to own it. He did not as a convicted felon have a right to even touch a gun. He was fleeing the scene of a burglary which was have put him back in jail by violating his probation. If he had been kept in jail full time for his sentence for his prior crimes he would still be alive today.
@scl974 жыл бұрын
Yes the Mc Micheals have the right to own guns and carry them. However, with such a huge right comes great responsibility. I have a question for you. Would a responsible gun owner approach a trespasser with a gun fully loaded? Think about it. What is responsible about that? If you were leaving some property and three men were chasing you with guns wouldn't you feel ambushed? Especially when you are UNARMED?!!! Dont tell me that they needed to bring a gun because they dont know the intentions of Arbery because both of them were armed. All they had to do was have one of them talk to Arbery UNARMED and have the other man keep a watchful eye just in case it got lethal.

A private person may arrest an offender if the offense was committed in their presence, if the offense was a felony, and the offender is escaping or fleeing. The men did not see Arbery commit a crime and if they did see him trespassing, that's a misdemeanor not a felony, so a citizens arrest is not lawful. The prosecutors argued that on day 1 or 2. Also fact, if you paid attention to this video, Arbery grabbed the gun after being shot in the chest first. That's called self defense. We have the right to defend ourselves if we fear for our lives. They are not and were not law enforcement in uniform. He didn't know who they were or their intentions.
