Alec Baldwin broke down in tears as a judge dismissed the involuntary manslaughter case against him for a fatal shooting on the set of the film Rust.
The trial collapsed three days into Baldwin's trial in Santa Fe, at a court just miles from where cinematographer Halyna Hutchins was shot with a revolver that Mr Baldwin was using in rehearsals.
It is the second time the case against the actor has been dismissed since the October 2021 shooting. He will not be tried again.
His lawyers alleged police and prosecutors hid evidence - a batch of bullets - that could have been connected to the shooting.

Worse than poorly prosecuted. The prosecutorial misconduct in the case is staggering. The hiding of evidence from the defense was just the worst of it, but it was party of a pattern of misconduct surrounding the discovery process. Indeed, if one credits the special prosecutor that she was unaware of the coverup, one could accuse her of “criminal negligence”, the same charge Baldwin was facing. 😂

Not really, he was bank rolling the film to which he went with the cheapest armour there is. After a scene he seen shouting quick quick re arm me so we can go again. He was as much to blame as anybody

Whoever brought live rounds on to the film set is responsible, whoever didn't secure the live rounds if they were even needed during filming for whatever reason is responsible. It is not the job of an actor to know a live round could be inside a prop gun when he was rehearsing, a shocking accident from his part for which I am sure he will feel guilt for the rest of his life, but it clearly was not his fault.

My belief is that this was a terrible tragedy that should never have occured, and ultimately, he should maybe not be criminally charged, but does bear some civil responsibility. However, there is clear evidence that would've been shown in this trial, and was shown in the HGR trial, that Baldwin was careless with his handling of guns, there were many instances of poor handling and management of dummy rounds, live rounds (which they knew were live) and other mismanagement from the production side of things. Alec Baldwin asserts in many interviews that he NEVER ever had his finger on the trigger of any gun on set. that he would NEVER put his finger on the trigger and point the gun at anybody. And yet, there is clear pictures of his finger wrapped around the trigger of guns multiple times outside of needing to during the filming of a scene. Also, the Screen Actors Guild (SAG) of which Alec is a member, has clear guidelines on the handling of guns from an actor's point of view which state that an actor must also take due diligence to ensure any gun they are handling is safe. There are multiple testimonies from people on set that Baldwin didn't do any checks, as well as the fact that HGR and other responsible production team members also didn't do proper checks in many instances.

There is no reason for live amunition to be on set. There is no reason why the gun would have live amunition loaded on set. There is no expectation for live amunition being on set.

Totally ridiculous that he was charged in the first place! How many thousands of times have actors shot a PROP gun relying on the armorer to provide a gun with blanks. This should have NEVER happened and he should sue those involved with this stupidity.

The fact that he was a producer on the film and the producers clearly hired cheap amateurs instead of well paid professionals to handle the guns is the real issue. I don’t understand why that wasn’t brought up in the trial.

This was the THIRD incidence of accidental discharge on the Rust set. Something like 6 camera crew quit 'due to safety concerns' within a week of this final shooting. But their concerns were dismissed, they were replaced and the show went on. Baldwin probably was negligent. However, the prosecutor still needed to follow the law. I saw a video of Baldwin's attorneys going through a number of violations by the prosecution a few months ago. I was surprised it wasn't dismissed back then.

1:33 _the prosecution suppressing evidence_ is one of the main flaws in the US criminal justice system. to have a system where public prosecutors can even entertain, let alone act on such thoughts, is subverting trust in the whole system.

I don't understand. There is a big difference between voluntarily suppress evidence and deciding that it wasn't evidence. Can't a prosecutor do that? Judges dismiss so-called "evidence" all the time. Besides this happened when the Guttierez trial. She should be the one being dismissed...

@@optimumposify what is the job of a public prosecutor? is it to accumulate convictions like trophies? or is it to put the bad guys out of service and let those go when there is lack of evidence, contradicting evidence or exonerating evidence? if there is evidence suggesting the accused didn't do it or it would most likely lead to other avenues, other suspects or opens up the case to new investigation etc; what does a public prosecutor do with such evidence? if there is any incentive to suppress that evidence, then the system is failing the public. it must be in the public prosecutors interest to either produce such evidence voluntarily (or by design when the counsel for the defendant looks at the files of the prosecution) or to make them close the case as this evidence exonerates the accused. the US lacks such rules. it makes many prosecutors resort to unethical steps. pair that with the possibility of the DA seeking [re-]election and you have the perfect recipe for corruption of the justice system.

@@optimumposify what kind of criminal justice system do you get when you allow prosecutors to 'voluntarily' suppress evidence which indicates an accused didn't do it and might get exonerated? this suppressed evidence would usually remain unknown to the court, to the judge, jury, the defendant and their counsel. can you see the most likely outcome and what it means for society?

Judges can decide what evidence is allowable. A prosecutor cannot decide on behalf of the defense what evidence is relevant. That’s the first basic principle that was violated. But the kicker is that the investigators working for the special prosecutor took action to hide the evidence. I’m not an expert but an educated layman. It seems to me that the investigators, including the crime scene technician, have opened themselves up to criminal charges of obstruction of justice and conspiracy to commit obstruction.

The armorer did not do her job. She is responsible for the securing the set and making sure that there is no live ammunition. However, in the case the Judge cited gross prosecutorial misconduct on the part of the investigators, prosecutors, and the DA itself.

The USA isn't "all over the world". In most countries, real weapons are for obvious reason not allowed on a film set, as they are _real_ weapons. The US has an insanely toxic weapons lobby called the NRA, responsible for buying and bullying legislators into bastardised readings of their constitution. They cut out all unwanted words of the second amendment and then use those out of context words to force deadly weapons into every crevasse of society, including workplaces where fiction is created.

Not responsible? He broke two of the most important firearm handling safety rules. A. Never point a gun at anything you don't intend to shoot. B. Finger off the trigger unless you intend to shoot. He did intentionally aim the gun, and he did intentionally pull the trigger. The gun didn't fire by itself. FBI tested the gun and declared it correctly functional. So don't whine some feeble excuse about a faulty gun either.

Everyone acknowledged it was an accident and not murder, although in this case people have an axe to grind against Baldwin for reasons unrelated to what happened on set.

Prosecutors are EVIL. They had tried to attach other charges to this case which would have added 5 years to the sentence. Prosecutors' EVIL job is to convict and do as much damage to their victim, aka the defendant, as they can. .

The defense is expected to provide the prosecution a list of witnesses so they can try to find a way to undermine their credibility, and the defense is expected to provide all evidence in case it's exculpatory. Moreover, it's not equal and opposite, so it DOESN'T balance out.

@@FirstLast-hs4gw What are you talking about? The Judge did not declare a "mistrial". The Judge "dismissed case with prejudice" which means the conduct of prosecutors broke the law. This is the most severe penalty that a judge can impose on the persecution for not doing their job.

Michael Massey wasn't even charged with Lee's death because of course not. But then, he wasn't as rich and famous as Baldwin is, and he didn't mock Bush in a scathing and hilarious parody, otherwise, North Carolina, where they were filming _The Crow,_ was indeed a red state in 1993, so they likely could/would have tried to get revenge and burn him.

The whole production of Rust was a failure from the start. They cut corners by hiring someone so unprofessional that jumped at the chance. They had another armorer before her that was a professional and warned them about the safety concerns. Alec Baldwin is a producer on Rust, he should've known better!

The Mission Impossible movies may take a decade to shoot or film! Or introducing a law that requires all actors who are handed prop guns to check if the bullets have live rounds. Sounds very silly. Imagine the director saying in every take: "Hey, we have a law that you cannot rehearse and point guns at the camera. Please check first your guns ALL the time if it contains live rounds".

It sounds to me like the prosecutor didn't want that evidence messing with her case. If she cared about justice she would've followed the evidence and went after everyone responsible. She just wanted to preserve her conviction rate

Because he didn't check himself. He was using the gun so the onus was on him. It's similar to the way parachutists pack their own chutes or you get asked at customs if you packed your own bags.

It wasn’t blank round. They were using replica rounds that look like live rounds. As live rounds are forbidden on set an actor could not tell the difference. It why they hire an armorer.

​@@TRSF1RACINGon movie sets they use both dummy rounds and blank rounds and they are very different. You are confusing the two different types of ammo. Blanks can fire but look different whereas dummy rounds look real but cannot fire. The case revolved around mixing a real live bullet with the 99 percent identical looking dummy rounds. It is the armourer and AD that are supposed to check the appropriate ammo is loaded in the gun.

True there should NEVER be live ammo on the set. BUT also... True Baldwin should NOT have been practicing drawing and firing a gun by pointing it at people. If he had pointed it anywhere there was no living being in the line of fire, then no one would have been killed. BOTH errors contributed to a tragic and needless death.

No he didn't. He told the truth that he didn't pull the trigger, he didn't say it didn't fire. "Pulling the trigger" is about INTENT, that he purposely pulled the trigger. That doesn't mean it didn't get pulled because of physics. There can be many reasons a gun could go off without the trigger being intentionally pulled. Saying he didn't pull it isn't the same as saying it didn't go off. You may not see a distinction, but the law does.
